122 | 54 | | SECTION 1. NEW LAW A new section of law to be codified |
---|
123 | 55 | | in the Oklahoma Statutes as Section 1793 of Title 21, unless there |
---|
124 | 56 | | is created a duplication in numbe ring, reads as follows: |

125 | 57 | | A. It shall be unlawful for the owner of real property which |
---|
126 | 58 | | has been used for the purpose of growing and harvesting marijuana |
---|
127 | 59 | | crops to willfully desert or abandon the real property without first |
---|
128 | 60 | | restoring the land to its previous condition. |
---|
129 | 61 | | B. Any person who violates the provisions of this secti on |

130 | 62 | | shall, upon conviction, be guilty of a misdemeanor punishable by |
---|
131 | 63 | | imprisonment in the c ounty jail for a term of one (1) year, by a |
---|
132 | 64 | | fine of One Hundred Thousand Dollars ($100,000.00), or by both such |

165 | 98 | | state is authorized to seize any equipmen t, vehicle, airplane, |
---|
166 | 99 | | vessel or any other conveyance that is used in the commission of any |
---|
167 | 100 | | armed robbery offense defined in Section 801 of this title, used to |
---|
168 | 101 | | facilitate the intentional discharge of any ki nd of firearm in |
---|
169 | 102 | | violation of Section 652 of this t itle, used in violation of the |
---|
170 | 103 | | Trademark Anti-Counterfeiting Act, used in the attempt or commiss ion |
---|
171 | 104 | | of any act of burglary in the first or second degree, motor vehicle |
---|
172 | 105 | | theft, unauthorized use of a vehicle, obliteration of distinguishing |
---|
173 | 106 | | numbers on vehicles or criminal possession of vehicles with altered, |
---|
174 | 107 | | removed or obliterated numbers as defined by S ections 1431, 1435, |
---|
175 | 108 | | 1716, 1719 and 1720 of this title or Sections 4 -104 and 4-107 of |
---|
176 | 109 | | Title 47 of the Oklahoma Statutes, used in the commission of any |
---|
177 | 110 | | arson offense defined in Section 1401, 1402, 1403, 1404 or 1405 of |
---|
178 | 111 | | this title, used in any manner to facil itate or participate in the |
---|
179 | 112 | | commission of any human trafficking offense i n violation of Section |
---|
180 | 113 | | 748 of this title, or used by any defendant when such vehicle or |
---|
181 | 114 | | other conveyance is used in any ma nner by a prostitute, pimp or |
---|
182 | 115 | | panderer to facilitate or parti cipate in the commission of any |
---|

213 | 147 | | 2. No conveyance used by a person as a common carrier in the |
---|
214 | 148 | | transaction of business as a common carr ier shall be forfeited under |
---|
215 | 149 | | the provisions of this section unless it shall appear that the owner |
---|
216 | 150 | | or other person in charge of such conveyance was a co nsenting party |
---|
217 | 151 | | or privy to the unlawful use of the conveyance in viol ation of this |
---|
218 | 152 | | section. |
---|
219 | 153 | | 3. No conveyance shall be forfeited under the provisions of |
---|
220 | 154 | | this section by reason of any act or omissio n established by the |
---|
221 | 155 | | owner thereof to have been committed o r omitted without the |
---|
222 | 156 | | knowledge or consent of such owner, and if the act is committed by |
---|
223 | 157 | | any person other than such owner, the owner shall establish further |
---|
224 | 158 | | that the conveyance was unlawfully in th e possession of a person |
---|
225 | 159 | | other than the owner in violation of the criminal laws of the United |
---|
226 | 160 | | States or of any state. |
---|
227 | 161 | | B. In addition to the property described in s ubsection A of |
---|
228 | 162 | | this section, the following property is also subject to forfeiture |
---|

---|

270 | 205 | | 6. Any weapon possessed, used or available for use in a ny |
---|
271 | 206 | | manner during the commission of a felony within the Stat e of |
---|
272 | 207 | | Oklahoma, or any firearm that is possessed by a convicted felon; |
---|
273 | 208 | | 7. Any police scanner used in viol ation of Section 1214 of this |
---|
274 | 209 | | title; |
---|
275 | 210 | | 8. Any computer and its components and peripherals, in cluding |
---|
276 | 211 | | but not limited to the central processing unit, mon itor, keyboard, |
---|
277 | 212 | | printers, scanners, software, and hardware, when it i s used in the |
---|
278 | 213 | | commission of any crim e in this state; |
---|
279 | 214 | | 9. All property used in the commi ssion of, or in any manner to |
---|

316 | 252 | | monies, coins and currency, or other instrumentality used in an y |
---|
317 | 253 | | manner or part, to commit any violation of the pr ovisions set forth |
---|
318 | 254 | | in Section 748 of this title; |
---|
319 | 255 | | 12. Any and all property used in any manner or par t to |
---|
320 | 256 | | facilitate, participate or further the commission of a human |
---|
321 | 257 | | trafficking offense in violation of Sec tion 748 of this title, and |
---|
322 | 258 | | all property, including monies, real estate, or any other tangi ble |
---|
323 | 259 | | assets or property of or derived from or used by a prost itute, pimp |
---|
324 | 260 | | or panderer in any manner or part to facilitate, particip ate or |
---|
325 | 261 | | further the commission of any prostitution offense in violation of |
---|
326 | 262 | | Sections Section 1028, 1029 or 1030 of this title; provid ed, |
---|
327 | 263 | | however, any monies, real estate or any other tangib le asset or |
---|
328 | 264 | | property of a customer or anyone merely procuring the ser vices of a |
---|
329 | 265 | | prostitute shall not be i ncluded; and |
---|

---|
363 | 300 | | C. Property described i n subsection A or B of this section may |
---|
364 | 301 | | be held as evidence until a forfeiture has been declared or a |
---|
365 | 302 | | release ordered. Forfeiture actions under this section may be |
---|
366 | 303 | | brought by the distric t attorney in the proper county of venue as |
---|
367 | 304 | | petitioner; provided, in the event the district attorney elec ts not |
---|
368 | 305 | | to file such action, or fails to file such a ction within ninety (90) |
---|
369 | 306 | | days of the date of the seizure of such equipment, the property |
---|
370 | 307 | | shall be returned to the owner. |
---|
371 | 308 | | D. Notice of seizure and intended forfeiture pr oceeding shall |
---|
372 | 309 | | be filed in the offic e of the clerk of the district court for the |
---|
373 | 310 | | county wherein such property is seized and shall b e given all owners |
---|
374 | 311 | | and parties in interest. |
---|
375 | 312 | | E. Notice shall be given according to one of the following |
---|
376 | 313 | | methods: |
---|
377 | 314 | | 1. Upon each owner or party in interest whose right, title, or |
---|
378 | 315 | | interest is of record in the Oklah oma Tax Commission or with the |
---|
379 | 316 | | county clerk for filings under the Uniform Commercial Code, served |

416 | 354 | | the notice, the owner of the property and any other party in |
---|
417 | 355 | | interest or claimant may file a verified answer and claim to t he |
---|
418 | 356 | | property described in the notice of seizure and of th e intended |
---|
419 | 357 | | forfeiture proceeding. |
---|
420 | 358 | | G. If at the end of sixty (60) day s after the notice has been |
---|
421 | 359 | | mailed or published there is no verified answer on file, th e court |
---|
422 | 360 | | shall hear evidence upon the fact of the unlawful use and may order |
---|
423 | 361 | | the property forfeited t o the state, if such fact is proven. |
---|
424 | 362 | | H. If a verified answer is file d, the forfeiture proceeding |
---|
425 | 363 | | shall be set for hearing. |
---|
426 | 364 | | I. At the hearing the petitione r shall prove by clear and |
---|
427 | 365 | | convincing evidence that property was used in the attempt or |
---|
428 | 366 | | commission of an act specified in subsection A of this section or is |
---|

463 | 402 | | K. In the event of such p roof, the court may order the property |
---|
464 | 403 | | released to the bona fide or i nnocent owner, lien holder, mortgage e, |
---|
465 | 404 | | or vendor if the amount due such person is equal to, or in excess |
---|
466 | 405 | | of, the value of the prope rty as of the date of the seizure, it |
---|
467 | 406 | | being the intention of this section to forfeit only the right, |
---|
468 | 407 | | title, or interest of th e purchaser, except for items bearin g a |
---|
469 | 408 | | counterfeit mark or used exclusively to manufac ture a counterfeit |
---|
470 | 409 | | mark. |
---|
471 | 410 | | L. If the amount due to such person is less than the value of |
---|
472 | 411 | | the property, or if no bona fide claim is established, the property |
---|
473 | 412 | | may be forfeited to the state and may be sold pur suant to judgment |
---|
474 | 413 | | of the court, as on sale upon exe cution, and as provided in Section |
---|
475 | 414 | | 2-508 of Title 63 of the Oklahoma Statutes, except as otherwise |
---|

568 | 509 | | enforcement agency; one-third (1/3) of said fund to be us ed and |

569 | 510 | | maintained as a revolving fun d by the district attorney to be used |
---|
570 | 511 | | to defray any lawful expenses of the office of the distri ct |

571 | 512 | | attorney; and one-third (1/3) to go to the jail maint enance fund, |

613 | 555 | | R. No vehicle, airplane, or vessel used by a person as a common |

614 | 556 | | carrier in the transaction of business as a common carrier shall be |

615 | 557 | | forfeited pursuant to the provisions of th is section unless it shall |
---|
616 | 558 | | be proven that the owner or other person in charge of such |
---|
617 | 559 | | conveyance was a consenting party or privy to the attempt or |
---|
618 | 560 | | commission of an act specified in subsection A or B of this section. |

619 | 561 | | No property shall be forfeited pursuant to the provisions of this |

620 | 562 | | section by reason of any act or omission established by the owner |

621 | 563 | | thereof to have been committed or omitted without the know ledge or |
