23	105		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

25	106		SECTION 1. AMENDATORY 29 O.S. 2021, Section 4-112, is
26	107		amended to read as follows:

28	108		Section 4-112. A. Except as otherwise provided for in the
29	109		Oklahoma Wildlife Conservation Code or the Oklahoma Fa rmed Cervidae
30	110		Act, no person may hunt, pursue, trap, harass, catch, kill, take or
31	111		attempt to take in any manner, use, have in possession, sell, or
32	112		transport all or any portion of any wildlife except fish, without
33	113		having first procured a license from the De partment of Wildlife
34	114		Conservation. The Wildlife Conservation Commission shall designate
35	115		a consecutive Saturday and Sunday in September of each year as free
36	116		hunting days in which residents of this state may hunt without first
37	117		procuring a hunting license pu rsuant to the provision s of this
38	118		section.

40	145		B. The following legal residents of Oklahoma s hall be exempt
41	146		from the annual hunting license requirement of paragra ph 1 of
42	147		subsection F of this section and the following nonresidents shall be
43	148		exempt from the annua l nonresident hunting l icenses required
44	149		pursuant to paragraph paragraphs 1 and 2 of subsection C of this
45	150		section:

47	151		1. Legal residents under sixteen (16) years of age;

49	152		2. Legal residents sixty-five (65) years of age or older
50	153		provided they have obtained a s enior citizen lifetime hunting or
51	154		combination hunting and fishing license pursuant to the provisions
52	155		of Section 4-114 of this title;
53		-
54	156		3. Legal residents born on or before January 1, 1923;
55		-
56	157		4. Legal resident veterans having a disability of sixty percent
57	158		(60%) or more;
58		-
59	159		5. Legal resident owners or tenants who hunt on land owned or
60	160		leased by them;
61		-
62	161		6. Any nonresident under fourteen (14) years of age;
63		-
64	162		7. Legal residents having a proven disability which renders
65	163		them nonambulatory and confines them to a wheelcha ir, as certified
66	164		by a physician licensed in this state or in any state which borders
67	165		this state;

69	166		8. Any legal resident or nonresident under eighteen (18) yea rs
70	167		of age who is in the physical custody of a child care facility as
71	168		defined by Section 402 of Tit le 10 of the Oklahoma S tatutes; and

74	196		trapping, harassing, catching, killing, taking, or attempting to
75	197		take in any manner any species of rattlesnake during an organized
76	198		rattlesnake-hunting event or fes tival and who has a rat tlesnake
77	199		permit issued pursuant to Section 4 -143 of this title.

79	200		C. Except as otherwise provided for in the Oklahoma Wildlife
80	201		Conservation Code, the nonresident hunting licenses issued pursuant
81	202		to this section and the fee for each li cense shall be:

83	203		1. Annual hunting license for nonresidents hunting game other
84	204		than deer, antelope, elk or bear which expires on December 31 of the
85	205		year purchased – One Hundred Forty-one Dollars ($141.00).
86	206		Nonresidents hunting big game, combination big ga me and upland game
87	207		or exotic wildlife in a commercial hunting area shall be required to
88	208		have this license;

90	209		2. Annual hunting license for nonresidents hunting game other

193	398		shall be required to have this license; and

195	399		9. Ten-day hunting license for nonresidents hunting small game
196	400		in a commercial hunting area – Five Dollars ($5.00).

198	401		D. The Department of Wildlife Conservation shall provide a
199	402		report to both the President Pro Temp ore of the Senate and the
200	403		Speaker of the House of Representatives by February 1 of 2019 and
201	404		2020 setting forth infor mation regarding licenses issued pursuant to
202	405		paragraphs 3, 4 and 5 of subsection C of this section, which shall
203	406		include, but not be limited to:
204		-
205	407		1. The number of licenses issued during the most recent
206	408		respective deer hunting seasons; and
207		-
208	409		2. A fiscal analysis comparing revenue generated from the fees
209	410		of the licenses issued during the most recent respective deer
210	411		hunting seasons compared to prev ious years and whether the deer
211	412		hunting license structure is beneficial to the Department.
212		-
213	413		E. Of the fees collected pursuant to the provisions of
214	414		subsection C of this section:
215		-
216	415		1. Five Dollars ($5.00) of the license fee of each license
217	416		issued pursuant to paragraphs 1 through 7 of subsection C of this
218	417		section and Two Dollars and fifty cents ($2.50) of the license fee

226	450		section shall be for the Oklahoma Wildlife Land Stamp and shall be
227	451		deposited in the Oklahoma Wildlife Land Fund created pursuant to the
228	452		provisions of Section 4 -141 of this title.

230	453		F. Except as otherwise provided, the resident hunting licens es
231	454		issued pursuant to this section and the fee for each license shall
232	455		be:

234	456		1. Annual hunting license for residents eighteen (18) years of
235	457		age and older which expires on December 31 of the year pu rchased -
236	458		Twenty-four Dollars ($24.00);

238	459		2. Annual hunting li cense for residents eighteen (18) years of
239	460		age and older which expires on June 30 of the fiscal year purchased
240	461		– Thirty-one Dollars ($31.00);

242	462		3. Annual hunting license for residents sixteen (16) or
243	463		seventeen (17) years of age which expires on December 31 of the year
244	464		purchased - Four Dollars ($4.00);

370	692		arresting game warden in lieu of posting bond. Proof of hunter
371	693		safety certification will not be required for the temporary
372	694		substitute license. The fee for a substitute license purchased
373	695		pursuant to the provisions of th is subsection shall be:

375	696		a. for legal residents, Fifty Dollars ($50.00), and

377	697		b. for nonresidents, One Hundred Forty -five Dollars
378	698		($145.00).

380	699		2. Except as otherwise provided for b y this subsection, the
381	700		fees from licenses purchased pursuant to the provisions of this
382	701		subsection shall be deposited in the Wildlife Conservation Fund to
383	702		be used exclusively for developing, manag ing, preserving, and
384	703		protecting wildlife and wildlife habitat .

386	704		K. Any person producing proof in court that a current hunting
387	705		license issued by the Department of Wildlife Conservation to that
388	706		person was in force at the time of the alleged offense shall be
389	707		entitled to dismissal of a charge of violating this section u pon
390	708		payment of court costs. If proof of a current hunting license
391	709		issued by the Department to the person that was in force at the time
392	710		of the alleged offense is presented to the court or distric t
393	711		attorney within seventy-two (72) hours after the violation, the
394	712		charge shall be dismissed without payment of court costs.

396	713		L. Unless a substitute license is purchased as provided for by
397	714		subsection J of this section, any resident convicted of violating

408	750		county jail for a period not to exceed six (6) months, or by b oth.

410	751		SECTION 2. It being immediately necessary for the preservation
411	752		of the public peace, health or safety, an emergency is hereby
412	753		declared to exist, by reason w hereof this act shall take effect and
413	754		be in full force from and after its passa ge and approval.
