AS INTRODUCED 
 
An Act relating to private residential roads; 
requiring all residential developers to construct 
private roads to a certain standard or p rovide notice 
and obtain surety bond insurance; providing for 
codification; and providing an effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 1200 of Title 60, unless there 
is created a duplication in n umbering, reads as follows: 
All residential developers c onstructing private roads for 
residential development s shall either: 
1.  Construct roads to the current applicable code or regulation 
of the incorporated municipality that t he development is located o r 
the county if the development is located in an unincorporated 
location. 
2.  Construct roads to a lesser standard than the applicable 
code or regulation for a pu blic road, however, residential 
developers and any subsequent seller s must disclose that fact to

prospective buyers. Furthermore, developers or subsequent sellers 
must obtain surety bond insurance guaranteeing future road 
maintenance or payment for future road maintenance if the road 
requires maintenance due the sub-standard construction . 
SECTION 2.  This act shall become effective November 1, 2022.
