3846 An Act relating to the Grand River Dam Authority;
3947 amending 82 O.S. 2021, Section 862.1, which relates
4048 to Grand River Dam Authority exemptions; providing
4149 for certain Oklahoma Open Records Act exemptions; and

4856 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4957 SECTION 1. AMENDATORY 82 O.S . 2021, Section 862.1, is
5058 amended to read as follows:
5159 Section 862.1 In addition to the powers, rights and privileges
5260 enumerated in Section 862 of this title, the Grand River Dam
5361 Authority shall be exempt fro m the provisions of the:
5462 1. The Oklahoma Open R ecords Act, exclusively limited to:
5563 a. customer proprietary information the Authority is
5664 contractually obligated to keep confidential , and
5765 b. security plans and procedures in its role as an
5866 electric utility regulated by the federal government ,

60-dam infrastructure and re lated information systems
61-that, if misused, could facilitate actual, potential,

96+that, if misused, could facilitate actual, potential,

8998 of, or incapacitation of such in frastructure or

92101 systems to resist such interference , compromise, or
93102 incapacitation, including an y planned or past
94103 assessment, projection, or estimate of the
95104 vulnerability of critical infrastructure or
96105 information system, security testing, risk evaluation
97106 thereto, risk management planning, operational plans,
98107 structural schematics, recovery of response plans or
99108 risk audits, and
100109 d. proprietary or commercial information received subject
101110 to a nondisclosure agreement or confidentiality
102111 agreement;
103112 2. The Oklahoma Open Meeting Act, exclusively limited to
104113 authorizing the Grand River Dam Authority Board of Directors to
105114 confer on:
106115 a. coal or gas fuel supply and transportation contracts ,
107116 b. power purchase agreements, and
108-c. security plans and procedures in its role as an
109-electric utility regulated by the federal government;
110-and
111-3. Title 61 of the Oklahoma Statutes;

138148 4. The Information Tech nology Consolidation and Coordination
139149 Act;
140150 5. The State Travel Reimbursement Act; and
141151 6. The Surplus Property Act; provided that the district may, on
142152 a transactional basis, elect to make itself subject to the
143153 requirements of the Surplus Property Act.
144154 SECTION 2. This act shall become e ffective November 1, 2022.
