49	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
50	51		SECTION 1. AMENDATORY 47 O.S. 2021, Section 1 -104, is
51	52		amended to read as follows:
52	53		Section 1-104. A. A bicycle is a device upon wh ich any person
53	54		or persons may ride, propelled solely by human power through a belt,
54	55		chain, or gears, and having two or more wheels, excluding mopeds.
55	56		B. An electric-assisted bicycle is any bicycle with:
56	57		1. Two or three wheels; and
57	58		2. Fully operative ped als for human propulsion and equipped
58	59		with an electric motor with a power output of not more than s even
59	60		hundred fifty (750) watts that meets the requir ements of one of the
60	61		following three classes:
61		-	a. "Class 1 electric-assisted bicycle" shall mean an
62		-	electric-assisted bicycle equipped with a motor that

	88	+	a. "Class 1 electric-assisted bicycle" shall mean an
	89	+	electric-assisted bicycle equipped with a motor that
90	90		provides assistance only when the rider is pedaling,
91	91		and that ceases to provide assistance when the bicy cle
92	92		reaches the speed of twenty ( 20) miles per hour,
93	93		b. "Class 2 electric-assisted bicycle" shall mean an
94	94		electric-assisted bicycle equipped with a motor that
95	95		may be used exclusively to propel the bicycle , and
96	96		that is not capable of providing assistance wh en the
97	97		bicycle reaches the speed of twenty (20) miles per
98	98		hour, and
99	99		c. "Class 3 electric-assisted bicycle" shall mean an
100	100		electric-assisted bicycle equipped with a motor that
101	101		provides assistance only when the rider is pedaling,
102	102		and that ceases to provide as sistance when the bicycle
103	103		reaches the speed of twenty-eight (28) miles per hour.
104	104		An electric-assisted bicycle shall meet the manufacturing and
105	105		equipment requirements adopted by the Consumer Product Safety
106	106		Commission for bicycles and shall operate in such a manner that the
107	107		electric motor disengages or ceases to function when the rider stops
108	108		pedaling or the brakes are applied.
109	109		C. A motorized bicycle is any bicycle having:
110	110		1. Fully operative pedals for prop ulsion by human power;
111		-	2. A power drive system that functions directly or
112		-	automatically without clutching or shifting by the operator after
113		-	the drive system is engaged; and

	137	+	2. A power drive system that functions directly or
	138	+	automatically without clutching or shifting by the operator after
	139	+	the drive system is engaged; and
141	140		3. A combustion engine with a piston or rotor displacement of
142	141		eighty (80 cu cm) cubic centimeters (80 cc) or less, regardless of
143	142		the number of chambers in the engine, wh ich is capable of propelling
144	143		the bicycle at a maximum design speed of not more than thirty-five
145	144		(35) miles per hour on level ground.
146	145		D. As used in this title, the term "bicycle" shall include
147	146		tricycles, quadcycles, or similar h uman-powered devices, electr ic-
148	147		assisted bicycles, and motorized bicycles unless otherwise
149	148		specifically indicated.
150	149		SECTION 2. AMENDATORY 47 O.S. 2021, Section 1 -133.3, is
151	150		amended to read as follows:
152	151		Section 1-133.3 Motorized scooter.
153	152		A. A "motorized scooter" is any vehicle having:
154	153		1. Not more than three wheels in contact wi th the ground;
155	154		2. Handlebars and a foot support or seat for the use of the
156	155		operator;
157	156		3. A power source that is capable of propelling the vehicle at
158	157		a maximum design speed of not more t han twenty-five (25) miles per
159	158		hour on level ground, and:,
160	159		a. if the power source is a combustion engine, has a
161	160		piston or rotor displacement of thirty -five cubic
162		-	centimeters (35 cu cm) (35 cc) or less regardless of
163		-	the number of chambers in the power source ,

191	189		b. if the power source is electric, has a power output of
192	190		not more than one thousand (1,000) watts.
193	191		B. For purposes of this section, an electric personal assistive
194	192		mobility device, as defined in Section 1-114A of this title,
195	193		bicycle, electric-assisted bicycle, or motorized bicycle, as defined
196	194		in Section 1-104 of this title, shall not be considered a motorized
197	195		scooter.
198	196		C. A motorized scooter shall not be required to b e registered
199	197		under the laws of this state. The operator of a motorized scooter
200	198		shall not be required to possess a driver license or to comply with
201	199		the vehicle insurance or financial responsibility laws of this
202	200		state.
203	201		SECTION 3. This act shall become effective November 1, 2022.
