54 | 49 | | SECTION 1. AMENDATORY 28 O.S. 2021, Section 86, is |

56 | 51 | | Section 86. A. Jurors shall be paid the following fees o ut of |
---|
57 | 52 | | the local court fund: |
---|
58 | 53 | | 1. For each day's attendance before any court of record, Twenty |
---|
59 | 54 | | Dollars ($20.00) Seventy-five Dollars ($75.00); and |
---|
60 | 55 | | 2. For mileage going to and returning from jury service each |
---|
61 | 56 | | day, pursuant to the provisions of the State Trav el Reimbursement |
---|
62 | 57 | | Act. |
---|
63 | 58 | | B. The Court Fund Board of the district court may contract for |
---|
64 | 59 | | or provide reimbursement for parking for district c ourt jurors to be |
---|
94 | 88 | | C. The provisions of this section shall not apply to any person |
---|
95 | 89 | | who is summoned for jury duty and who is excused f rom serving |
---|
96 | 90 | | pursuant to the provisions of subsection A of Section 28 of Title 38 |

97 | 91 | | of the Oklahoma Statutes, beginning on the day the person is excused |

99 | 93 | | D. The Supreme Court shall promulgate rules to establish a |
---|
100 | 94 | | Lengthy Trial Fund that shall be used to provide full or partial |
---|
101 | 95 | | wage replacement or wage supplementation to jurors who serve as |
---|
102 | 96 | | petit jurors for more than ten (10) days. |
---|
103 | 97 | | 1. The court rules shall provide for the selection and |
---|
104 | 98 | | appointment of an Administrator for the fund; procedures for the |
---|
105 | 99 | | administration of the fund, including payments of salaries of the |
---|
106 | 100 | | Administrator and other necessary personnel; proc edures for the |
---|
107 | 101 | | accounting, auditing and investment of money in the Lengthy Trial |
---|
108 | 102 | | Fund; and a report by the Supreme Court on the administr ation of the |
---|
109 | 103 | | Lengthy Trial Fund included in its annual report on the judicial |
---|
110 | 104 | | branch, setting forth the money collected for and disbursed from the |
---|
111 | 105 | | fund. |
---|
112 | 106 | | 2. The clerk of the court shall collect from each attorney who |
---|
113 | 107 | | files a civil case, unless otherwise ex empted under the provisions |
---|
114 | 108 | | of this section, a fee of Ten Dollars ($10.00) pe r case to be paid |
---|
115 | 109 | | into the Lengthy Trial F und. A lawyer will be deemed to have filed |
---|
145 | 138 | | filing and opens a new case. All such fe es shall be forwarded to |
---|
146 | 139 | | the Administrator of the Lengthy Trial Fund for deposit. |

147 | 140 | | 3. The Administrator shall use the fees deposited in the |
---|
148 | 141 | | Lengthy Trial Fund to pay full or parti al wage replacement or |
---|
149 | 142 | | supplementation to jurors whose employers pay less tha n full regular |
---|
150 | 143 | | wages when the period of ju ry service lasts more than ten (10) days. |
---|
151 | 144 | | 4. The court may pay replacement or supplemental wages of up to |
---|
152 | 145 | | Two Hundred Dollars ($200.00) per day per juror beginning on the |
---|
153 | 146 | | eleventh day of jury service. In addition , for any jurors who |
---|
154 | 147 | | qualify for payment b y serving on a jury for more than ten (10) |
---|
155 | 148 | | days, the court may, upon finding that such service posed a |
---|
156 | 149 | | significant financial hardship to a juror, even in light of payments |
---|
157 | 150 | | made with respect to jury service after th e tenth day, award |
---|
158 | 151 | | replacement or suppleme ntal wages of up to Fifty Dollars ($50.00) |
---|
159 | 152 | | per day from the fourth to the tenth day of jury service. |
---|
160 | 153 | | 5. Any juror who is serving or has served on a jury that |
---|
161 | 154 | | qualifies for payment from the Lengthy Trial Fund, prov ided the |
---|
162 | 155 | | service commenced on or after Jan uary 1, 2005, may submit a request |
---|
163 | 156 | | for payment from the Lengthy Trial Fund on a form provided by the |
---|
164 | 157 | | Administrator. Payment shall be lim ited to the difference between |
---|
165 | 158 | | the state-paid jury fee and the actual amount of wages a juror |
---|
166 | 159 | | earns, up to the maximum level payable, minus any amount the juror |
---|
196 | 188 | | employer will pay during the term of jur y service starting on the |
---|
197 | 189 | | eleventh day and thereafter, the amount of replacement or |
---|
198 | 190 | | supplemental wages requested, and any other information the |
---|
199 | 191 | | Administrator deems necessary for p roper payment. The juror shall |
---|
200 | 192 | | be required to submit verification from the e mployer as to the wage |
---|
201 | 193 | | information provided to the Administrator, including but not limited |
---|
202 | 194 | | to the employee's most recent earnings statement or similar |
---|
203 | 195 | | document, prior to initiati on of payment from the fund. If an |
---|
204 | 196 | | individual is self-employed or receives c ompensation other than |
---|
205 | 197 | | wages, the individual may provide a sworn affidavit attesting to his |
---|
206 | 198 | | or her approximate gross weekly income, together with such other |
---|
207 | 199 | | information as the Adm inistrator may require, in order to verify |
---|
208 | 200 | | weekly income. |
---|
209 | 201 | | 6. The following attorneys and causes of action are exempt f rom |
---|
210 | 202 | | payment of the Lengthy Trial Fund fee: |
---|
211 | 203 | | a. government attorneys entering appearances in the |
---|
212 | 204 | | course of their official duties, |
---|
213 | 205 | | b. pro se litigants, |
---|
214 | 206 | | c. cases in small claims court or the state equivalent |
---|
215 | 207 | | thereof, or |
---|
216 | 208 | | d. claims seeking Social Security disabi lity |
---|
217 | 209 | | determinations, individual veterans' compensation or |
---|
247 | 238 | | child custody and support cases, actions brought in |
---|
248 | 239 | | forma pauperis, and any other filings designat ed by |
---|
249 | 240 | | rule that involve minimal use of court resources and |
---|
250 | 241 | | that customarily are not afforded the opportunity for |
---|
251 | 242 | | a trial by jury. |
---|
252 | 243 | | 7. Until June 30, 2021, the Office of Management and Enterprise |
---|
253 | 244 | | Services shall, at the request of the Administrative Director of the |
---|
254 | 245 | | Courts, transfer any monies from the Lengthy Trial Fund to the |
---|
255 | 246 | | Supreme Court Administrative Revolving Fund or the Interagency |
---|
256 | 247 | | Reimbursement Fund as necessary to perform the duties imposed upon |
---|
257 | 248 | | the Supreme Court, Court of Civil Appeals and district courts by |
---|
258 | 249 | | law. |
---|
259 | 250 | | SECTION 2. This act shall become effective November 1, 2022. |
