31114 BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:

33115 SECTION 1. AMENDATORY 74 O.S. 2021, Section 18b, is
34116 amended to read as follows:

36117 Section 18b. A. The duties of the Attorney General as the
37118 chief law officer of the state shall be:

39119 1. To appear for the state and prosecute and defend all actions
40120 and proceedings, civil or criminal, in the Supreme Court and Court
41121 of Criminal Appeals in which the state is interested as a party;

43122 2. To appear for the state and prosecute and defend all actions
44123 and proceedings in any of the federal courts in which the state is
45124 interested as a party;

49153 at the request of the Governor, the Legislature, or either bra nch
50154 thereof, and prosecute and defend in any court or before any
51155 commission, board or officers any cause o r proceeding, civil or
52156 criminal, in which the state may be a party or interested; and when
53157 so appearing in any such cause or proceeding, the Attorney General
54158 may, if the Attorney General deems it advisable and to the best
55159 interest of the state, take and as sume control of the prosecution or
56160 defense of the state's interest therein;

58161 4. To consult with and advise district attorneys, when
59162 requested by them, in all matters pertaining to the duties of their
60163 offices, when the district attorneys shall furnish the A ttorney
61164 General with a written opinion supported by citation of authorities
62165 upon the matter submitted;

64166 5. To give an opinion in writing upon all ques tions of law
65167 submitted to the Attorney General by the Legislature or either
66168 branch thereof, or by any stat e officer, board, commission or
67169 department, provided, that the Attorney General shall not furnish
68170 opinions to any but district attorneys, the Legislat ure or either
69171 branch thereof, or any other state official, board, commission or
70172 department, and to them on ly upon matters in which they are
71173 officially interested;

73174 6. At the request of the Governo r, State Auditor and Inspector,
74175 State Treasurer, or either b ranch of the Legislature, to prosecute

76203 upon a breach thereof, and to prosecute or defend for the state all
77204 actions, civil or cri minal, relating to any matter connected with
78205 either of their Departments;

80206 7. Whenever requested by any state officer, board or
81207 commission, to prepare proper drafts f or contracts, forms and other
82208 writing which may be wanted for the use of the state;

84209 8. To prepare drafts of bills and resolutions for individual
85210 members of the Legislature upon their written request stating the
86211 gist of the bill or resolution desired;

88212 9. To enforce the proper application of monies appropriated by
89213 the Legislature and to prosecu te breaches of trust in the
90214 administration of such funds;

92215 10. To institute actions to recover state monies illegally
93216 expended, to recover state property and to preve nt the illegal use
94217 of any state property, upon the request of the Governor or the
95218 Legislature;

97219 11. To pay into the State Treasury, immediately upon i ts
98220 receipt, all monies received by the Attorney General belonging to
99221 the state;

101222 12. To settle, compromise and dispose of an action in which the
102223 Attorney General represents the interests of the st ate, so long as
103224 the consideration negotiated for such settle ment, compromise or

108254 13. To keep and file copies of all opinions, contr acts, forms
109255 and letters of the office, and to keep an index of all opinions,
110256 contracts and forms according to subject and section of the law
111257 construed or applied;

113258 14. To keep a register or docket of all actions, demands and
114259 investigations prosecuted, defe nded or conducted by the Attorney
115260 General in behalf of the state . The register or docket shall give
116261 the style of the case or investigation, where pending, court number,
117262 office number, the gist of the matter, result and the names of the
118263 assistants who handled the matter;

120264 15. To keep a complete office file of all cases and
121265 investigations handled by the Attorne y General on behalf of the
122266 state;

124267 16. To report to the Legislature or either branch there of
125268 whenever requested upon any business relating to the duti es of the

128270 17. To institute civil actions against members of any state
129271 board or commission for failure of such members to perform their
130272 duties as prescribed by the statu tes and the Constitution and to
131273 prosecute members of any sta te board or commission for violation of

135302 18. To respond to any request for an opinion of the Attorney

138305 the law regarding such subject matter;

140306 19. To convene multicounty grand juries in such manner and for
141307 such purposes as provided by law; provided, such grand juries are
142308 composed of citizens from each of the counties on a pro rata basis

145310 20. To investigate any report by the State Auditor and
146311 Inspector filed with the Attorney Genera l pursuant to Section 223 of
147312 this title and prosecute all ac tions, civil or criminal, relating to
148313 such reports or any irregularities or derelictions in the management
149314 of public funds or property which are violations of the laws of this
150315 state;

152316 21. To represent and protect the collective interests of all
153317 utility consumers of this state in rate-related proceedings before
154318 the Corporation Commission or in any other state o r federal judicial
155319 or administrative proceeding;

158321 insurance consumers of this state in rate -related proceedings before
159322 the Insurance Commissioner or in any other state or federal judicial

164352 criminal prosecution is warranted, or to refer such matters to the
165353 appropriate district attorney ; and

167354 24. To monitor and evaluate any action by the federal
168355 government including, but not limited to, e xecutive orders by the
169356 President of the United States, rules or regulations promulgated by
170357 an agency of the federal government or acts of Congress to determine
171358 if such actions are in violation of the Tenth Amendment to the
172359 Constitution of the United States ; and

174360 25. To maintain data related to human traffic king and to assist
175361 law enforcement, social service agencies, and victim services
176362 programs in identifying and suppo rting victims of human trafficking.

178363 B. Nothing in this section shall be construed as requ iring the
179364 Attorney General to appear and defend or prosecute in any court any
180-cause or proceeding for or on behalf of the Oklahoma Tax Commission, ENR. H. B. NO. 4210 Page 5
365+cause or proceeding for or on behalf of the Oklahoma Tax Commission,
181366 the Board of Managers of the State Insurance Fund, or the
182367 Commissioners of the Land Office.

184368 C. In all appeals from the Corporation Commission to the
185369 Supreme Court of Oklahoma in which the state is a party, the
186370 Attorney General shall have the right to designate counsel of th e
187371 Corporation Commission as the Attorney General's legally appointed
188372 representative in suc h appeals, and it shall be the duty of the
189373 Corporation Commission counsel to act when so designated and to
190374 consult and advise wit h the Attorney General regarding such appeals
191375 prior to taking action therein.

193402 SECTION 2. NEW LAW A new section of law to be codified
194403 in the Oklahoma Statutes as Se ction 18r of Title 74, unless there is
195404 created a duplication in numbering, reads as follows:

197405 There is hereby created within the Office of the Attorney
198406 General the Human Trafficking Response Unit, which shall:

200407 1. Maintain data in a central location on human trafficking
201408 that shall be shared with law enforcement, criminal justice
202409 entities, social service agencies, and victim services programs and
203410 document information including , but not limited to, offenders,
204411 locations, victims, types of trafficking, and trafficking
205412 techniques. Provided, however, that any personal identifying
206413 information shall be de-identified using tokens or a similar method
207414 prior to the sharing of data in order to protect individual s'
208415 privacy rights;

210416 2. Develop training programs that address prevention efforts
211417 and best practices on identifying and assisting victims of human
212418 trafficking and support agencies in identifying at-risk environments
213419 for human trafficking;

215420 3. Review current state agency policies to ensure they include
216421 best practices to identify human trafficking victims and encourage
217422 reporting;

219423 4. Create an incentive program to encourage state agencies to
220424 have personnel attend training programs and review policies;

229456 SECTION 3. This act shall become e ffective July 1, 2022.

231457 SECTION 4. It being immediately nece ssary for the preservation
232458 of the public peace, health or safety, an emergency is hereby
233459 declared to exist, by reason whereof this act shall take effect and
234460 be in full force from and after its pas sage and approval.
