4953 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5054 SECTION 1. AMENDATORY 63 O.S. 2021, Section 2 -415, is
5155 amended to read as follows:
5256 Section 2-415. A. The provisions of the Trafficking in Illegal
5357 Drugs Act shall apply to persons convicted of violations with
5458 respect to the following substances:
5559 1. Marijuana;
5660 2. Cocaine or coca leaves;
5761 3. Heroin;
5862 4. Amphetamine or methamphetamine;
5963 5. Lysergic acid diethylamide (LSD);
6064 6. Phencyclidine (PCP);

8792 7. Cocaine base, commonly known as "crack" or "rock";
8893 8. 3,4-Methylenedioxy methamphetamine, commonly known as
8994 "ecstasy" or MDMA;
9095 9. Morphine;
9196 10. Oxycodone;
9297 11. Hydrocodone;
9398 12. Benzodiazepine; or
9499 13. Fentanyl and its analogs and derivatives.
95100 B. Except as otherwise authorized by the Uniform Controlled
96101 Dangerous Substances Act, it shall be unlawful for any person to:
97102 1. Knowingly distribute, manufacture, b ring into this state or
98103 possess a controlled substance specified in subsection A of this
99104 section in the quantities specified in subsection C of this section;
100105 2. Possess any controlled substance with the intent to
101106 manufacture a controlled substance specifi ed in subsection A of this
102107 section in quantities specified in subsection C of this section; or
103108 3. Use or solicit the use of services of a person less than
104109 eighteen (18) years of age to distribute or manufacture a contro lled
105110 dangerous substance specified i n subsection A of this section in
106111 quantities specified in subsection C of this section.
107112 Violation of this section shall be known as "trafficking in
108113 illegal drugs". Separate types of controlled substances described
109114 in subsection A of this section when poss essed at the same time in

136142 violation of any provision of this section shall constitute a
137143 separate offense for each substance.
138144 Any person who commits the conduct described in paragraph 1, 2
139145 or 3 of this subsection and repr esents the quantity of the
140146 controlled substance to be an amount described in subsection C of
141147 this section shall be punished under the provisions appropriate for
142148 the amount of controlled substance represented, regardless of the
143149 actual amount.
144150 C. In the case of a violation of the provisions o f subsection B
145151 of this section, involving:
146152 1. Marijuana:
147153 a. twenty-five (25) pounds or more of a mixture or
148154 substance containing a detectable amount o f marijuana
149155 shall be punishable by a fine of not less than Twenty -
150156 five Thousand Dollars ($25,000.00) and not more than
151157 One Hundred Thousand Dollars ($100,000.00), or
152158 b. one thousand (1,000) pounds or more of a mixture or
153159 substance containing a detectable amount o f marijuana
154160 shall be deemed aggravated trafficking punishable by a
155161 fine of not less than One Hundr ed Thousand Dollars
156162 ($100,000.00) and not more than Five Hundred Thousand
157163 Dollars ($500,000.00);
158164 2. Cocaine, coca leaves or cocaine base:

402413 fine of not less than One Hundred Thousand Dollars ($100,000.00) and
403414 not more than Five Hundred Thousand Dollars ($500,000.00);
404415 10. Hydrocodone: Three thousand seven hundre d fifty (3,750)

445457 or carfentanil, or any fentanyl analogs or derivatives
446458 shall be trafficking punishable by a term of
447459 imprisonment in the custody of the Department of
448460 Corrections not to exceed twenty (20) years and by a
449461 fine of not less than One Hundred Thousand Dollars
450462 ($100,000.00) and not more tha n Two Hundred Fifty
451463 Thousand Dollars ($250,000.00), or
452464 b. five (5) grams or more of a mixture containing
453465 fentanyl or carfentanil, or any fent anyl analogs or
454466 derivatives shall be ag gravated trafficking punishable
455467 by a term of imprisonment in the custody of the

487500 D. Any person who violates the provisions of this section with
488501 respect to marijuana, cocaine, coca leaves, cocaine base, heroin,
489502 amphetamine or methamphetamine in a quantity specified in paragraphs
490503 1, 2, 3 and 4 of subsection C of this section shall, in addition to
491504 any fines specified by this section, be punishable by a term of
492505 imprisonment as follows:
493506 1. For trafficking, a first violation of this section, a term
494507 of imprisonment in the custody of the Department o f Corrections not
495508 to exceed twenty (20) years;
496509 2. For trafficking, a second violation of this section, a term
497510 of imprisonment in the Department of Corrections of not less than
498511 four (4) years nor more than life, for w hich the person shall serve
499512 fifty percent (50%) of the sentence before being eligible for parole
500513 consideration;
501514 3. For trafficking, a third or subsequent violation of this
502515 section, a term of imprisonment in the custody of the Department of
503516 Corrections of not less than twenty (20) years nor mor e than life,
504517 of which the person shall serve fifty percent (50%) of the sentence
505518 before being eligible for parole consideration.

532546 Persons convicted of trafficking shall not be eligible for
533547 earned credits or any other t ype of credits which have the effect of
534548 reducing the length of sentence to less than fifty percent (50%) of
535549 the sentence imposed; and
536550 If the person is conv icted of aggravated trafficking , the person
537551 shall serve eighty-five percent (85%) of such sentence be fore being
538552 eligible for parole consider ation.
539553 E. The penalties specified in subsections C and D of this
540554 section are subject to the enhancements enumerated in subsections E
541555 and F of Section 2-401 of this title.
542556 F. Any person convicted of any offense descr ibed in this
543557 section shall, in addition to any fine imposed, pay a special
544558 assessment trauma-care fee of One Hundred Dollars ($100.00) to be
545559 deposited into the Trauma Care Assistance Revolving Fund created in
546560 Section 1-2530.9 of this title and the assessme nt pursuant to
547561 Section 2-503.2 of this title.
548562 SECTION 2. This act shall become effective November 1, 2022.
