5255 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5356 SECTION 1. AMENDATORY 70 O.S. 2021, S ection 6-101.10, is
5457 amended to read as follows:
5558 Section 6-101.10 A. Each school district board of education
5659 shall maintain and annually review, following cons ultation with or
5760 involvement of representatives s elected by local teachers, a written
5861 policy of evaluation and corresponding professional development for
5962 all teachers and administrators. In those school districts in which
6063 there exists a professional negot iations agreement made in
6164 accordance with Section 509.1 et seq. of this title, the procedure
6265 for evaluating members of the negotiations unit and any standards of

93+performance and conduct proposed for adoption beyond those
9094 established by the State Board of E ducation shall be negot iable
9195 items. Nothing in t his section shall be construed to annul, modify
9296 or to preclude the renewal or continuing of any existing agreement
9397 heretofore entered into between any school district and any
9498 organizational representative of its employees. Every policy of
9599 evaluation adopted by a board of education shall:
96100 1. Be based upon a set of minimum criteria developed by the
97101 State Board of Education, which shall be revised and based upon the
98102 Oklahoma Teacher and Leader Effectiveness Ev aluation System (TLE)
99103 developed by the State Boar d of Education as provided in Section 6 -
100104 101.16 of this title. The revisions to each policy of evaluation
101105 shall be phased in according to the following schedule:
102106 a. for the 2014-2015, 2015-2016 and 2016-2017 school
103107 years, the evaluation rating of teachers and
104108 administrators shall be based on the qualit ative
105109 component of the TLE. For the 2016 -2017 school year,
106110 the State Department of Education shall work with
107111 school districts to develop individualized program s of
108112 professional development as described in sub section B
109113 of this section. However, nothing in this
110114 subparagraph shall preclude a school district with an
111115 average daily attendance of more than thirty -five
112116 thousand (35,000) from continuing to use quantitat ive

144+components which the district has incorporate d at its
140145 own expense prior to the 2015 -2016 school year into
141146 its evaluation system of teachers and administrators,
142147 as defined by the district 's written policy,
143148 b. for evaluations of teachers and administrato rs
144149 conducted during the 2017-2018 school year, an d each
145150 school year thereafter, school districts shall
146151 incorporate and put into operation the qualitative
147152 component of the TLE as provided for in subsection B
148153 of Section 6-101.16 of this title into the evalua tions
149154 used in all school sites within the distric t. For the
150155 2017-2018 school year, and each sch ool year
151156 thereafter, teachers and administrators shall receive
152157 a district evaluation rating based on the components
153158 of the TLE as set forth in subsection B of S ection 6-
154159 101.16 of this title. For the 2017 -2018 school year,
155160 school districts shall incorporat e the individualized
156161 programs of professional development as described in
157162 subsection B of this section on a pilot program basis,
158163 and
159164 c. for evaluations of teach ers and administrators
160165 conducted during the 2018 -2019 school year, and each
161166 school year thereaft er, school districts shall fully
162167 incorporate and put into operation the individualized

190196 subsection B of this section;
191197 2. Be prescribed in writing at the tim e of adoption and at all
192198 times when amendments to the policy are adopted. The original
193199 policy and all amendments to the policy shall be promptly made
194200 available to all persons subject to the policy;
195201 3. Provide that all evaluation s be made in writing and t hat
196202 evaluation documents and responses thereto be maintained in a
197203 personnel file for each evaluated person;
198204 4. Provide that every probationary teacher receive formative
199205 feedback from the evaluation process at least two times per school
200206 year, once during the fall semester and once during the spring
201207 semester;
202208 5. Provide that every teacher be evaluated once every year,
203209 except for career teachers receiving a district evaluation rating of
204210 "superior" or "highly effective" under the TLE who may be evaluated
205211 once every three (3) years; and
206212 6. Provide that, except for superintendents of independent and
207213 elementary school districts and superintendents of area school
208214 districts who shall be evaluated by the school distr ict board of
209215 education, all certified personnel s hall be evaluated by a
210216 principal, assistant pri ncipal, designee of the principal,
211217 supervisor, content expert, department chair, peer committee or

239246 district board of education.
240247 B. 1. Every policy of professional development adopted by a
241248 school district board of education shall provide for the development
242249 of a focused and individualized program of professional development
243250 for the teacher or ad ministrator that is con sistent with the
244251 qualitative component of the TLE. The policy of profess ional
245252 development shall:
246253 a. establish an annual professional growth goal for the
247254 teacher or administrator that is developed by the
248255 teacher or administrator in c ollaboration with the
249256 evaluator,
250257 b. be tailored to address a specific area or criteria
251258 identified through the qualitative component of the
252259 TLE,
253260 c. allow the teacher or administrator to actively engage
254261 with learning practices that are evidence -based,
255262 researched practices that are correlated with
256263 increased student achievement, and
257264 d. be supported by resources that are easily available
258265 and supplied by the school district and the State
259266 Department of Education.
260267 2. School districts shall monitor compliance with each
261268 individualized program of professional devel opment implemented

288296 pursuant to this subsection. All professional development completed
289297 pursuant to an individualized program of professional development
290298 shall count toward the total number of points a teach er or
291299 administrator is required to complete as es tablished by a school
292300 district board of educati on pursuant to Section 6 -194 of this title.
293301 The implementation of the individualized program of professional
294302 development required by this subsection shall not be construed as
295303 increasing the professional devel opment points requirements.
296304 3. Individualized programs of professional development required
297305 by this subsection may include but are not limited to the following
298306 learning practices:
299307 a. presenter-led workshops,
300308 b. individual or faculty studies of books, scho larly
301309 articles and video productions,
302310 c. peer observations,
303311 d. committee studies to address student achievement
304312 issues,
305313 e. work related to a specific subject area or areas
306314 associated with obtaining an advanc ed degree or
307315 professional certification,
308316 f. action research projects designed to improve student
309317 achievement, and

336345 g. participation in local, regional or state initiatives
337346 associated with the development or implementation of
338347 curriculum standards.
339348 4. If the total amount of required federal, state, and local
340349 school district professional develop ment for a teacher exceeds
341350 twenty-four (24) hours in a single school year , the teacher shall be
342351 exempt from completing the Professional Learning Focus requirement
343352 for the school year.
344353 C. All individuals designated by the school district board of
345354 education to conduct th e personnel evaluations shall be required to
346355 participate in training conducted by the State Department of
347356 Education or training provided by the school district using
348357 guidelines and materials developed by the State Department of
349358 Education prior to conductin g evaluations.
350359 D. The State Department of Education shall develop and conduct
351360 workshops pursuant to statewide criteria which train individuals in
352361 conducting evaluations.
353362 E. The State Board of Education shall monitor compliance with
354363 the provisions of this section by school districts.
355364 F. The State Board of Education shall study continued
356365 implementation of the TLE to produce a system that promotes
357366 reflection and professional grow th for teachers and leader s.

384394 G. Refusal by a school district to comply with th e provisions
385395 of this section shall be grounds for withholding State Aid funds
386396 until compliance occurs.
387397 H. Data collected pursuant to this section shall not be subject
388398 to the Oklahoma Open Meeting Act or the Oklahoma Open Records Act.
389399 SECTION 2. This act shall become effective November 1, 2022.
