3458 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3659 SECTION 1. NEW LAW A new section of law to be codified
3760 in the Oklahoma Statutes as Section 233.14 of Title 44, unless there
3861 is created a duplica tion in numbering, reads as follows:

4062 There is hereby created in the State Treasury a revolving fund
4163 for the Oklahoma Military Department to be designated the "Military
4264 Justice Revolving Fund". The fund shall be a continuing fund, not
4365 subject to fiscal ye ar limitations, and shall consist of all monies
4466 directed for deposit to the fund by law. All monies accruing to the

4593 credit of said fund are hereby appropriated and may be budgeted and
46-expended by the Oklahoma Military Department for the purpose of ENR. H. B. NO. 4449 Page 2
94+expended by the Oklahoma Military Department for the purpose of
4795 prosecuting military misconduct as needed. Expenditures from said
4896 fund shall be made upon warrants issued by the State Treasure r
4997 against claims filed as prescribed by law with the Director of the
5098 Office of Management an d Enterprise Services for approval and
5199 payment.

53100 SECTION 2. AMENDATORY 74 O.S. 2021, Section 9030.5, is
54101 amended to read as follows:

56102 Section 9030.5 A. 1. Except as otherwise provided by
57103 subsection C of this section, all state age ncies, including
58104 institutions within The Oklahoma State System of Higher Education,
59105 all state departments, board s, councils, and commissions shall
60106 allocate, as a nondeductible item out of any expenditures for
61107 capital projects including, but not limited to, bond issues for
62108 state construction excluding costs for bond issuance and related
63109 reserves, an amount of one and one-half percent (1 1/2%) of the
64110 expenditure to the Oklahoma Arts Council for the purpose of funding
65111 the Oklahoma Art in Public Places Act, exc ept as otherwise prov ided
66112 by subsection B of this section.

68113 2. The maximum assessment for any project shall not exceed Five
69114 Hundred Thousand Dollars ($500,000.00) . This assessment shall not
70115 apply to any private donations for a capital project . This
71116 allocation shall be applic able to all state agency capital projects

72143 approved by the appointing authority after Septem ber 1, 2004. The
73144 works of art commissioned pursuant to the Oklahoma Art in Public
74145 Places Act may be placed on public lands, integral to or atta ched to
75146 a public building or structure, or detached within or outside a
76147 public building or structure.

78148 B. 1. Of the assessment provided for in subsection A of this
79149 section, four-fifths (4/5) shall be placed in the Commissioning of
80150 Art in Public Places Rev olving Fund, created in Section 9030.6 of
81151 this title, for the commission of any work of art for the Oklahoma
82152 Art in Public Places Act . Institutions within The Okla homa State
83153 System of Higher Education shall remain in complete administrative
84154 control of their four-fifths (4/5) assessment pursuant to this
85155 subsection for the acquisition of art. The remaining one-fifth
86156 (1/5) of the assessment shall be reserved for the A rt in Public
87157 Places Administrative and Maintenance Revolving Fund created by
88158 Section 9030.7 of this title.

90159 2. Monies deposited in the Art in Public Places Administrative
91-and Maintenance Revolving Fund fo r the purpose of this moratorium ENR. H. B. NO. 4449 Page 3
160+and Maintenance Revolving Fund fo r the purpose of this moratorium
92161 shall be used for continued administration, educational costs and
93162 maintenance.
