40	40	An Act relating to private residential roads;
41	41	requiring all residential developers to construct
42	42	private roads to a certain standard or p rovide notice
43	43	and obtain surety bond insurance; providing for
44	44	codification; and providing an effective date.

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. NEW LAW A new section of law to be codified
52	52	in the Oklahoma Statutes as Section 1200 of Title 60, unless there
53	53	is created a duplication in n umbering, reads as follows:
54	54	All residential developers c onstructing private roads for
55	55	residential development s shall either:
56	56	1. Construct roads to the current applicable code or regulation
57	57	of the incorporated municipality that t he development is located o r
58	58	the county if the development is located in an unincorporated
59	59	location.
60	60	2. Construct roads to a lesser standard than the applicable
61	61	code or regulation for a pu blic road, however, residential
62	62	developers and any subsequent seller s must disclose that fact to

90	90	must obtain surety bond insurance guaranteeing future road
91	91	maintenance or payment for future road maintenance if the road
92	92	requires maintenance due the sub-standard construction .
93	93	SECTION 2. This act shall become effective November 1, 2022.
