5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. NEW LAW A new section of law to be codified
5656 in the Oklahoma Statutes as Section 81.2 of Title 74, unless there
5757 is created a duplication in numbering, reads as follows:
5858 A. This act shall be know n and may be cited as the "Pre-trial
5959 Data Collection Act".
6060 B. Beginning January 1, 2023, an entity required to collect
6161 data in accordance with this section shall collect the specified
6262 data required of the entity on a monthly basis. Each entity shall
6363 report the data collected in acco rdance with this subsection to the
6464 Office of Management and Enterprise Services on a month ly basis.

9191 C. The Office of Management and Enterprise Services shall
9292 publish datasets in its possession in a modern, open, electronic
9393 format that is machine -readable and readily accessible by the public
9494 on the website of the agency. The published data shall be
9595 searchable, at a minimum, by each data element, county, circuit, and
9696 unique identifier. Agencies that employ five hundred (500) or more
9797 employees shall submit data by July 1, 2023. Agencies that employ
9898 more than one hundred (100) but less than five hundred (500)
9999 employees shall submit data by December 31 , 2023. Agencies with
100100 more than zero (0) and less than one hundred (100) employees shall
101101 submit data by July 1, 2024. Beginning January 1, 2023, the Office
102102 of Management and Enterprise Services sha ll begin publishing the
103103 data received in the same modern, open, electronic format that is
104104 machine-readable and readily accessible to the public on the website
105105 of the Office of Management and Enterprise S ervices.
106106 D. Upon a determination by the Office of Management and
107107 Enterprise Services of noncompliance, any member of any board of
108108 county commissioners may bring an action in a district court having
109109 jurisdiction over the county from which the county commissioner
110110 serves to force compliance. If any entity covered under the
111111 provision of this act encompasses more than one county, upon a
112112 determination by the Office of Management and Enterprise Services of
113113 noncompliance, a county commissioner serving from any of the
