27	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29	56		SECTION 1. AMENDATORY 59 O.S. 2011, Section 144, as last
30	57		amended by Section 6, Chapter 363, O.S.L. 2019 (59 O.S. Supp. 2020,
31	58		Section 144), is amended to read as follows:
32		-
33	59		Section 144. A. The fee for examination for a l icense to
34	60		practice podiatric medicine in this state shall be One Hundred
35	61		Dollars ($100.00). The Board of Podiatric Medical Examiners may
36	62		increase this fee by not more than an additional Two Hundred Dollars
37	63		($200.00). The examination for such license shal l be given by the
38	64		Board. The Board may give the examination at any special meeting,
39	65		but shall not be required to do so. The Board may utilize the

43	95		B. To be entitled to take the examination, a person shall:
44		-
45	96		1. File a written or electronic online application on a form
46	97		prescribed by the Board;
47		-

50	98		2. Pay to the secretary -treasurer of the Board in advance the
51	99		fee for examination;
52		-
53	100		3. Satisfy the Board that the person is loyal to legally
54	101		resides in the United States of America;
55		-
56	102		4. Be more than twenty -one (21) years of age;
57		-
58	103		5. Not have been convicted of any felony crime that
59	104		substantially relates to the practice of podiatric medicine and
60	105		poses a reasonable threat to public safety;
61		-
62	106		6. Be free from contagious or infectious disease;
63		-
64	107		7. Be a graduate of an accredited college of podiatric
65	108		medicine; and
66		-
67	109		8. 7. Have complied with applicable Board rules.
68		-
69	110		C. An applicant satisfying the requirem ents of subsection B of
70	111		this section shall receive a license to practice podiatric medicine
71	112		in this state, to be issued by the Board, if the applicant:
72		-
73	113		1. Takes the examination administered or approved by the Board
74	114		and receives a passing score of at least seventy-five percent (75%)
75	115		on both the written and oral portions. An applicant receiving less
76	116		than a score of seventy -five percent (75%) on either the written or

77	144		oral portion of the examination shall be deemed to have failed the
78	145		entire examination;

80	146		2. Satisfactorily completes a podiatric surgical residency,
81	147		approved by the Council of Podiatric Medical Education of the
82	148		American Podiatric Medical Association, of not less than three (3)
83	149		years; provided, the provisions of this paragraph shall only apply
84	150		to applicants after March 1, 2018;

86	151		3. Satisfies the Board that the applicant has not violated any
87	152		of the provisions of the Podiatric Medicine Practice Act or any of
88	153		the rules of the Board; and

92	154		4. Satisfies the Board, in the case of any criminal conviction,
93	155		that the crime does not substantially relate to the practice of
94	156		podiatric medicine nor pose a reasonable threat to public safety, or
95	157		constitute an act of moral turpitude that would affect the practice
96	158		of podiatric medicine or public safety. For purposes of this
97	159		paragraph:

99	160		a. "substantially relate " means the nature of criminal
100	161		conduct for which the person was convicted has a
101	162		direct bearing on the fitness or ability to perform
102	163		one or more of the duties or responsibilities
103	164		necessarily related to the occupation , and
104		-
105	165		b. "pose a reasonable threat " means the nature of
106	166		criminal conduct for which the person was convicted
107	167		involved an act or threat of harm against another and

108	195		has a bearing on the fitness or ability to serve the
109	196		public or work with others in the occupat ion.

111	197		D. The examination administered or approved by the Board shall
112	198		include both a written and an oral portion, shall be administered in
113	199		the English language, and shall cover areas in anatomy, pathology,
114	200		podiatric medicine and surgery, dermatology, pharma cology,
115	201		biomechanics, anesthesia, radiology, Oklahoma law relating to
116	202		podiatric medicine, and such other subjects as the Board from time
117	203		to time determines necessary and appropriate. The Board may
118	204		authorize examination papers to be graded by one or more o f its own
119	205		members or by any one or more licensed podiatric physicians selected
120	206		by the Board. Each license issued by the Board shall be signed by
121	207		each member of the Board, bear the seal of the Board, and designate
122	208		the licensee as a licensed podiatric physi cian.

124	209		E. The Board may issue a temporary license if the applicant:
125		-
126	210		1. Has met the requirements of subsection B of this section;
127		-
128	211		2. Takes the examination administered or approved by the Board
129	212		and receives a passing score of at least seventy -five percent (75%)
130	213		on both the written and oral portions. An applicant receiving less
131	214		than a score of seventy -five percent (75%) on either the written or
132	215		oral portion of the examination shall be deemed to have failed the
133	216		entire examination;

137	217		3. Is within ninety (90) d ays of completing or has completed a
