4757 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
4858 SECTION 1. AMENDATORY 74 O.S. 2021, Section 62.3, is
4959 amended to read as follows:
5060 Section 62.3 A. The Director of the Office of Management and
5161 Enterprise Services shall promulgate rules for u se by state agencies
5262 and the Office of Management and Enterprise Services to dispose of
5363 surplus property. The rules shall include standards for
5464 recordkeeping, methods for removal or disposal of surplus property ,
5565 and acquisition by state agencies and autho rized entities of surplus
5666 property, and for Office management of surplus property programs.
57-B. A state agency selling, trading, redistributing or otherwise
58-disposing of surplus property shall comply with the ru les
59-promulgated by the Director.

94+B. A state agency selling, trading, redistributing or otherwise
95+disposing of surplus property shall comply with the ru les
96+promulgated by the Director.
8697 C. The Office shall make surplus property avai lable to state
8798 agencies and authorized entities, which shall include political
8899 subdivisions, school districts, and nonprofit entities of this
89100 state.
90101 D. The provisions of the O klahoma Surplus Property Act shall
91102 not apply to the Oklahoma Department of Trans portation, institutions
92103 of higher education in this state, the Oklahoma Historical Society,
93104 the University Hospitals Authority or University Hospitals Trust or
94105 the Northeast Oklahoma P ublic Facilities Authority. The Gr and River
95106 Dam Authority shall be exem pt from the provisions of the Oklahoma
96107 Surplus Property Act for any surplus property disposed of prior to
97108 November 1, 2006. CompSource Oklahoma shall be exempt from the
98109 provisions of the Oklahoma Surplus Property Act i f CompSource
99110 Oklahoma is operating pu rsuant to a pilot program authorized by
100111 Sections 3316 and 3317 of this title.
101112 E. Notwithstanding the provisions of the Oklahoma Surplus
102113 Property Act, the Oklahoma State Bureau of Inve stigation may,
103114 pursuant to rules pr omulgated by the Oklahoma State Burea u of
104115 Investigation Commission for that purpose, donate any surplus
105116 property, as defined in Section 62.2 of this title, to any law
106117 enforcement agency of any political subdivision of the State of
107-Oklahoma. The use of suc h donated equipment shall be limited to
108-valid and authorized law enforcement efforts by the receiving
109-agency.

145+Oklahoma. The use of suc h donated equipment shall be limited to
146+valid and authorized law enforcement efforts by the receiving
147+agency.
136148 SECTION 2. AMENDATORY 74 O.S. 2021, Section 62.7, is
137149 amended to read as follows:
138150 Section 62.7 A. When the Department of Transportation
139151 determines that any equipment or vehicle becomes excess, obsolete,
140152 antiquated, unused or ot herwise surplus, the Department shall notify
141153 the Office of Management and En terprise Services in writing that
142154 such equipment or vehicle is surplus. T he notice shall identify may
143155 engage a third-party vendor to auction such surplus items. The
144156 following information shall be provided to the vendor :
145157 1. The type, brand or make, and c ountry of manufacture of the
146158 equipment or vehicle;
147159 2. The age of the equi pment or vehicle including, but no t
148160 limited to, mileage;
149161 3. Whether the equipment or vehicle is in good working
150162 condition or not;
151163 4. If the equipment or vehicle is not in good work ing
152164 condition, whether it is in repai rable condition at reasonable cost;
153165 5. Original cost of the equipment or vehicle; and
154166 6. Present value of the equipment or vehicle, if known.
155167 B. The Office of Management and Enterprise Services, with any
156168 other notice of surplus property, shall notify th e eligible
157-individuals or entities as provided in subsection C of this section
158-of the availability of the surplus property of the Department of
159-Transportation.

196+individuals or entities as provided in subsection C of this section
197+of the availability of the surplus property of the Department of
198+Transportation.
186199 C. Prior to any advertised public auction or advertised se aled
187200 bids to all individuals and enti ties eligible for participation in
188201 the surplus program, the Office vendor, thirty (30) days prior to
189202 the advertised auction date, shall offer, at fair market value, the
190203 equipment or vehicles to the individuals or entiti es, in the
191204 following order of priorit y:
192205 1. Other state agencies;
193206 2. Political subdivisions of the state;
194207 3. Rural fire departments located in this state;
195208 4. Rural water districts located in this state; and
196209 5. Multipurpose senior citizen centers locate d in this state.
197210 D. C. Any equipment or vehicles purchased pursuant to this
198211 section shall be made available to the purchaser on the date of
199212 purchase.
200213 SECTION 3. This act shall become effective November 1, 2022.
