1745 requiring that certain funds be utilized for certain

2250 requiring certain tran sfers to certain funds;

2654 requiring the maintenance of certain records;
2755 providing budgeting and expenditure limitations and
2856 procedures; providing for lapse of fu nds under

3764 BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:

3965 SECTION 1. From the funds appropriated to the Department of
4066 Human Services in Enrolled Senate Bill No. 1040 of the 2nd Session
4167 of the 58th Oklahoma Legislature, the sum of Thirty-two Million Five
4268 Hundred Thousand Doll ars ($32,500,000.00) shall be used for
4369 providing Home and Community -Based Waiver services for persons with

4496 developmental disabilities. These funds shall be used to provide
4597 additional services and programs for pers ons with developmental
46-disabilities in order to eliminate the Developmental Disabilities ENR. H. B. NO. 4466 Page 2
98+disabilities in order to eliminate the Developmental Disabilities
4799 Services Division Waiting List fo r all people waiting as of May 1,
48100 2022, and to implement a twenty-five percent (25%) increase in rates
49101 for all services within the Home and Community-Based Services
50102 Waivers to ensure access to services for people with developmental
51103 disabilities and those ser ved through the ADvantage Waiver. Such
52104 funds shall be used to supplement rather than replace existing
53105 resources and programs.

55106 SECTION 2. From the funds appropriated to the Department of
56107 Human Services in Enrolled Senate Bill No. 1040 of the 2nd Session
57108 of the 58th Oklahoma Legis lature, the sum of Two Million Five
58109 Hundred Thousand Dollars ( $2,500,000.00) shall be used to maintain
59110 the funding levels from the fiscal year ending June 30, 2022, of
60111 Senior Nutrition programs in rural communities across Oklahoma. The
61112 Oklahoma Legislature requires joint approval from the President Pro
62113 Tempore of the Oklahoma State Senate and the Speaker of the Oklahoma
63114 House of Representatives before any Senior Nutrition sites may be
64115 closed due to declining attendance or increased operational costs
65116 during the fiscal year ending June 30, 20 23.

67117 SECTION 3. From the funds appropriated to the Department of
68118 Human Services in Enrolled Senate Bill No. 1040 of the 2nd Session

70146 Thousand Eight Hundre d Six Dollars ($1,001,806.00) shall be used to
71147 fund debt service obligations for the renovation and construction of
72148 the Robert M. Greer Center located in Enid, Oklahoma.

74149 SECTION 4. From the funds appropriated to the Department of
75150 Human Services in Enrolled Senate Bill No. 1040 of the 2nd Session
76151 of the 58th Oklahoma Legislature, the sum of One Million One Hundr ed
77152 Thousand Dollars ($1,100,000.00) shall be used for a nutrition
78153 incentive program that helps low-income families purchase fresh
79154 fruits and vegetables.

81155 SECTION 5. From the funds appropriated to the Department of
82156 Human Services in Enrolled Senate Bill No. 1040 of the 2nd Session
83157 of the 58th Oklahoma Legislature, the Department of Human Se rvices
84158 shall transfer Two Million Eight Hundred Thousand Dollars
85159 ($2,800,000.00) to the credit of the Child Abuse Multidiscipli nary
86160 Account established in Section 1-9-103 of Title 10A of the Oklahoma
87161 Statutes, which shall be distributed according to Sectio n 1-9-104 of
88162 Title 10A of the Oklahoma Statutes.

90163 SECTION 6. There is hereby appr opriated to the Department of
91-Human Services all federal monies received by the state during the ENR. H. B. NO. 4466 Page 3
164+Human Services all federal monies received by the state during the
92165 fiscal year ending June 30, 2023, from the Temporary Assistance for
93166 Needy Families Block Grant and the Child Care and Development Fund
94167 Block Grant to meet the p rovisions of federal law relating to such
95168 grants.

97195 SECTION 7. The Director of the Department of Human Services may
98196 request through the Director o f the Office of Management and
99197 Enterprise Services the early transfer by the Oklahoma Tax
100198 Commission of tax collections to the General Revenue Fund for the
101199 purpose of early allocation to the Department's disbursing funds to
102200 alleviate cash-flow problems.

104201 SECTION 8. A. The Director of the Of fice of Management and
105202 Enterprise Services s hall transfer monies appropriated f rom the
106203 General Revenue Fund to the Department of Human Services' disbursing
107204 funds in the amounts and ratios requested by the a gency except that
108205 the cumulative amount transferre d shall not exceed the cumulative
109206 amount of equal monthly allotments of the app ropriations from the
110207 General Revenue Fund.

112208 B. Monies appropriated or collected for the fiscal year ending
113209 June 30, 2023, may b e transferred to these disbursing funds for the
114210 fiscal year ending June 30, 2022, to satisfy e ncumbrances and
115211 obligations of the f iscal year; provided , that monies equal in
116212 amount are transferred from appropriations or collections for the
117213 fiscal year ending June 30, 2022, to the disbursing funds for the
118214 fiscal year ending June 30, 2023, to satisfy encumbrances and
119215 obligations of the fiscal year. All transfer requests shall be in
120216 writing to the Director of the Office of Management and Enterprise

123244 C. The Department of Human Services shall maintain re cords of
124245 such interyear transfers.

126246 SECTION 9. The Director of Human Services may request the
127247 Director of the Office of Management and Enterprise Services to
128248 transfer monies between the Dep artment of Human Services Support
129249 Service Providers Grant Program Fund and the Human Services
130250 Disbursing Fund or the Department of Human Service s Medical and
131251 Assistance Fund, as needed for the expenditure of funds.

133252 SECTION 10. Appropriations made by Enrolled Senate Bill No.
134253 1040 of the 2nd Session of the 58th Oklahoma Leg islature, not
135254 including appropriations made for capital outlay pu rposes, may be
136-budgeted for the fiscal year ending June 30, 2023 (hereafter FY-23), ENR. H. B. NO. 4466 Page 4
255+budgeted for the fiscal year ending June 30, 2023 (hereafter FY-23),
137256 or may be budgeted for th e fiscal year ending June 30, 2024
138257 (hereafter FY-24). Funds budgeted for FY -23 may be encumbered only
139258 through June 30, 2023 , and must be expended by November 15, 2023.
140259 Any funds remaining after November 15, 2023, and not budgeted for
141260 FY-24, shall lapse to the credit of the proper fund for the then
142261 current fiscal year. Funds budgeted for FY-24 may be encumbered
143262 only through June 30, 2024. Any funds remaining after November 15,
144263 2024, shall lapse to the credit of the proper fund for the then
145264 current fiscal year. These appropriations shall not be budgeted in
146265 both fiscal years simultaneously. Funds budgeted in FY-23, and not
147266 required to pay obligation s for that fiscal year, may be budgeted
148267 for FY-24, after the agency to which the funds have been
