2451 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:

2652 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-229.35, is
2753 amended to read as follows:

2954 Section 1-229.35 A. Beginning July 1, 2022 2023, every
3055 manufacturer of a vapor product that is sold or intended to be sold
3156 in this state, whether directly or through a distributor, re tailer,
3257 or similar intermediary or intermediaries, shall execute and deliver
3358 an attestation under penalty of perjury to the Oklahoma Alcoholic
3459 Beverage Laws Enforcement (ABLE) Commission cer tifying that, as of
3560 the date of such attestation:

3761 1. The vapor product was available for purchase in the United
3862 States as of August 8, 2016, and the manufacturer has applied for a
3963 marketing order for the vap or product by submitting a Premarket

4091 Tobacco Product Application on or before September 9, 2020, to the
4192 United States Food and Drug Administration (FDA); or

4393 2. The manufacturer has received a marketing order or other
4494 authorization for the vapor product fr om the FDA pursuant to Section
4595 387j of Title 21 of the United States Code.

4796 B. The manufacturer shall notify the A BLE Commission within
4897 thirty (30) days of any material change to the attestation,
4998 including whether the FDA has issued or not issued a market order or
5099 other authorization or has ordered the manufacturer to remove the
51100 vapor product, either temporarily or pe rmanently, from the United
52101 States market.

54102 C. The ABLE Commission shall develop a directory listing all of
55103 the manufacturers that have provide d attestations that comply with
56104 subsection A of this section and all vapor products that are listed
57105 in such attestations. The ABLE Commission shall:

59106 1. Make the directory available for public inspection on its
60107 website on or before October 1, 2022 2023; and
61-
62108 2. Update the directory as necessary to corr ect mistakes and to
63109 add or remove manufacturers or vapor products to ma intain the
64110 directory in conformity with the requirements of this section.

66111 D. It shall be unlawful for any person, directly or indirectly ,
67112 to knowingly manufacture, distribute, sell, ba rter, or furnish in
68113 this state any vapor product that is not included i n the directory.

70141 SECTION 2. It being immediately necessary for the p reservation
71142 of the public peace, health or safety, an emergency is hereby
72143 declared to exist, by re ason whereof this act shall take effect and
