49	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
50	54		SECTION 1. AMENDATORY 63 O.S. 2021, Section 2 -415, is
51	55		amended to read as follows:
52	56		Section 2-415. A. The provisions of the Trafficking in Illegal
53	57		Drugs Act shall apply to persons convicted of violations with
54	58		respect to the following substances:
55	59		1. Marijuana;
56	60		2. Cocaine or coca leaves;
57	61		3. Heroin;
58	62		4. Amphetamine or methamphetamine;
59	63		5. Lysergic acid diethylamide (LSD);
60	64		6. Phencyclidine (PCP);

87	92		7. Cocaine base, commonly known as "crack" or "rock";
88	93		8. 3,4-Methylenedioxy methamphetamine, commonly known as
89	94		"ecstasy" or MDMA;
90	95		9. Morphine;
91	96		10. Oxycodone;
92	97		11. Hydrocodone;
93	98		12. Benzodiazepine; or
94	99		13. Fentanyl and its analogs and derivatives.
95	100		B. Except as otherwise authorized by the Uniform Controlled
96	101		Dangerous Substances Act, it shall be unlawful for any person to:
97	102		1. Knowingly distribute, manufacture, b ring into this state or
98	103		possess a controlled substance specified in subsection A of this
99	104		section in the quantities specified in subsection C of this section;
100	105		2. Possess any controlled substance with the intent to
101	106		manufacture a controlled substance specifi ed in subsection A of this
102	107		section in quantities specified in subsection C of this section; or
103	108		3. Use or solicit the use of services of a person less than
104	109		eighteen (18) years of age to distribute or manufacture a contro lled
105	110		dangerous substance specified i n subsection A of this section in
106	111		quantities specified in subsection C of this section.
107	112		Violation of this section shall be known as "trafficking in
108	113		illegal drugs". Separate types of controlled substances described
109	114		in subsection A of this section when poss essed at the same time in

136	142		violation of any provision of this section shall constitute a
137	143		separate offense for each substance.
138	144		Any person who commits the conduct described in paragraph 1, 2
139	145		or 3 of this subsection and repr esents the quantity of the
140	146		controlled substance to be an amount described in subsection C of
141	147		this section shall be punished under the provisions appropriate for
142	148		the amount of controlled substance represented, regardless of the
143	149		actual amount.
144	150		C. In the case of a violation of the provisions o f subsection B
145	151		of this section, involving:
146	152		1. Marijuana:
147	153		a. twenty-five (25) pounds or more of a mixture or
148	154		substance containing a detectable amount o f marijuana
149	155		shall be punishable by a fine of not less than Twenty -
150	156		five Thousand Dollars ($25,000.00) and not more than
151	157		One Hundred Thousand Dollars ($100,000.00), or
152	158		b. one thousand (1,000) pounds or more of a mixture or
153	159		substance containing a detectable amount o f marijuana
154	160		shall be deemed aggravated trafficking punishable by a
155	161		fine of not less than One Hundr ed Thousand Dollars
156	162		($100,000.00) and not more than Five Hundred Thousand
157	163		Dollars ($500,000.00);
158	164		2. Cocaine, coca leaves or cocaine base:

203	210		3. Heroin:
204	211		a. ten (10) grams or more of a mixture or substance
205	212		containing a detectable amount of heroin shall be

304	313		6. Phencyclidine (PCP):
305	314		a. twenty (20) grams or more of a substance containing a
306	315		mixture or substance containing a detectable amount of
307	316		phencyclidine (PCP) shall be trafficking punishable by

350	360		substance containing a detectable amoun t of 3,4-
351	361		Methylenedioxy methamphetamine s hall be trafficking
352	362		punishable by a term of imprisonment in the custody of
353	363		the Department of Corrections not to exceed twenty
354	364		(20) years and by a fine of not less than Twenty -five
355	365		Thousand Dollars ($25,000.00) and n ot more than One

395	406		Department of Corrections not to exceed twenty (20) years and by a
396	407		fine of not less than One Hundred Thousand D ollars ($100,000.00) and
397	408		not more than Five Hundred Thousand Dollars ($500,000.00);
398	409		9. Oxycodone: Four hundred (400) grams or more of a mixture
399	410		containing a detectable amount of oxycodone shall be trafficking
400	411		punishable by a term of imprisonment in the c ustody of the
401	412		Department of Corrections not to exceed twenty (20) years and by a
402	413		fine of not less than One Hundred Thousand Dollars ($100,000.00) and
403	414		not more than Five Hundred Thousand Dollars ($500,000.00);
404	415		10. Hydrocodone: Three thousand seven hundre d fifty (3,750)
405	416		grams or more of a mixture containing a detectable amount of
406	417		hydrocodone shall be trafficking punishable by a term of

444	456		a. one (1) gram or more of a mixture containing fentanyl
445	457		or carfentanil, or any fentanyl analogs or derivatives
446	458		shall be trafficking punishable by a term of
447	459		imprisonment in the custody of the Department of
448	460		Corrections not to exceed twenty (20) years and by a
449	461		fine of not less than One Hundred Thousand Dollars
450	462		($100,000.00) and not more tha n Two Hundred Fifty
451	463		Thousand Dollars ($250,000.00), or
452	464		b. five (5) grams or more of a mixture containing
453	465		fentanyl or carfentanil, or any fent anyl analogs or
454	466		derivatives shall be ag gravated trafficking punishable
455	467		by a term of imprisonment in the custody of the
456	468		Department of Corrections of not less than two (2)

487	500		D. Any person who violates the provisions of this section with
488	501		respect to marijuana, cocaine, coca leaves, cocaine base, heroin,
489	502		amphetamine or methamphetamine in a quantity specified in paragraphs
490	503		1, 2, 3 and 4 of subsection C of this section shall, in addition to
491	504		any fines specified by this section, be punishable by a term of
492	505		imprisonment as follows:
493	506		1. For trafficking, a first violation of this section, a term
494	507		of imprisonment in the custody of the Department o f Corrections not
495	508		to exceed twenty (20) years;
496	509		2. For trafficking, a second violation of this section, a term
497	510		of imprisonment in the Department of Corrections of not less than
498	511		four (4) years nor more than life, for w hich the person shall serve
499	512		fifty percent (50%) of the sentence before being eligible for parole
500	513		consideration;
501	514		3. For trafficking, a third or subsequent violation of this
502	515		section, a term of imprisonment in the custody of the Department of
503	516		Corrections of not less than twenty (20) years nor mor e than life,
504	517		of which the person shall serve fifty percent (50%) of the sentence
505	518		before being eligible for parole consideration.

532	546		Persons convicted of trafficking shall not be eligible for
533	547		earned credits or any other t ype of credits which have the effect of
534	548		reducing the length of sentence to less than fifty percent (50%) of
535	549		the sentence imposed; and
536	550		If the person is conv icted of aggravated trafficking , the person
537	551		shall serve eighty-five percent (85%) of such sentence be fore being
538	552		eligible for parole consider ation.
539	553		E. The penalties specified in subsections C and D of this
540	554		section are subject to the enhancements enumerated in subsections E
541	555		and F of Section 2-401 of this title.
542	556		F. Any person convicted of any offense descr ibed in this
543	557		section shall, in addition to any fine imposed, pay a special
544	558		assessment trauma-care fee of One Hundred Dollars ($100.00) to be
545	559		deposited into the Trauma Care Assistance Revolving Fund created in
546	560		Section 1-2530.9 of this title and the assessme nt pursuant to
547	561		Section 2-503.2 of this title.
548	562		SECTION 2. This act shall become effective November 1, 2022.
