50120 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

52121 SECTION 1. NEW LAW A new section of law to be codified
53122 in the Oklahoma Statutes as Section 24-159 of Title 70, unless there
54123 is created a duplication in numbering, reads as follows:

56124 A. Each public school dis trict shall maintain a protocol for
57125 responding to students in mental health crisis with the goal of
58126 preventing student suicide, self-harm, and harm to others.

60127 1. The protocol shall be developed , maintained, and implemented
61128 in partnership with one or more local mental health treatment
62129 providers certified by the Department of Mental Health and Substance
63130 Abuse Services. At least one provider partner shall have:

75165 shall serve as a school partner if requested by a school district

78167 B. The protocol for responding to mental health crises shall,
79168 at a minimum:

81169 1. Provide a definition of mental health crisis involving
82170 potential for harm to self or others;

84171 2. Document how mental health cris es may be identified by
85172 school administrators, teachers, support employees, and school-based
86173 mental health professionals;

88174 3. Outline nonpunitive steps to safeguard student health and
89175 safety in response to an immediate or potential mental health

96206 5. Outline a process for ensuring parent and caregiver
97207 notification and involvement during an actual or potential mental

103211 C. If a student who is under eighteen (18) years of age is
104212 identified as being in or at risk of a mental health crisis, the
105213 school shall inform the parent or legal guardian of the student and
106214 offer the treatment referral information contained in the protocol.
107215 Parent or legal guardian consent shall be required for any
108216 subsequent action taken by the school as part of the proto col except
109217 in cases of immediate and life -threatening danger to self or oth ers.

111218 D. All protocols developed by school districts and partner
112219 organizations shall comply with the Health Insurance Portability and
113220 Accountability Act (HIPAA) of 1996 and Family E ducational Rights and
114221 Privacy Act (FERPA) privacy requirements.

116222 E. School administrators, teachers, support employees, and
117223 school-based mental health providers shall be provided ready access
118224 to and regular training on the protocol.

120225 F. A working agreement shall be signed by the school district
121226 board of education and each identified mental health provider
122227 partner outlining all obligations of the parties under the
123228 established protocol and a strategy for regularl y reviewing its
124229 effectiveness using anonymous, nonidentifiable data.

126256 G. Not less than every two (2) years, the school district and

128258 protocol and working agreements and consider any updates necessary
129259 to better meet the needs of students . School districts and mental
130260 health provider partners shall include in their review process
131261 information gathered from the Oklahoma Prevention Needs Assessment
132262 Survey or an alternative survey, as provided for in Section 24 -158
133263 of Title 70 of the Oklahoma Statutes .

135264 H. Each school district shall submit the latest protocol and

173318 SECTION 2. AMENDATORY 70 O.S. 2021, Section 24 -158, is

190358 C. The Department of Mental Health and Substance Abuse Servic es
191359 shall maintain the Oklahoma Preven tion Needs Assessment Survey and
192360 shall provide technic al assistance for schools in survey
193361 administration, reporting, planning , and development of school
194362 mental health prevention and intervention strategies informed by t he
195363 survey results.

197364 D. If a school or school district chooses to administer an
198365 alternative survey or assessment tool to fulfill the purpose
199366 described in subsection B of this section, it may apply for a waiver
200367 through the Department of Mental Health and Sub stance Abuse
201368 Services.

203369 E. The school district superintendent or his or her designee
204370 shall provide prior written notification to the parents or legal
205371 guardians of students to be administered the Oklahoma Prevention
206372 Needs Assessment Survey or an alternative survey or assessment tool
207373 adopted pursuant to subsection D of this section. The notificat ion
208374 shall include information to parents and legal guardians that they
209375 may opt their student out of the survey or assessment tool by
210376 providing written notice to the school district.

212377 F. Prior to the biennial administration of the Oklahoma
213378 Prevention Needs Assessment Survey, the Department of Mental Health
214379 and Substance Abuse Services shall submit the survey to the
215-President Pro Tempore of the Oklahoma State Senate, the Speaker of
216-the Oklahoma House of Representatives, the chairs of the committees
217-with responsibility over common ed ucation in both houses of the
218-Legislature, and the chairs of the committees with responsibility
219-over public health in both houses of the Legisla ture.

222412 availability of federal funding. If federal fu nding is insufficient
223413 to provide the Oklahoma Prevention Needs Assessment Survey to public
224414 schools on a biennial basis, administration of the survey shall not
