52	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	56		SECTION 1. AMENDATORY 70 O.S. 2021, S ection 6-101.10, is
54	57		amended to read as follows:
55	58		Section 6-101.10 A. Each school district board of education
56	59		shall maintain and annually review, following cons ultation with or
57	60		involvement of representatives s elected by local teachers, a written
58	61		policy of evaluation and corresponding professional development for
59	62		all teachers and administrators. In those school districts in which
60	63		there exists a professional negot iations agreement made in
61	64		accordance with Section 509.1 et seq. of this title, the procedure
62	65		for evaluating members of the negotiations unit and any standards of

	93	+	performance and conduct proposed for adoption beyond those
90	94		established by the State Board of E ducation shall be negot iable
91	95		items. Nothing in t his section shall be construed to annul, modify
92	96		or to preclude the renewal or continuing of any existing agreement
93	97		heretofore entered into between any school district and any
94	98		organizational representative of its employees. Every policy of
95	99		evaluation adopted by a board of education shall:
96	100		1. Be based upon a set of minimum criteria developed by the
97	101		State Board of Education, which shall be revised and based upon the
98	102		Oklahoma Teacher and Leader Effectiveness Ev aluation System (TLE)
99	103		developed by the State Boar d of Education as provided in Section 6 -
100	104		101.16 of this title. The revisions to each policy of evaluation
101	105		shall be phased in according to the following schedule:
102	106		a. for the 2014-2015, 2015-2016 and 2016-2017 school
103	107		years, the evaluation rating of teachers and
104	108		administrators shall be based on the qualit ative
105	109		component of the TLE. For the 2016 -2017 school year,
106	110		the State Department of Education shall work with
107	111		school districts to develop individualized program s of
108	112		professional development as described in sub section B
109	113		of this section. However, nothing in this
110	114		subparagraph shall preclude a school district with an
111	115		average daily attendance of more than thirty -five
112	116		thousand (35,000) from continuing to use quantitat ive

140	145		own expense prior to the 2015 -2016 school year into
141	146		its evaluation system of teachers and administrators,
142	147		as defined by the district 's written policy,
143	148		b. for evaluations of teachers and administrato rs
144	149		conducted during the 2017-2018 school year, an d each
145	150		school year thereafter, school districts shall
146	151		incorporate and put into operation the qualitative
147	152		component of the TLE as provided for in subsection B
148	153		of Section 6-101.16 of this title into the evalua tions
149	154		used in all school sites within the distric t. For the
150	155		2017-2018 school year, and each sch ool year
151	156		thereafter, teachers and administrators shall receive
152	157		a district evaluation rating based on the components
153	158		of the TLE as set forth in subsection B of S ection 6-
154	159		101.16 of this title. For the 2017 -2018 school year,
155	160		school districts shall incorporat e the individualized
156	161		programs of professional development as described in
157	162		subsection B of this section on a pilot program basis,
158	163		and
159	164		c. for evaluations of teach ers and administrators
160	165		conducted during the 2018 -2019 school year, and each
161	166		school year thereaft er, school districts shall fully
162	167		incorporate and put into operation the individualized

190	196		subsection B of this section;
191	197		2. Be prescribed in writing at the tim e of adoption and at all
192	198		times when amendments to the policy are adopted. The original
193	199		policy and all amendments to the policy shall be promptly made
194	200		available to all persons subject to the policy;
195	201		3. Provide that all evaluation s be made in writing and t hat
196	202		evaluation documents and responses thereto be maintained in a
197	203		personnel file for each evaluated person;
198	204		4. Provide that every probationary teacher receive formative
199	205		feedback from the evaluation process at least two times per school
200	206		year, once during the fall semester and once during the spring
201	207		semester;
202	208		5. Provide that every teacher be evaluated once every year,
203	209		except for career teachers receiving a district evaluation rating of
204	210		"superior" or "highly effective" under the TLE who may be evaluated
205	211		once every three (3) years; and
206	212		6. Provide that, except for superintendents of independent and
207	213		elementary school districts and superintendents of area school
208	214		districts who shall be evaluated by the school distr ict board of
209	215		education, all certified personnel s hall be evaluated by a
210	216		principal, assistant pri ncipal, designee of the principal,
211	217		supervisor, content expert, department chair, peer committee or

238	245		other trained persons or groups of persons designated by the school
239	246		district board of education.
240	247		B. 1. Every policy of professional development adopted by a
241	248		school district board of education shall provide for the development
242	249		of a focused and individualized program of professional development
243	250		for the teacher or ad ministrator that is con sistent with the
244	251		qualitative component of the TLE. The policy of profess ional
245	252		development shall:
246	253		a. establish an annual professional growth goal for the
247	254		teacher or administrator that is developed by the
248	255		teacher or administrator in c ollaboration with the
249	256		evaluator,
250	257		b. be tailored to address a specific area or criteria
251	258		identified through the qualitative component of the
252	259		TLE,
253	260		c. allow the teacher or administrator to actively engage
254	261		with learning practices that are evidence -based,
255	262		researched practices that are correlated with
256	263		increased student achievement, and
257	264		d. be supported by resources that are easily available
258	265		and supplied by the school district and the State
259	266		Department of Education.
260	267		2. School districts shall monitor compliance with each
261	268		individualized program of professional devel opment implemented

288	296		pursuant to this subsection. All professional development completed
289	297		pursuant to an individualized program of professional development
290	298		shall count toward the total number of points a teach er or
291	299		administrator is required to complete as es tablished by a school
292	300		district board of educati on pursuant to Section 6 -194 of this title.
293	301		The implementation of the individualized program of professional
294	302		development required by this subsection shall not be construed as
295	303		increasing the professional devel opment points requirements.
296	304		3. Individualized programs of professional development required
297	305		by this subsection may include but are not limited to the following
298	306		learning practices:
299	307		a. presenter-led workshops,
300	308		b. individual or faculty studies of books, scho larly
301	309		articles and video productions,
302	310		c. peer observations,
303	311		d. committee studies to address student achievement
304	312		issues,
305	313		e. work related to a specific subject area or areas
306	314		associated with obtaining an advanc ed degree or
307	315		professional certification,
308	316		f. action research projects designed to improve student
309	317		achievement, and

336	345		g. participation in local, regional or state initiatives
337	346		associated with the development or implementation of
338	347		curriculum standards.
339	348		4. If the total amount of required federal, state, and local
340	349		school district professional develop ment for a teacher exceeds
341	350		twenty-four (24) hours in a single school year , the teacher shall be
342	351		exempt from completing the Professional Learning Focus requirement
343	352		for the school year.
344	353		C. All individuals designated by the school district board of
345	354		education to conduct th e personnel evaluations shall be required to
346	355		participate in training conducted by the State Department of
347	356		Education or training provided by the school district using
348	357		guidelines and materials developed by the State Department of
349	358		Education prior to conductin g evaluations.
350	359		D. The State Department of Education shall develop and conduct
351	360		workshops pursuant to statewide criteria which train individuals in
352	361		conducting evaluations.
353	362		E. The State Board of Education shall monitor compliance with
354	363		the provisions of this section by school districts.
355	364		F. The State Board of Education shall study continued
356	365		implementation of the TLE to produce a system that promotes
357	366		reflection and professional grow th for teachers and leader s.

384	394		G. Refusal by a school district to comply with th e provisions
385	395		of this section shall be grounds for withholding State Aid funds
386	396		until compliance occurs.
387	397		H. Data collected pursuant to this section shall not be subject
388	398		to the Oklahoma Open Meeting Act or the Oklahoma Open Records Act.
389	399		SECTION 2. This act shall become effective November 1, 2022.
