12153 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
12254 SECTION 1. NEW LAW A new section of law to be codified
12355 in the Oklahoma Statutes as Section 1793 of Title 21, unless there
12456 is created a duplication in numbe ring, reads as follows:
12557 A. It shall be unlawful for the owner of real property which
12658 has been used for the purpose of growing and harvesting marijuana
12759 crops to willfully desert or abandon the real property without first
12860 restoring the land to its previous condition.
12961 B. Any person who violates the provisions of this secti on
13062 shall, upon conviction, be guilty of a misdemeanor punishable by
13163 imprisonment in the c ounty jail for a term of one (1) year, by a
13264 fine of One Hundred Thousand Dollars ($100,000.00), or by both such

16093 court may order the person to reimburse the count y for the cost to
16194 remediate any damage to the land caused by the property owner .
16295 SECTION 2. AMENDATORY 21 O.S. 2021, Section 1738, is
16396 amended to read as follows:
16497 Section 1738. A. 1. Any commissioned peace office r of this
16598 state is authorized to seize any equipmen t, vehicle, airplane,
16699 vessel or any other conveyance that is used in the commission of any
167100 armed robbery offense defined in Section 801 of this title, used to
168101 facilitate the intentional discharge of any ki nd of firearm in
169102 violation of Section 652 of this t itle, used in violation of the
170103 Trademark Anti-Counterfeiting Act, used in the attempt or commiss ion
171104 of any act of burglary in the first or second degree, motor vehicle
172105 theft, unauthorized use of a vehicle, obliteration of distinguishing
173106 numbers on vehicles or criminal possession of vehicles with altered,
174107 removed or obliterated numbers as defined by S ections 1431, 1435,
175108 1716, 1719 and 1720 of this title or Sections 4 -104 and 4-107 of
176109 Title 47 of the Oklahoma Statutes, used in the commission of any
177110 arson offense defined in Section 1401, 1402, 1403, 1404 or 1405 of
178111 this title, used in any manner to facil itate or participate in the
179112 commission of any human trafficking offense i n violation of Section
180113 748 of this title, or used by any defendant when such vehicle or
181114 other conveyance is used in any ma nner by a prostitute, pimp or
182115 panderer to facilitate or parti cipate in the commission of any

209143 prostitution offense in violation of Sections Section 1028, 1029 or
210144 1030 of this title; provided, however, that the vehicle or
211145 conveyance of a customer or anyone merely pr ocuring the services of
212146 a prostitute shall not be include d.
213147 2. No conveyance used by a person as a common carrier in the
214148 transaction of business as a common carr ier shall be forfeited under
215149 the provisions of this section unless it shall appear that the owner
216150 or other person in charge of such conveyance was a co nsenting party
217151 or privy to the unlawful use of the conveyance in viol ation of this
218152 section.
219153 3. No conveyance shall be forfeited under the provisions of
220154 this section by reason of any act or omissio n established by the
221155 owner thereof to have been committed o r omitted without the
222156 knowledge or consent of such owner, and if the act is committed by
223157 any person other than such owner, the owner shall establish further
224158 that the conveyance was unlawfully in th e possession of a person
225159 other than the owner in violation of the criminal laws of the United
226160 States or of any state.
227161 B. In addition to the property described in s ubsection A of
228162 this section, the following property is also subject to forfeiture
229163 pursuant to this section:
230164 1. Property used in the commission of thef t of livestock or in
231165 any manner to facilitate the theft of livestock;

258193 2. The proceeds gained from the co mmission of theft of
259194 livestock;
260195 3. Personal property acquired with proceeds gained from the
261196 commission of theft of livestock;
262197 4. All conveyances, inc luding aircraft, vehicles or vessels,
263198 and horses or dogs which are us ed to transport or in any manner to
264199 facilitate the transportation for the purpose of th e commission of
265200 theft of livestock;
266201 5. Any items having a counterfeit mark and all property that is
267202 owned by or registered to the defendant that is employed or used in
268203 connection with any violation of the Trademark Anti-Counterfeiting
269204 Act;
270205 6. Any weapon possessed, used or available for use in a ny
271206 manner during the commission of a felony within the Stat e of
272207 Oklahoma, or any firearm that is possessed by a convicted felon;
273208 7. Any police scanner used in viol ation of Section 1214 of this
274209 title;
275210 8. Any computer and its components and peripherals, in cluding
276211 but not limited to the central processing unit, mon itor, keyboard,
277212 printers, scanners, software, and hardware, when it i s used in the
278213 commission of any crim e in this state;
279214 9. All property used in the commi ssion of, or in any manner to
280215 facilitate, a violation of Section 1040.12a of this title;

307243 10. All conveyances, including aircraft, vehicles or vessels,
308244 monies, coins and currency, or other instrumentality used or
309245 intended to be used, in any manner or part, to commit a violation of
310246 paragraph 1 of subsection A of Section 1021 of this title, where the
311247 victim of the crime is a minor child, subsection B of Section 1021
312248 of this title, Section 1021.2 of this title , paragraph 1 of
313249 subsection A of Section 1111 of th is title, or paragraphs 2 and 3 of
314250 subsection A of Section 1123 of this title;
315251 11. All conveyances, including aircraft, vehicles or vessels,
316252 monies, coins and currency, or other instrumentality used in an y
317253 manner or part, to commit any violation of the pr ovisions set forth
318254 in Section 748 of this title;
319255 12. Any and all property used in any manner or par t to
320256 facilitate, participate or further the commission of a human
321257 trafficking offense in violation of Sec tion 748 of this title, and
322258 all property, including monies, real estate, or any other tangi ble
323259 assets or property of or derived from or used by a prost itute, pimp
324260 or panderer in any manner or part to facilitate, particip ate or
325261 further the commission of any prostitution offense in violation of
326262 Sections Section 1028, 1029 or 1030 of this title; provid ed,
327263 however, any monies, real estate or any other tangib le asset or
328264 property of a customer or anyone merely procuring the ser vices of a
329265 prostitute shall not be i ncluded; and

356293 13. Any vehicle, airplane, vessel, or parts of a vehicle whose
357294 numbers have been removed, altered or obliterated so as to prevent
358295 determination of the true identity or ownership of said property and
359296 parts of vehicles which probable cause indi cates are stolen but
360297 whose true ownership cannot be determined; and
361298 14. Any real property used in any manner or part to commit any
362299 violation of the provisions set forth in Section 1 of this act.
363300 C. Property described i n subsection A or B of this section may
364301 be held as evidence until a forfeiture has been declared or a
365302 release ordered. Forfeiture actions under this section may be
366303 brought by the distric t attorney in the proper county of venue as
367304 petitioner; provided, in the event the district attorney elec ts not
368305 to file such action, or fails to file such a ction within ninety (90)
369306 days of the date of the seizure of such equipment, the property
370307 shall be returned to the owner.
371308 D. Notice of seizure and intended forfeiture pr oceeding shall
372309 be filed in the offic e of the clerk of the district court for the
373310 county wherein such property is seized and shall b e given all owners
374311 and parties in interest.
375312 E. Notice shall be given according to one of the following
376313 methods:
377314 1. Upon each owner or party in interest whose right, title, or
378315 interest is of record in the Oklah oma Tax Commission or with the
379316 county clerk for filings under the Uniform Commercial Code, served

406344 in the manner of service of process in civil cases prescribed by
407345 Section 2004 of Title 12 of the Oklahoma S tatutes;
408346 2. Upon each owner or party in interest w hose name and address
409347 is known, served in th e manner of service of process in civil cases
410348 prescribed by Section 2004 of Title 12 of the Oklahoma Statutes; or
411349 3. Upon all other owners, whose addresses are unknown, but who
412350 are believed to have an interest i n the property by one publication
413351 in a newspaper of general circulation in the county where the
414352 seizure was made.
415353 F. Within sixty (60) days after the mailing or publica tion of
416354 the notice, the owner of the property and any other party in
417355 interest or claimant may file a verified answer and claim to t he
418356 property described in the notice of seizure and of th e intended
419357 forfeiture proceeding.
420358 G. If at the end of sixty (60) day s after the notice has been
421359 mailed or published there is no verified answer on file, th e court
422360 shall hear evidence upon the fact of the unlawful use and may order
423361 the property forfeited t o the state, if such fact is proven.
424362 H. If a verified answer is file d, the forfeiture proceeding
425363 shall be set for hearing.
426364 I. At the hearing the petitione r shall prove by clear and
427365 convincing evidence that property was used in the attempt or
428366 commission of an act specified in subsection A of this section or is

456395 the owner of the property.
457396 J. The claimant of any right, title, or intere st in the
458397 property may prove the lien, mortgage, or cond itional sales contract
459398 to be bona fide and that the right, title, or interest created by
460399 the document was created without any knowledge or reason to believe
461400 that the property was being, or was to be, used for the purpose
462401 charged.
463402 K. In the event of such p roof, the court may order the property
464403 released to the bona fide or i nnocent owner, lien holder, mortgage e,
465404 or vendor if the amount due such person is equal to, or in excess
466405 of, the value of the prope rty as of the date of the seizure, it
467406 being the intention of this section to forfeit only the right,
468407 title, or interest of th e purchaser, except for items bearin g a
469408 counterfeit mark or used exclusively to manufac ture a counterfeit
470409 mark.
471410 L. If the amount due to such person is less than the value of
472411 the property, or if no bona fide claim is established, the property
473412 may be forfeited to the state and may be sold pur suant to judgment
474413 of the court, as on sale upon exe cution, and as provided in Section
475414 2-508 of Title 63 of the Oklahoma Statutes, except as otherwise
476415 provided for by law and for property bearing a counterfeit mark
477416 which shall be destroyed.

504444 M. Property taken or detained pursuant to this section shall
505445 not be repleviable, but shall be deemed to be in the custody of the
506446 petitioner or in the custody of the l aw enforcement agency as
507447 provided in the Trademark Anti-Counterfeiting Act. Except for
508448 property required to be destroyed pursuant to the Trademark Anti -
509449 Counterfeiting Act, the petitioner shall releas e said property to
510450 the owner of the property if it is de termined that the owner had no
511451 knowledge of the illegal use of the pr operty or if there is
512452 insufficient evidence to sustain the burden of showing illegal us e
513453 of such property. If the owner of the pro perty stipulates to the
514454 forfeiture and waives the hearin g, the petitioner may determine if
515455 the value of the property is equal to or less than the outstanding
516456 lien. If such lien exceeds the value of the property, the property
517457 may be released to the lien ho lder. Property which has not been
518458 released by the petit ioner shall be subject to the orders and
519459 decrees of the court or the official having jurisdiction thereof .
520460 N. The petitioner, or the law enforcement agency holding
521461 property pursuant to the Trademark Anti-Counterfeiting Act, shall
522462 not be held civilly liabl e for having custody of the seized property
523463 or proceeding with a forf eiture action as provided for in thi s
524464 section.
525465 O. Attorney fees shall not be assessed against the state or the
526466 petitioner for any actions or proceeding pursuant to Section 1701 et
527467 seq. of this title.

554495 P. The proceeds of the sale of any property shall be
555496 distributed as follows, in the order indicated:
556497 1. To the bona fide or innocent purchas er, conditional sales
557498 vendor, or mortgagee o f the property, if any, up to the amount of
558499 such person's interest in the property, when the court declaring the
559500 forfeiture orders a distribution to such person;
560501 2. To the payment of the actual reasonable expens es of
561502 preserving the property;
562503 3. To the victim of the crime to compensate said victim for any
563504 loss incurred as a result of the act for which such property was
564505 forfeited; and
565506 4. The balance to a revolvin g fund in the office of the county
566507 treasurer of the county wherein the property was seized, to be
567508 distributed as follows: one -third (1/3) to the invest igating law
568509 enforcement agency; one-third (1/3) of said fund to be us ed and
569510 maintained as a revolving fun d by the district attorney to be used
570511 to defray any lawful expenses of the office of the distri ct
571512 attorney; and one-third (1/3) to go to the jail maint enance fund,
572513 with a yearly accounting to the board of county commissi oners in
573514 whose county the fund is es tablished. If the petitioner is not the
574515 district attorney, then the one -third (1/3) which woul d have been
575516 designated to that office shall be distribut ed to the petitioner.
576517 Monies distributed to the jail maintenance fun d shall be used to pay
577518 costs for the storage of such property if such property is order ed

605547 or vendor and if such funds ar e available in said fund.
606548 Q. If the court finds that the property wa s not used in the
607549 attempt or commission of an act specified in subsection A of this
608550 section and was not property subject to forfeit ure pursuant to
609551 subsection B of this section and is not property bearing a
610552 counterfeit mark, the court shall order the proper ty released to the
611553 owner as the right, title, or interest appears on record in the Tax
612554 Commission as of the seizure.
613555 R. No vehicle, airplane, or vessel used by a person as a common
614556 carrier in the transaction of business as a common carrier shall be
615557 forfeited pursuant to the provisions of th is section unless it shall
616558 be proven that the owner or other person in charge of such
617559 conveyance was a consenting party or privy to the attempt or
618560 commission of an act specified in subsection A or B of this section.
619561 No property shall be forfeited pursuant to the provisions of this
620562 section by reason of any act or omission established by the owner
621563 thereof to have been committed or omitted without the know ledge or
622564 consent of such owner, and by any person other than such own er while
623565 such property was unlawfull y in the possession of a person other
624566 than the owner in violation of the criminal laws of the U nited
625567 States or of any state.
626568 S. Whenever any property is forfeited pursuant to this section,
627569 the district court having juri sdiction of the proceeding may order

655598 the state, county, or muni cipal law enforcement agency which seized
656599 the property.
657600 SECTION 3. It being immediately necessary for the pr eservation
658601 of the public peace, heal th or safety, an emergency is hereby
659602 declared to exist, by reason whereof this act shall take e ffect and
660603 be in full force from and after its passage an d approval.
