54 | 48 | | SECTION 1. NEW LAW A n ew section of law not to be |

55 | 49 | | codified in the Oklahoma Statutes reads as follows: |

56 | 50 | | A. Effective July 1, 20 22, all full-time officers and employees |
---|
57 | 51 | | of the state who were employed by the state on the last working day |
---|
58 | 52 | | of June 2022 shall be awarded an annualized salary increase equal to |
---|
59 | 53 | | three percent (3%) for persons whose gross annual salary as of June |
---|
60 | 54 | | 30, 2022, was Eighty Thousand Dollars ( $80,000.00) or less. |
---|
61 | 55 | | B. Except for those pers onnel specifically excluded from |
---|
62 | 56 | | eligibility for any increase or advancement in salary pursuant to |
---|
63 | 57 | | this section, the salary increase provided by this section shall be |
---|
64 | 58 | | applicable to: |
---|
93 | 86 | | 2. Employees of a conservatio n district; and |
---|
94 | 87 | | 3. Employees of the George Nigh Rehabilitation Institute. |
---|
95 | 88 | | C. Employees eligible for the increase provided for in |
---|
96 | 89 | | subsection A of this section who are on leave without p ay on July 1, |
---|
97 | 90 | | 2022, shall receive an annualized increase, effective up on their |
---|
98 | 91 | | return to work, but shall not receive any increase for a period of |
---|
99 | 92 | | time prior to their return to work. |
---|
100 | 93 | | D. Employees who leave the state service before July 1, 20 22, |
---|
101 | 94 | | and who are reinstated or reemployed in the state service during |
---|
102 | 95 | | July 2022 without a break in service, who are otherwise eligible for |
---|
103 | 96 | | the pay increase provide d for in this section, shall be granted such |
---|
104 | 97 | | raise effective immediately upon such reinstatement or reemploym ent. |
---|
105 | 98 | | As used in this subsection, "break in service" is defined as a |
---|
106 | 99 | | period of time in excess o f thirty (30) calendar days between two |
---|
107 | 100 | | periods of state employment. |
---|
108 | 101 | | E. The following officers and employees shall be ineligible for |
---|
109 | 102 | | a pay increase pursuant to this section and nothing, except as |
---|
110 | 103 | | otherwise provided by Section 840 -2.17 of Title 74 of the O klahoma |
---|
111 | 104 | | Statutes, shall be construed to authorize an y increase or |
---|
112 | 105 | | advancement of the salaries of: |
---|
113 | 106 | | 1. Any elected official; |
---|
114 | 107 | | 2. Any cabinet secretary whose salar y is governed by Section |
---|
115 | 108 | | 10.5 of Title 74 of the Oklahoma Statutes; |
---|
144 | 136 | | 4. Any Justice or judge whose salary is governed by t he |
---|
145 | 137 | | provisions of Title 85A of the Oklahoma Statutes or whose |
---|
146 | 138 | | compensation is set by the Board on Judicial Com pensation pursuant |
---|
147 | 139 | | to Section 3.4 of Title 20 of the Oklahoma Stat utes; |
---|
148 | 140 | | 5. Any district attorney whose salary is governed by Section |
---|
149 | 141 | | 215.30 of Title 19 of the Oklahoma Statutes; |
---|
150 | 142 | | 6. Officers and employees of institutions under the |
---|
151 | 143 | | administrative authority of the Oklahoma State Regents for Higher |
---|
152 | 144 | | Education, except for officers and employees of the G eorge Nigh |
---|
153 | 145 | | Rehabilitation Institute; |
---|
154 | 146 | | 7. Persons employed pursuant to Section 2241 of Title 74 of the |
---|
155 | 147 | | Oklahoma Statutes; |
---|
156 | 148 | | 8. Persons employed pursuant to Section 1.6a of Title 53 of the |
---|
157 | 149 | | Oklahoma Statutes; |
---|
158 | 150 | | 9. Persons employed or under contract pursuant to subsection B |

159 | 151 | | of Section 1419 of Title 10 of the Okla homa Statutes; and |
---|
160 | 152 | | 10. The Adjutant General and Assistant Adjutants General |

161 | 153 | | pursuant to Section 27 of Tit le 44 of the Oklahoma Statutes. |

162 | 154 | | F. No salary increase pursuant to this s ection shall be made |

163 | 155 | | that exceeds a salary limitation provided in an agency 's annual |
---|
164 | 156 | | appropriation bill or salary limits set by statute. |

165 | 157 | | SECTION 2. This act shall become effective July 1, 2022. |
