3397 SECTION 1. NEW LAW A new section of law to be codified
3498 in the Oklahoma Statu tes as Section 11-201 of Title 70, unless there
3599 is created a duplication in numbering, reads as follows:
100+A. A school district, charter school, virtual charter school,
101+state agency, public library, or university may offer digital or
102+online library database resources to students i n kindergarten
103+through twelfth grade only if the vendor, person, or entity
104+providing the resources verifies that all the resources comply with
105+the provisions of subsection B of this section.
106+B. Digital or online library database re sources offered by
107+school districts, charter schools, virtual charter schools, state
108+agencies, public libraries, or universities to students in
109+kindergarten through twelfth grade shall have safety policies and
110+technology protection measures that:
111+1. Prohibit and prevent a user o f the resource from sending,
112+receiving, viewing, or downloading materials that are child
113+pornography or obscene materials, as defined in Section 1024.1 of
114+Title 21 of the Oklahoma Statutes, or materials that depict child
115+sexual exploitation, as defined in Section 843.5 of Title 21 of the
116+Oklahoma Statutes; and
117+2. Filter or block access to child pornography or obscene
118+materials, as defined in Section 1024.1 of T itle 21 of the Oklahoma
119+Statutes, or materials that depict child sexual exploitation, as
120+defined in Section 843.5 of Title 21 of the Oklahoma Statutes.

147+C. Notwithstanding any contract provision to the contrary, if a
148+provider of digital or online library resources fails to comply with
149+the requirements of subsection B of this section, the school
150+district, public charter school, state agency, public library, or
151+university shall withhold further payments, if any, to the provider
152+pending verification of compliance.
153+D. If a provider of digital or online library database
154+resources fails to timely verify tha t the provider is in compliance
155+with the safety policies and requirements of subsection B of this
156+section, the school district, public charter school, state agency,
157+public library, or university shall consider the provider ’s act of
158+noncompliance a breach o f contract.
159+E. No later than December 1 of each year, libraries shall
160+submit to the Speaker of the House of Representative s and President
161+Pro Tempore of the Senate, an aggregate written repor t on any issues
162+related to provider comp liance with technology protection measures
163+required by subsection B of this section.
164+F. Employees of school districts, charter schools, virtual
165+charter schools, state agencies, public libraries, and universities
166+shall not be exempt from prosecution for willful violations of state
167+law prohibiting indecent exposure to obscene material or child
168+pornography as provided in Section 1021 of Title 21 of the Oklahoma
169+Statutes.
170+SECTION 2. This act shall become effective November 1, 2022.”
