34	58		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

36	59		SECTION 1. NEW LAW A new section of law to be codified
37	60		in the Oklahoma Statutes as Section 233.14 of Title 44, unless there
38	61		is created a duplica tion in numbering, reads as follows:

40	62		There is hereby created in the State Treasury a revolving fund
41	63		for the Oklahoma Military Department to be designated the "Military
42	64		Justice Revolving Fund". The fund shall be a continuing fund, not
43	65		subject to fiscal ye ar limitations, and shall consist of all monies
44	66		directed for deposit to the fund by law. All monies accruing to the

45	93		credit of said fund are hereby appropriated and may be budgeted and

47	95		prosecuting military misconduct as needed. Expenditures from said
48	96		fund shall be made upon warrants issued by the State Treasure r
49	97		against claims filed as prescribed by law with the Director of the
50	98		Office of Management an d Enterprise Services for approval and
51	99		payment.

53	100		SECTION 2. AMENDATORY 74 O.S. 2021, Section 9030.5, is
54	101		amended to read as follows:

56	102		Section 9030.5 A. 1. Except as otherwise provided by
57	103		subsection C of this section, all state age ncies, including
58	104		institutions within The Oklahoma State System of Higher Education,
59	105		all state departments, board s, councils, and commissions shall
60	106		allocate, as a nondeductible item out of any expenditures for
61	107		capital projects including, but not limited to, bond issues for
62	108		state construction excluding costs for bond issuance and related
63	109		reserves, an amount of one and one-half percent (1 1/2%) of the
64	110		expenditure to the Oklahoma Arts Council for the purpose of funding
65	111		the Oklahoma Art in Public Places Act, exc ept as otherwise prov ided
66	112		by subsection B of this section.

68	113		2. The maximum assessment for any project shall not exceed Five
69	114		Hundred Thousand Dollars ($500,000.00) . This assessment shall not
70	115		apply to any private donations for a capital project . This
71	116		allocation shall be applic able to all state agency capital projects

72	143		approved by the appointing authority after Septem ber 1, 2004. The
73	144		works of art commissioned pursuant to the Oklahoma Art in Public
74	145		Places Act may be placed on public lands, integral to or atta ched to
75	146		a public building or structure, or detached within or outside a
76	147		public building or structure.

78	148		B. 1. Of the assessment provided for in subsection A of this
79	149		section, four-fifths (4/5) shall be placed in the Commissioning of
80	150		Art in Public Places Rev olving Fund, created in Section 9030.6 of
81	151		this title, for the commission of any work of art for the Oklahoma
82	152		Art in Public Places Act . Institutions within The Okla homa State
83	153		System of Higher Education shall remain in complete administrative
84	154		control of their four-fifths (4/5) assessment pursuant to this
85	155		subsection for the acquisition of art. The remaining one-fifth
86	156		(1/5) of the assessment shall be reserved for the A rt in Public
87	157		Places Administrative and Maintenance Revolving Fund created by
88	158		Section 9030.7 of this title.

90	159		2. Monies deposited in the Art in Public Places Administrative
91		-	and Maintenance Revolving Fund fo r the purpose of this moratorium ~~ENR. H. B. NO. 4449 Page 3~~

92	161		shall be used for continued administration, educational costs and
93	162		maintenance.

95	163		C. The provisions of subsection A of this section shall not be
