47	47	certain publication date; provid ing certain action
48	48	for noncompliance; providing for codification; and

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. NEW LAW A new section of law to be codified
56	56	in the Oklahoma Statutes as Section 81.2 of Title 74, unless there
57	57	is created a duplication in numbering, reads as follows:
58	58	A. This act shall be know n and may be cited as the "Pre-trial
59	59	Data Collection Act".
60	60	B. Beginning January 1, 2023, an entity required to collect
61	61	data in accordance with this section shall collect the specified
62	62	data required of the entity on a monthly basis. Each entity shall
63	63	report the data collected in acco rdance with this subsection to the
64	64	Office of Management and Enterprise Services on a month ly basis.

91	91	C. The Office of Management and Enterprise Services shall
92	92	publish datasets in its possession in a modern, open, electronic
93	93	format that is machine -readable and readily accessible by the public
94	94	on the website of the agency. The published data shall be
95	95	searchable, at a minimum, by each data element, county, circuit, and
96	96	unique identifier. Agencies that employ five hundred (500) or more
97	97	employees shall submit data by July 1, 2023. Agencies that employ
98	98	more than one hundred (100) but less than five hundred (500)
99	99	employees shall submit data by December 31 , 2023. Agencies with
100	100	more than zero (0) and less than one hundred (100) employees shall
101	101	submit data by July 1, 2024. Beginning January 1, 2023, the Office
102	102	of Management and Enterprise Services sha ll begin publishing the
103	103	data received in the same modern, open, electronic format that is
104	104	machine-readable and readily accessible to the public on the website
105	105	of the Office of Management and Enterprise S ervices.
106	106	D. Upon a determination by the Office of Management and
107	107	Enterprise Services of noncompliance, any member of any board of
108	108	county commissioners may bring an action in a district court having
109	109	jurisdiction over the county from which the county commissioner
110	110	serves to force compliance. If any entity covered under the
111	111	provision of this act encompasses more than one county, upon a
112	112	determination by the Office of Management and Enterprise Services of
113	113	noncompliance, a county commissioner serving from any of the
