47 | 57 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA: |

48 | 58 | | SECTION 1. AMENDATORY 74 O.S. 2021, Section 62.3, is |
---|
49 | 59 | | amended to read as follows: |

50 | 60 | | Section 62.3 A. The Director of the Office of Management and |
---|
51 | 61 | | Enterprise Services shall promulgate rules for u se by state agencies |
---|
52 | 62 | | and the Office of Management and Enterprise Services to dispose of |
---|
53 | 63 | | surplus property. The rules shall include standards for |
---|
54 | 64 | | recordkeeping, methods for removal or disposal of surplus property , |
---|
55 | 65 | | and acquisition by state agencies and autho rized entities of surplus |
---|
56 | 66 | | property, and for Office management of surplus property programs. |
---|
86 | 97 | | C. The Office shall make surplus property avai lable to state |
---|
87 | 98 | | agencies and authorized entities, which shall include political |
---|
88 | 99 | | subdivisions, school districts, and nonprofit entities of this |
---|
89 | 100 | | state. |

90 | 101 | | D. The provisions of the O klahoma Surplus Property Act shall |

91 | 102 | | not apply to the Oklahoma Department of Trans portation, institutions |
---|
92 | 103 | | of higher education in this state, the Oklahoma Historical Society, |
---|
93 | 104 | | the University Hospitals Authority or University Hospitals Trust or |
---|
94 | 105 | | the Northeast Oklahoma P ublic Facilities Authority. The Gr and River |
---|
95 | 106 | | Dam Authority shall be exem pt from the provisions of the Oklahoma |
---|
96 | 107 | | Surplus Property Act for any surplus property disposed of prior to |
---|
97 | 108 | | November 1, 2006. CompSource Oklahoma shall be exempt from the |
---|
98 | 109 | | provisions of the Oklahoma Surplus Property Act i f CompSource |
---|
99 | 110 | | Oklahoma is operating pu rsuant to a pilot program authorized by |
---|
100 | 111 | | Sections 3316 and 3317 of this title. |
---|
101 | 112 | | E. Notwithstanding the provisions of the Oklahoma Surplus |
---|
102 | 113 | | Property Act, the Oklahoma State Bureau of Inve stigation may, |
---|
103 | 114 | | pursuant to rules pr omulgated by the Oklahoma State Burea u of |
---|
104 | 115 | | Investigation Commission for that purpose, donate any surplus |
---|
105 | 116 | | property, as defined in Section 62.2 of this title, to any law |
---|
106 | 117 | | enforcement agency of any political subdivision of the State of |
---|
136 | 148 | | SECTION 2. AMENDATORY 74 O.S. 2021, Section 62.7, is |
---|
137 | 149 | | amended to read as follows: |

138 | 150 | | Section 62.7 A. When the Department of Transportation |
---|
139 | 151 | | determines that any equipment or vehicle becomes excess, obsolete, |
---|
140 | 152 | | antiquated, unused or ot herwise surplus, the Department shall notify |
---|
141 | 153 | | the Office of Management and En terprise Services in writing that |
---|
142 | 154 | | such equipment or vehicle is surplus. T he notice shall identify may |
---|
143 | 155 | | engage a third-party vendor to auction such surplus items. The |
---|
144 | 156 | | following information shall be provided to the vendor : |
---|
145 | 157 | | 1. The type, brand or make, and c ountry of manufacture of the |
---|
146 | 158 | | equipment or vehicle; |
---|
147 | 159 | | 2. The age of the equi pment or vehicle including, but no t |
---|
148 | 160 | | limited to, mileage; |
---|
149 | 161 | | 3. Whether the equipment or vehicle is in good working |
---|
150 | 162 | | condition or not; |
---|
151 | 163 | | 4. If the equipment or vehicle is not in good work ing |
---|
152 | 164 | | condition, whether it is in repai rable condition at reasonable cost; |
---|
153 | 165 | | 5. Original cost of the equipment or vehicle; and |
---|
154 | 166 | | 6. Present value of the equipment or vehicle, if known. |
---|
155 | 167 | | B. The Office of Management and Enterprise Services, with any |
---|
156 | 168 | | other notice of surplus property, shall notify th e eligible |
---|
186 | 199 | | C. Prior to any advertised public auction or advertised se aled |
---|
187 | 200 | | bids to all individuals and enti ties eligible for participation in |
---|
188 | 201 | | the surplus program, the Office vendor, thirty (30) days prior to |
---|
189 | 202 | | the advertised auction date, shall offer, at fair market value, the |
---|
190 | 203 | | equipment or vehicles to the individuals or entiti es, in the |
---|
191 | 204 | | following order of priorit y: |
---|
192 | 205 | | 1. Other state agencies; |
---|
193 | 206 | | 2. Political subdivisions of the state; |
---|
194 | 207 | | 3. Rural fire departments located in this state; |
---|
195 | 208 | | 4. Rural water districts located in this state; and |
---|
196 | 209 | | 5. Multipurpose senior citizen centers locate d in this state. |
---|
197 | 210 | | D. C. Any equipment or vehicles purchased pursuant to this |
---|
198 | 211 | | section shall be made available to the purchaser on the date of |
---|
199 | 212 | | purchase. |
---|
200 | 213 | | SECTION 3. This act shall become effective November 1, 2022. |
