50 | 48 | | SECTION 1. AMENDATORY 47 O.S. 2021, Section 11 -1116, is |

52 | 50 | | Section 11-1116. A. The self-propelled or motor-driven and |

53 | 51 | | operated vehicles des cribed in this section shall be pro hibited from |

54 | 52 | | operating or shall be limited in operation on the streets a nd |
---|
55 | 53 | | highways of this sta te. |

56 | 54 | | B. Self-propelled or motor-driven cycles, known and commonly |
---|
57 | 55 | | referred to as "minibikes" and other similar trade names, sh all be |
---|
58 | 56 | | prohibited from operating on the streets and highwa ys of this state, |
---|
59 | 57 | | except: |
---|
60 | 58 | | 1. When used in a parade; or |
---|
90 | 87 | | upon streets having a speed limit of thirty (3 0) miles per hour or |
---|
91 | 88 | | less. |
---|
92 | 89 | | All minibikes offered for sale in this state shall bear the |
---|
93 | 90 | | following notice to the customer: "This machine is not manufactured |
---|
94 | 91 | | or sold for operation on the public st reets or highways. Since it |
---|
95 | 92 | | is not provided with equipment req uired by law for street or highway |
---|
96 | 93 | | use, all persons are cautioned that a ny operation of this vehicle |
---|
97 | 94 | | upon a public street or highwa y will be in violation of the motor |
---|
98 | 95 | | vehicle laws of this state and will subject the violat or to arrest." |

99 | 96 | | C. Golf carts and utility vehicles, as def ined by Section 1102 |
---|
100 | 97 | | of this title, shall not be operated on the streets and highways of |
---|
101 | 98 | | this state except: |
---|
102 | 99 | | 1. Golf carts or utility vehicles owned by the Oklahoma Touri sm |
---|
103 | 100 | | and Recreation Department , and operated by employees or agen ts of |
---|
104 | 101 | | the Department or employees of independent management companies |
---|
105 | 102 | | working on behalf of the Department, may be operated on the s treets |
---|
106 | 103 | | and highways of this state during daylight hours or und er rules |
---|
107 | 104 | | developed by the Oklahoma Tourism and Recreation Commi ssion, when |
---|
108 | 105 | | the streets and highways are located within the boundaries o f a |
---|
109 | 106 | | state park. The Department shall have warning signs pl aced at the |
---|
110 | 107 | | entrance and other locations at those state parks allowing golf |
---|
111 | 108 | | carts or utility vehicles to be operated on the s treets and highways |
---|
141 | 137 | | may be operating on streets and highway s and that motor vehicle |
---|
142 | 138 | | operators shall take special precautio ns to be alert for the |
---|
143 | 139 | | presence of golf carts or utility vehicles on the streets and |
---|
144 | 140 | | highways; |

145 | 141 | | 2. The municipal governing body has adopted an ordinance |
---|
146 | 142 | | governing the operation of golf carts an d/or utility vehicles on |
---|
147 | 143 | | city streets; provided, such ordinance s shall include necessa ry |
---|
148 | 144 | | vehicle lighting and safety requirements; |
---|
149 | 145 | | 3. Golf carts or utility vehicles may operate on state highway s |
---|
150 | 146 | | only if making a perpendicular crossing of a state highway l ocated |
---|
151 | 147 | | within the boundaries of a municipality which has adopte d an |
---|
152 | 148 | | ordinance governing the operation of golf carts and/or utility |
---|
153 | 149 | | vehicles; |
---|
154 | 150 | | 4. The board of county commi ssioners of a county has approved |
---|
155 | 151 | | the operation of golf cart and/or utility vehicle tr affic on |
---|
156 | 152 | | roadways within the county, and: |
---|
157 | 153 | | a. the roadway has a posted speed limit of t wenty-five |
---|
158 | 154 | | (25) miles per hour or less, |
---|
159 | 155 | | b. the roadway is located in an unincorporat ed area, and |
---|
160 | 156 | | c. appropriate signage, cautioning motorists of the |
---|
161 | 157 | | possibility of golf c art or utility vehicle traf fic, |
---|
162 | 158 | | is erected by the board of coun ty commissioners; or |
---|
192 | 187 | | title may be operated on the streets and highways of this state . |

193 | 188 | | Provided, however, street-legal utility vehicles shall not be |
---|
194 | 189 | | operated on the National System of Interstate an d Defense Highways |
---|
195 | 190 | | or U.S. highways. |

196 | 191 | | D. All-terrain vehicles shall not be operated on the streets |
---|
197 | 192 | | and highways of this s tate, except: |
---|
198 | 193 | | 1. On unpaved roads which are located within the boundaries of |
---|
199 | 194 | | any property of the Forest Service of the United States D epartment |
---|
200 | 195 | | of Agriculture; |
---|
201 | 196 | | 2. On highways if: |
---|
202 | 197 | | a. the vehicle needs to make a direct crossing of the |
---|
203 | 198 | | highway while the veh icle is traveling upon a |
---|
204 | 199 | | regularly traveled trail and needs to continue travel |
---|
205 | 200 | | from one area of the trail to another and, if the |
---|
206 | 201 | | vehicle comes to a complete stop, yields the right-of- |
---|
207 | 202 | | way to all oncoming traffic that constitutes an |
---|
208 | 203 | | immediate hazard, and cro sses the highway at an angle |
---|
209 | 204 | | of approximately ninety (90) degre es to the direction |
---|
210 | 205 | | of the street or highway . This exception shall not |
---|
211 | 206 | | apply to divided highways or highways with a posted |
---|
212 | 207 | | speed limit of more than thirty -five (35) miles per |
---|
213 | 208 | | hour in the area of the crossing, |
---|
243 | 237 | | terrain vehicle may travel for not more than three |
---|
244 | 238 | | hundred (300) feet on a highway to cross a railroad |
---|
245 | 239 | | track, |
---|
246 | 240 | | c. the operator of the al l-terrain vehicle making the |
---|
247 | 241 | | crossing at a highway has a valid driver license, and |
---|
248 | 242 | | d. the operator of the vehicle makes a crossing on a |
---|
249 | 243 | | highway during daylight hours only; |
---|
250 | 244 | | 3. On streets and highways within a municipality if the |
---|
251 | 245 | | municipal governing body ha s adopted an ordinance governing the |
---|
252 | 246 | | operation of golf carts, u tility vehicles or all -terrain vehicles on |
---|
253 | 247 | | streets and highways within t he municipality; or |
---|
254 | 248 | | 4. On roadways within unincorporated a reas of a county if those |
---|
255 | 249 | | roadways are not part of the state h ighway system or the National |
---|
256 | 250 | | System of Interstate and Defense Highways; provided, how ever, that |
---|
257 | 251 | | the driver is a licensed driver. |
---|
258 | 252 | | E. Mopeds, as defined by Section 1-133.2 of this title, may be |
---|
259 | 253 | | operated on the streets and highways of this state if: |
---|
260 | 254 | | 1. The municipal governing body has adopted an ordinance |
---|
261 | 255 | | governing the operation of mopeds o n city streets; provided, such |
---|
262 | 256 | | ordinances shall include necessary vehicle lighting a nd safety |
---|
263 | 257 | | requirements; or |
