37	64		BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:

39	65		SECTION 1. From the funds appropriated to the Department of
40	66		Human Services in Enrolled Senate Bill No. 1040 of the 2nd Session
41	67		of the 58th Oklahoma Legislature, the sum of Thirty-two Million Five
42	68		Hundred Thousand Doll ars ($32,500,000.00) shall be used for
43	69		providing Home and Community -Based Waiver services for persons with

44	96		developmental disabilities. These funds shall be used to provide
45	97		additional services and programs for pers ons with developmental
46		-	disabilities in order to eliminate the Developmental Disabilities ~~ENR. H. B. NO. 4466 Page 2~~
	98	+	disabilities in order to eliminate the Developmental Disabilities
47	99		Services Division Waiting List fo r all people waiting as of May 1,
48	100		2022, and to implement a twenty-five percent (25%) increase in rates
49	101		for all services within the Home and Community-Based Services
50	102		Waivers to ensure access to services for people with developmental
51	103		disabilities and those ser ved through the ADvantage Waiver. Such
52	104		funds shall be used to supplement rather than replace existing
53	105		resources and programs.

55	106		SECTION 2. From the funds appropriated to the Department of
56	107		Human Services in Enrolled Senate Bill No. 1040 of the 2nd Session
57	108		of the 58th Oklahoma Legis lature, the sum of Two Million Five
58	109		Hundred Thousand Dollars ( $2,500,000.00) shall be used to maintain
59	110		the funding levels from the fiscal year ending June 30, 2022, of
60	111		Senior Nutrition programs in rural communities across Oklahoma. The
61	112		Oklahoma Legislature requires joint approval from the President Pro
62	113		Tempore of the Oklahoma State Senate and the Speaker of the Oklahoma
63	114		House of Representatives before any Senior Nutrition sites may be
64	115		closed due to declining attendance or increased operational costs
65	116		during the fiscal year ending June 30, 20 23.

67	117		SECTION 3. From the funds appropriated to the Department of
68	118		Human Services in Enrolled Senate Bill No. 1040 of the 2nd Session

72	148		the Robert M. Greer Center located in Enid, Oklahoma.

74	149		SECTION 4. From the funds appropriated to the Department of
75	150		Human Services in Enrolled Senate Bill No. 1040 of the 2nd Session
76	151		of the 58th Oklahoma Legislature, the sum of One Million One Hundr ed
77	152		Thousand Dollars ($1,100,000.00) shall be used for a nutrition
78	153		incentive program that helps low-income families purchase fresh
79	154		fruits and vegetables.

81	155		SECTION 5. From the funds appropriated to the Department of
82	156		Human Services in Enrolled Senate Bill No. 1040 of the 2nd Session
83	157		of the 58th Oklahoma Legislature, the Department of Human Se rvices
84	158		shall transfer Two Million Eight Hundred Thousand Dollars
85	159		($2,800,000.00) to the credit of the Child Abuse Multidiscipli nary
86	160		Account established in Section 1-9-103 of Title 10A of the Oklahoma
87	161		Statutes, which shall be distributed according to Sectio n 1-9-104 of
88	162		Title 10A of the Oklahoma Statutes.

90	163		SECTION 6. There is hereby appr opriated to the Department of

97	195		SECTION 7. The Director of the Department of Human Services may
98	196		request through the Director o f the Office of Management and
99	197		Enterprise Services the early transfer by the Oklahoma Tax
100	198		Commission of tax collections to the General Revenue Fund for the
101	199		purpose of early allocation to the Department's disbursing funds to
102	200		alleviate cash-flow problems.

104	201		SECTION 8. A. The Director of the Of fice of Management and
105	202		Enterprise Services s hall transfer monies appropriated f rom the
106	203		General Revenue Fund to the Department of Human Services' disbursing
107	204		funds in the amounts and ratios requested by the a gency except that
108	205		the cumulative amount transferre d shall not exceed the cumulative
109	206		amount of equal monthly allotments of the app ropriations from the
110	207		General Revenue Fund.

112	208		B. Monies appropriated or collected for the fiscal year ending
113	209		June 30, 2023, may b e transferred to these disbursing funds for the
114	210		fiscal year ending June 30, 2022, to satisfy e ncumbrances and
115	211		obligations of the f iscal year; provided , that monies equal in
116	212		amount are transferred from appropriations or collections for the
117	213		fiscal year ending June 30, 2022, to the disbursing funds for the
118	214		fiscal year ending June 30, 2023, to satisfy encumbrances and
119	215		obligations of the fiscal year. All transfer requests shall be in
120	216		writing to the Director of the Office of Management and Enterprise

126	246		SECTION 9. The Director of Human Services may request the
127	247		Director of the Office of Management and Enterprise Services to
128	248		transfer monies between the Dep artment of Human Services Support
129	249		Service Providers Grant Program Fund and the Human Services
130	250		Disbursing Fund or the Department of Human Service s Medical and
131	251		Assistance Fund, as needed for the expenditure of funds.

133	252		SECTION 10. Appropriations made by Enrolled Senate Bill No.
134	253		1040 of the 2nd Session of the 58th Oklahoma Leg islature, not
135	254		including appropriations made for capital outlay pu rposes, may be
136		-	budgeted for the fiscal year ending June 30, 2023 (hereafter FY-23), ~~ENR. H. B. NO. 4466 Page 4~~
	255	+	budgeted for the fiscal year ending June 30, 2023 (hereafter FY-23),
137	256		or may be budgeted for th e fiscal year ending June 30, 2024
138	257		(hereafter FY-24). Funds budgeted for FY -23 may be encumbered only
139	258		through June 30, 2023 , and must be expended by November 15, 2023.
140	259		Any funds remaining after November 15, 2023, and not budgeted for
141	260		FY-24, shall lapse to the credit of the proper fund for the then
142	261		current fiscal year. Funds budgeted for FY-24 may be encumbered
143	262		only through June 30, 2024. Any funds remaining after November 15,
144	263		2024, shall lapse to the credit of the proper fund for the then
145	264		current fiscal year. These appropriations shall not be budgeted in
146	265		both fiscal years simultaneously. Funds budgeted in FY-23, and not
147	266		required to pay obligation s for that fiscal year, may be budgeted
148	267		for FY-24, after the agency to which the funds have been
