30112 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

32113 SECTION 1. NEW LAW A new section of law to be codified
33114 in the Oklahoma Statutes as Section 3-6-101 of Title 27A, unless
34115 there is created a duplication in numbering, reads as fo llows:

36116 This act shall be known and may be cited as the "Healthy Soil
37117 Program Act".

39118 SECTION 2. NEW LAW A new section of law to be codified
40119 in the Oklahoma Statutes as Section 3-6-102 of Title 27A, unless
41120 there is created a duplication in numbering, reads as follows:
121+As used in the Healthy Soil Program Act:
122+1. "Champion" means a land manager who is declared a soil
123+health champion due to the land manager's excellence in applying and
124+promoting soil health principles, as modeled by the Soil Health

51153 2. "Commission" means the Oklahoma Conservation Commission;

53154 3. "Eligible entity" means a local governmental entity with
54155 proven land management capacity to support healthy soil and
55156 including conservation distric ts;

57157 4. "Healthy soil" means soil that enhances its continuing
58158 capacity to function as a biological system, increases its organic
59159 matter, and improves its structure and water- and nutrient-holding
60160 capacity;

62161 5. "Program" means the healthy soil program created in this
63162 act;

65163 6. "Soil health principle" means a principle that promotes soil
66164 health in a given environment and includes:

68165 a. keeping soil covered,
69-
70166 b. minimizing soil disturbance on cropland and minimizing
71167 external inputs,

73168 c. maximizing biodiversity,

75169 d. maintaining a living root, or
76-
77170 e. integrating animals into land management, including
78171 grazing animals, birds, beneficial insects, or
79172 keystone species, such as earthworms;

81199 7. "Supported method" means a method that is b ased upon soil
82200 health principles and is scientifically supported to promote healthy
83201 soil;

85202 8. "Technical assistance" means assistance provided to a farmer
86203 or rancher to achieve the purpose of the Healthy Soil Program Act
87204 and includes outreach, education, f inancial assistance or assistance
88205 with project planning, project design, grant applications, project
89206 implementation or project reporting; and

91207 9. "Technical assistance provider" means a local, state,
92208 federal, tribal, or educational entity with demonstrated technical
93209 expertise in designing and implementing agricultural management
94210 practices that contribute to healthy soils and includes a
95211 conservation district, the United States Natural Resources
96212 Conservation Service, the United States Forest Service, the United
97213 States Bureau of Land Management, or the state Forestry Division.

103217 A. There is hereby created a healthy soil program to be
104218 administered by the Oklahoma Conservation Commission .

116253 A. The healthy soil program shall be composed of:

118254 1. A healthy soil assessment and e ducation program;

120255 2. A healthy soil grant program; and

122256 3. Other programs established by the Oklahoma Conservation
123257 Commission to accomplish the purposes of the Healthy Soil Program
124258 Act.

126259 B. In administering the healthy so il assessment and education
127260 program, the Commission shall:

129261 1. Work through technical assista nce providers or eligible
130262 entities to:

132263 a. encourage farmers, ranchers, and land managers to
133264 undertake voluntary soil health measurements,

138267 c. facilitate on-site, producer-led workshops and
139268 training sessions to promote and engender soil health

142270 d. complete a baseline soil health assessment by testing

148301 2. Establish a statewide network of champions to promote soil
149302 health stewardship, offer guidance to producers and land managers ,
150303 and encourage teamwork;

152304 3. Create a program to provide ongoing training in soil health
153305 stewardship and workshop facilitation for champions and eligible
154306 entities;

156307 4. In collaboration with technical assistance providers,
157308 sponsor soil health workshops and training sessions through
158309 conservation districts on farms throughout the state; and

160310 5. Educate students and the general public about the importance
161311 of soil health stewardship.

163312 C. In administering the healthy soil grant program, the
164313 Commission shall:

166314 1. Award grants to eligible entities to provide technical
167315 assistance to producers and land managers in advancing soil health
168316 principles and implementing supported methods;

170317 2. Develop a user-friendly grant program application and
171318 application and reporting processes;

173319 3. Develop criteria for t he award of grants; provided that
174320 grants shall be awarded equitably and priority may be given to
175321 eligible entities serving young producers, veterans, small farms or

179350 4. Ensure that grant funds are only used to advance soil health
180351 and soil health stewardship.

182352 D. The Commission shall encourage producer, land manager,
183353 landowner, and interagency collabor ation in the management of
184354 healthy soils and shall:

186355 1. Work with technical assistance providers to advance soil
187356 health stewardship across private, state, federal, and tribal land
188357 jurisdictions by fostering collaboration among prod ucers, land
189358 managers, and landowners; and
190-
191359 2. Conduct outreach to producers and land managers to promote
192360 the program and other federal, state, or local grant opportunities
193361 that support and promote healthy soils.

195362 E. In administering the program, the Commission shall support
196363 local economic growth in Oklahoma and shall:

198364 1. Identify ways to increa se the generation and use of compost
199365 to build healthy soils;

201366 2. To the extent permitted by statute, prioritize in-state
202367 sourcing of the resources needed for the program, including testing
203368 resources, compost, seeds, fencing supplies, and equipment; and

205369 3. Support the emerging market for food grown in Oklahoma under
206370 management for healthy soils.

232412 the Oklahoma Statutes; and

234413 8. Other expenditures as deter mined by the Commission to be
235414 necessary to support the overall effective administration of the
236415 program.
