5348 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5449 SECTION 1. AMENDATORY 28 O.S. 2021, Section 86, is
5550 amended to read as follows:
5651 Section 86. A. Jurors shall be paid the following fees o ut of
5752 the local court fund:
5853 1. For each day's attendance before any court of record, Twenty
5954 Dollars ($20.00) Seventy-five Dollars ($75.00); and
6055 2. For mileage going to and returning from jury service each
6156 day, pursuant to the provisions of the State Trav el Reimbursement
6257 Act.
6358 B. The Court Fund Board of the district court may contract for
6459 or provide reimbursement for parking for district c ourt jurors to be
60+paid from the Court Fund. Parking so provided to jurors sh all be in
61+lieu of any reimbursement to jur ors for parking fees.

92-paid from the Court Fund. Parking so provided to jurors sh all be in
93-lieu of any reimbursement to jurors for parking fees.
9488 C. The provisions of this section shall not apply to any person
9589 who is summoned for jury duty and who is excused f rom serving
9690 pursuant to the provisions of subsection A of Section 28 of Title 38
9791 of the Oklahoma Statutes, beginning on the day the person is excused
9892 from service.
9993 D. The Supreme Court shall promulgate rules to establish a
10094 Lengthy Trial Fund that shall be used to provide full or partial
10195 wage replacement or wage supplementation to jurors who serve as
10296 petit jurors for more than ten (10) days.
10397 1. The court rules shall provide for the selection and
10498 appointment of an Administrator for the fund; procedures for the
10599 administration of the fund, including payments of salaries of the
106100 Administrator and other necessary personnel; proc edures for the
107101 accounting, auditing and investment of money in the Lengthy Trial
108102 Fund; and a report by the Supreme Court on the administr ation of the
109103 Lengthy Trial Fund included in its annual report on the judicial
110104 branch, setting forth the money collected for and disbursed from the
111105 fund.
112106 2. The clerk of the court shall collect from each attorney who
113107 files a civil case, unless otherwise ex empted under the provisions
114108 of this section, a fee of Ten Dollars ($10.00) pe r case to be paid
115109 into the Lengthy Trial F und. A lawyer will be deemed to have filed
110+a case at the time the first pleading or other filing on which an
111+individual lawyer's name appears is submitted to the court for

143-a case at the time the first pleading or other filing on which an
144-individual lawyer's name appears is submitted to the court for
145138 filing and opens a new case. All such fe es shall be forwarded to
146139 the Administrator of the Lengthy Trial Fund for deposit.
147140 3. The Administrator shall use the fees deposited in the
148141 Lengthy Trial Fund to pay full or parti al wage replacement or
149142 supplementation to jurors whose employers pay less tha n full regular
150143 wages when the period of ju ry service lasts more than ten (10) days.
151144 4. The court may pay replacement or supplemental wages of up to
152145 Two Hundred Dollars ($200.00) per day per juror beginning on the
153146 eleventh day of jury service. In addition , for any jurors who
154147 qualify for payment b y serving on a jury for more than ten (10)
155148 days, the court may, upon finding that such service posed a
156149 significant financial hardship to a juror, even in light of payments
157150 made with respect to jury service after th e tenth day, award
158151 replacement or suppleme ntal wages of up to Fifty Dollars ($50.00)
159152 per day from the fourth to the tenth day of jury service.
160153 5. Any juror who is serving or has served on a jury that
161154 qualifies for payment from the Lengthy Trial Fund, prov ided the
162155 service commenced on or after Jan uary 1, 2005, may submit a request
163156 for payment from the Lengthy Trial Fund on a form provided by the
164157 Administrator. Payment shall be lim ited to the difference between
165158 the state-paid jury fee and the actual amount of wages a juror
166159 earns, up to the maximum level payable, minus any amount the juror
160+actually receives from the employer during the same time period.

194-actually receives from the employer during the same time period.
195-The form shall disclose the j uror's regular wages, the amount the
196188 employer will pay during the term of jur y service starting on the
197189 eleventh day and thereafter, the amount of replacement or
198190 supplemental wages requested, and any other information the
199191 Administrator deems necessary for p roper payment. The juror shall
200192 be required to submit verification from the e mployer as to the wage
201193 information provided to the Administrator, including but not limited
202194 to the employee's most recent earnings statement or similar
203195 document, prior to initiati on of payment from the fund. If an
204196 individual is self-employed or receives c ompensation other than
205197 wages, the individual may provide a sworn affidavit attesting to his
206198 or her approximate gross weekly income, together with such other
207199 information as the Adm inistrator may require, in order to verify
208200 weekly income.
209201 6. The following attorneys and causes of action are exempt f rom
210202 payment of the Lengthy Trial Fund fee:
211203 a. government attorneys entering appearances in the
212204 course of their official duties,
213205 b. pro se litigants,
214206 c. cases in small claims court or the state equivalent
215207 thereof, or
216208 d. claims seeking Social Security disabi lity
217209 determinations, individual veterans' compensation or
210+disability determinations, recoupment actions for
211+government backed educational loans or mortgages,

250241 that customarily are not afforded the opportunity for
251242 a trial by jury.
252243 7. Until June 30, 2021, the Office of Management and Enterprise
253244 Services shall, at the request of the Administrative Director of the
254245 Courts, transfer any monies from the Lengthy Trial Fund to the
255246 Supreme Court Administrative Revolving Fund or the Interagency
256247 Reimbursement Fund as necessary to perform the duties imposed upon
257248 the Supreme Court, Court of Civil Appeals and district courts by
258249 law.
259250 SECTION 2. This act shall become effective November 1, 2022.
