2755 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2956 SECTION 1. AMENDATORY 59 O.S. 2011, Section 144, as last
3057 amended by Section 6, Chapter 363, O.S.L. 2019 (59 O.S. Supp. 2020,
3158 Section 144), is amended to read as follows:

3359 Section 144. A. The fee for examination for a l icense to
3460 practice podiatric medicine in this state shall be One Hundred
3561 Dollars ($100.00). The Board of Podiatric Medical Examiners may
3662 increase this fee by not more than an additional Two Hundred Dollars
3763 ($200.00). The examination for such license shal l be given by the
3864 Board. The Board may give the examination at any special meeting,
3965 but shall not be required to do so. The Board may utilize the

4395 B. To be entitled to take the examination, a person shall:

4596 1. File a written or electronic online application on a form
4697 prescribed by the Board;

5098 2. Pay to the secretary -treasurer of the Board in advance the
5199 fee for examination;

53100 3. Satisfy the Board that the person is loyal to legally
54101 resides in the United States of America;

56102 4. Be more than twenty -one (21) years of age;

58103 5. Not have been convicted of any felony crime that
59104 substantially relates to the practice of podiatric medicine and
60105 poses a reasonable threat to public safety;
61-
62106 6. Be free from contagious or infectious disease;
63-
64107 7. Be a graduate of an accredited college of podiatric
65108 medicine; and
66-
67109 8. 7. Have complied with applicable Board rules.

69110 C. An applicant satisfying the requirem ents of subsection B of
70111 this section shall receive a license to practice podiatric medicine
71112 in this state, to be issued by the Board, if the applicant:

73113 1. Takes the examination administered or approved by the Board
74114 and receives a passing score of at least seventy-five percent (75%)
75115 on both the written and oral portions. An applicant receiving less
76116 than a score of seventy -five percent (75%) on either the written or

77144 oral portion of the examination shall be deemed to have failed the
78145 entire examination;

80146 2. Satisfactorily completes a podiatric surgical residency,
81147 approved by the Council of Podiatric Medical Education of the
82148 American Podiatric Medical Association, of not less than three (3)
83149 years; provided, the provisions of this paragraph shall only apply
84150 to applicants after March 1, 2018;
85-
86151 3. Satisfies the Board that the applicant has not violated any
87152 of the provisions of the Podiatric Medicine Practice Act or any of
88153 the rules of the Board; and

92154 4. Satisfies the Board, in the case of any criminal conviction,
93155 that the crime does not substantially relate to the practice of
94156 podiatric medicine nor pose a reasonable threat to public safety, or
95157 constitute an act of moral turpitude that would affect the practice
96158 of podiatric medicine or public safety. For purposes of this
97159 paragraph:

99160 a. "substantially relate " means the nature of criminal
100161 conduct for which the person was convicted has a
101162 direct bearing on the fitness or ability to perform
102163 one or more of the duties or responsibilities
103164 necessarily related to the occupation , and
104-
105165 b. "pose a reasonable threat " means the nature of
106166 criminal conduct for which the person was convicted
107167 involved an act or threat of harm against another and

108195 has a bearing on the fitness or ability to serve the
109196 public or work with others in the occupat ion.

111197 D. The examination administered or approved by the Board shall
112198 include both a written and an oral portion, shall be administered in
113199 the English language, and shall cover areas in anatomy, pathology,
114200 podiatric medicine and surgery, dermatology, pharma cology,
115201 biomechanics, anesthesia, radiology, Oklahoma law relating to
116202 podiatric medicine, and such other subjects as the Board from time
117203 to time determines necessary and appropriate. The Board may
118204 authorize examination papers to be graded by one or more o f its own
119205 members or by any one or more licensed podiatric physicians selected
120206 by the Board. Each license issued by the Board shall be signed by
121207 each member of the Board, bear the seal of the Board, and designate
122208 the licensee as a licensed podiatric physi cian.

124209 E. The Board may issue a temporary license if the applicant:

126210 1. Has met the requirements of subsection B of this section;

128211 2. Takes the examination administered or approved by the Board
129212 and receives a passing score of at least seventy -five percent (75%)
130213 on both the written and oral portions. An applicant receiving less
131214 than a score of seventy -five percent (75%) on either the written or
132215 oral portion of the examination shall be deemed to have failed the
