4956 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5057 SECTION 1. NEW LAW A new section of law to be codified
5158 in the Oklahoma Statutes as Section 702 of Title 10, unless there is

5360 This act shall be known and may be cited as the "Parent

86-Parent Representation Program shall be to ensure uniform and high-
87-quality legal representation for indigent pa rents, legal guardians,
88-and custodians in deprived child actions brought by the state
89-pursuant to the provisions of Sec tion 1–1–101 et seq. of Title 10A
90-of the Oklahoma Statutes.
89+SECTION 2. NEW LAW A new section of law to be codified
90+in the Oklahoma Statutes as Section 703 of Title 10, unless there is
91+created a duplication in numbering, reads as follows:
92+A. There is hereby created within an agency to be selected by
93+the Oklahoma Supreme Court's Uniform Repre sentation of Children and
94+Parents in Cases Involving Abuse and Neglect Oversi ght Committee the
95+Parent Representation Program. The purpose of the Parent
96+Representation Program shall be to ensure uniform and high-quality
97+legal representation for indigent pa rents, legal guardians, and
98+custodians in deprived child actions brought by the state pursuant
99+to the provisions of Sec tion 1–1–101 et seq. of Title 10A of the
100+Oklahoma Statutes.
91101 B. From funds appropriated or otherwise avail able for the
92102 purpose of implementing the Parent Representation Act , an agency to
93-be selected by the Administrative Office of the Courts shall issue a
94-request for proposals and contract with an eligible organization to
95-administer the Parent Representation Program through the
96-establishment of a central office for the state. The Parent
97-Representation Program , through the activities of the central
98-office, shall work statewide cooperatively with judicial districts
99-and attorneys by contracting with, training, compensating, and
100-supporting legal counsel for the parents, legal guardians, and
101-custodians appointed by the court pursuant to Se ction 1-4-306 of
102-Title 10A of the Oklahoma Statutes. The Parent Representation
103-Program shall have the responsibility to ensure that all parents ,
104-legal guardians, and custodians who are entitled to court-appointed
105-counsel are appointed counsel who have the training, support, and
106-access to resources to provide uniform and high-quality legal

141+Representation Program shall have the responsibility to ensure that
142+all parents, legal guardians, and custodians who are entitled to
143+court-appointed counsel are appointed counsel who have the training,
144+support, and access to reso urces to provide uniform and high-quality
145+legal representation. The central office s hall not provide direct
146+legal representation to clients except in selected appeals.
135147 C. An executive director for the Parent Represen tation Program
136148 shall be employed by th e eligible organization and approved by the
137149 Parent Representation Program Board. The executive director must
138150 have at least ten (10) years of experience as a licensed attorney
139151 prior to appointment, be licensed to practice law in Oklahoma at the
140152 time of appointment, and be familiar with the unique demands of
141153 representing parents, legal guardians, and cus todians in deprived
142154 child cases in Oklahoma. The executive director shall devote
143155 himself or herself full time to the performance of his or her duties
144156 as executive director and shall not engage in private pra ctice of
145157 law. The executive director, on behalf of the Parent Representation
146158 Program, shall hire all staff, including employees of the central
147159 office and contract attorneys or other legal providers eligib le for
148160 appointment pursuant to Section 1-4-306 of Title 10A of the Oklahoma
149161 Statutes and interdisciplinary contrac tors required to implement the
150162 Parent Representation Act. The executive director shall submit
151-budget requests and shall report quarterly to t he Parent
152-Representation Program Board.
153-D. The Parent Representation Program shall have authority to
154-contract with any type of legal entity, including, but not limited
155-to, law firms, legal services programs, law school clinics, and
156-individual attorneys as needed. In addition, the Parent
157-Representation Program sha ll have authority to contract with and

188201 E. The Parent Representation Program shall ensure tha t all
189202 counsel are members of the Okl ahoma Bar Association in good standing
190203 and are adequately trained. The Parent Representation Program shall
191204 provide uniform and high -quality training in collaboration with the
192205 State of Oklahoma Children's Court Improvement Program, the Oklahoma
193206 Bar Association, local bar associations, and other relevant stat e
194207 and national organizations to all attorneys who r epresent parents,
195208 legal guardians, and custodians in deprived child proceedings. The
196209 Parent Representation Progra m shall verify that contracted att orneys
197210 providing legal representation to parents, legal guardians , and
198211 custodians meet the standards of prac tice as approved by the
199212 Oklahoma Supreme Court and caseload limits as developed and
200-recommended by the Administrative Office of the Courts created by
201-the Oklahoma Supreme Court. In addition, the Parent Representation
202-Program shall ensure that all interdisciplinary contrac tors are
203-provided with unifor m and evidence-based training, resources, and
204-support.
205-F. The Parent Represent ation Program shall ens ure that all
206-areas of the state are equi tably served and, based on the
207-appropriations available , shall prioritize those judicial districts
208-where attorneys are unavailable for court appointments or are

246+F. The Parent Represent ation Program shall ens ure that all

235250 minimally compensated. The Parent Representation Progr am shall
236251 determine where additional attorneys are needed within the sta te's
237252 judicial districts and shall develop additional resour ces.
238253 G. The Parent Representation Program shall ensure that counsel
239254 and interdisciplinary contractors are adequately compensated based
240255 on available appropriations an d other funding received and ar e
241256 provided access to resources in order to deliver high -quality legal
242257 representation. The Parent Representation Program is autho rized to
243258 annually review the performance of the attorneys, interdisciplinary
244259 contractors, and entities with which the eligible organization
245260 contracts, with the goal of helping them to achieve and maintain
246261 high-quality performance. The Parent Representation Program shall
247262 ensure that review measures preserve client confidentiality and
248263 avoid conflicts of interest.

252-A. For the purpose of establishing and p roviding oversight for
253-the Parent Representation Program, there is hereby created the
254-Parent Representation Program Board wi thin an agency to be selected
255-by the Administrative Office of the Courts . The Board shall consist
256-of twelve (12) members as follows:
257-1. One member appointed, initially for a one -year term, by the
258-President Pro Tempore of the Oklahoma State Senate;

294+A. For the purpose of establishing and p roviding oversight for

296+Parent Representation Program Board wi thin an agency to be selected

299+Committee. The Board shall consist of twel ve (12) members as
300+follows:
301+1. One member appointed, initially for a one -year term, by the
302+President Pro Tempore of the Oklahoma State Senate;

286304 Speaker of the Oklahoma House of Representatives ;
287305 3. Three members appointed by the Chief Justice of the Oklahoma
288306 Supreme Court, one each initially to be appointed for one-, two-,
289307 and three-year terms, one of whom shall be a retired district or
290308 associate district court judge who served in the juvenile division
291309 of any Oklahoma district court;
292310 4. Three members appointed by the president of the Oklahoma Bar
293311 Association, one each initially to be a ppointed for one-, two-, and
294-three-year terms, who shall be attorneys with at least five (5)
295-years of experience in representing parents and children in depriv ed
296-child proceedings;
297-5. One member of the Juvenile Justice Oversight and Advisory
298-Committee to be appointed by the Committee, initially for a two-year
299-term;
300-6. The project director for the Stat e of Oklahoma Children's
301-Court Improvement Program, or a des ignee, to be appointed initially
302-for a two-year term;
303-7. One member appointed by the Department of Mental Health and
304-Substance Abuse Services who shall be a parent with lived experience
305-with the child welfare system, to be appointed initially for a
306-three-year term; and
312+three-year terms who shall be attorneys with at least five (5) years
313+of experience in representing parents and children in depriv ed child

337356 shall serve until a qualified successor is appointed. A vacancy
338357 shall be filled for the remainder of the term in the same manner as
339358 a regular appointment. Members may be reappointed to successive
340359 terms. Members of the Board shall receive no compensation for their
341360 services on the Board but may be reimbursed pursuant to the State
342361 Travel Reimbursement Act.
343362 B. The Parent Representation Program Board sh all:
344363 1. Annually elect one member to serve as chair and one member
345364 to serve as vice-chair;
346-2. Meet not less than quarterly and may meet more frequently a s
347-necessary, as determined by the chair. Seven members shall
348-constitute a quorum;
349-3. Review proposals by eligible organizations received by an
350-agency to be selected by the Administrative Office of the Courts
351-pursuant to Section 2 of this act and recommend to an agency to be
352-selected by the Administrative Office of the Courts an eligible
353-organization to administer the Parent Representation Progra m;
354-4. Exercise oversight on be half of an agency to be selecte d by
355-the Administrative Office of the Courts over the selected eligible

385410 governance to the Parent Representation Program, to provide fiscal
386411 oversight of the general operating budget of the prog ram's central
387412 office, to participate in funding decisions relating to the
388413 provision and expansion of parent counsel and the interdisciplinary
389414 contractors within the state , based on annual appropriations and
390-funds received, and to assist with the duties of t he program's
391-central office concerning parent counsel training, as needed;
392-6. Prepare the rules, standards, training requirements for
393-attorneys and interdisciplinary contractors, and guidelines
394-necessary to carry out the responsibilities of the Parent
395-Representation Program for the approval of and promulgation by an
396-agency to be selected by the Administrative Office of the Courts ;
397-and
398-7. Prepare annually and distrib ute to an agency to be selected
399-by the Administrative Office of the Courts budget requests and a
400-report detailing expenditures of funds for the operating expens es of
401-the Parent Representatio n Program, activity data, and performance
402-measures from implementation of the program within the selected
403-judicial districts. An agency to be selected b y the Administrative
404-Office of the Courts shall distribute the proposed budget and the
405-report to the Speaker of the House of Representatives and the

463+the appropriate committee chairs of the respective chambers .
435464 C. As used in this section, "eligible organization" means an
436465 entity that:
437-1. Is organized as a not -for-profit corporation that is tax
438-exempt pursuant to the provisions of paragraph (3) of subsection (c)
439-of Section 501 of the United States Internal Revenue Code of 1986,
440-as amended;
441-2. Has as its primary purpose the furnishing of legal
442-assistance to eligible clients in civil matters;
443-3. Renders legal services to eligible clients in pre- and post-
444-petition deprived child proceedings; and
445-4. Is incorporated pursuant to any applicable laws in this
446-state.
447-SECTION 4. NEW LAW A new section of law t o be codified
448-in the Oklahoma Statutes as Sec tion 705 of Title 10, unless there is
449-created a duplication in numbering, reads as follows:
450-A. There is hereby created in the State Treasury a revolving
451-fund for an agency to be selected by the Administrative Office of
452-the Courts to be designated the "Parent Representation Program
453-Revolving Fund". The fund shall be a continuing fund, not subject
454-to fiscal year limitat ions, and shall consist of all monies received
455-by an agency to be selected by the Administrative Office of the

483-representation services to be provided by th e Parent Representation
484-Program. The revolving fund shall include funds appropriated to the
485-fund, federal funds, gifts, donations, and grants. All monies
486-accruing to the credit o f said fund are hereby appropriated and may
487-be budgeted and expended by an agency to be selected by the
488-Administrative Office of the Courts pursuant to the recommenda tions
489-of the Parent Represen tation Program Board for the purpose of
490-administering the Parent Representation Program and for the
491-provision of legal and interdisciplinary services to indigent
492-parents by and through the Parent Represent ation Program. By
493-January 31, 2023, and by January 31 of each year thereafter, an
494-agency to be selected by the Administrative Office of the Courts
495-shall disburse funds from the Parent Representation Program
496-Revolving Fund to the contracted eligible organizat ion.
497-B. An agency to be select ed by the Administrative Office of the
498-Courts shall allocate and expend funds from the Parent
499-Representation Program Revolving Fund as recommended by the Parent
500-Representation Program Board to p rovide for the necessary operating
501-costs of the Parent Representation Pr ogram, including court-
502-appointed legal and interdisciplinary representation to indigent
503-parents, legal guardians, or custodians in proceedings governed b y
504-the Oklahoma Children 's Code, to the extent that funds are available
505-from the Parent Representation Program Revolving Fund. An agency to

537-C. The eligible organization that contracts to operate and

539-interdisciplinary services shall mai ntain books and records in
540-accordance with generally accepted accounting principles. The books
541-and records shall ac count for the receipt and expenditure of all
542-funds paid pursuant to contract. Books and records shall be
543-maintained for a period of five (5) years from the close of the
544-fiscal year of the contract period. The State Auditor and Ins pector
545-shall audit each organization annually. The necessary expense of
546-each audit, including, but not limited to, the cost of typing,
547-printing, and binding, shall be paid from funds of the organization.

550-deposited in the Parent Representation Program Revolving Fund
