7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 75 O.S. 2011, Section 250.2, as
8181 amended by Section 1, Chapter 357, O.S.L. 2013 (75 O.S. Supp. 2020,
8282 Section 250.2), is amended to read as follows:
8383 Section 250.2. A. Article V of the Oklahoma Constitution vests
8484 in the Legislature the power to make laws, and thereby to establish
8585 agencies and to desi gnate agency functions, budgets and purposes.
8686 Article VI of the Oklahoma Constitution charges the Executive Branch
8787 of Government with the responsibility to implement all measures
8888 enacted by the Legislature.

140140 B. In creating agencies and designating their f unctions and
141141 purposes, the Legislature may delegat e rulemaking authority to
142142 executive branch agencies to facilitate administration of
143143 legislative policy. The delegation of rulemaking aut hority is
144144 intended to eliminate the necessity of establishing every
145145 administrative aspect of general public policy by l egislation. In
146146 so doing, however, t he Legislature reserves to itself:
147147 1. The right to retract any delegation of rulemaking authority
148148 unless otherwise precluded by the Oklahoma Constitution;
149149 2. The right to establish any aspect of general policy by
150150 legislation, notwithstanding any delegati on of rulemaking authority;
151151 3. The right and responsibility to designate the method for
152152 rule promulgation, review and modification;
153153 4. The right to approve or disapprov e any adopted rule by joint
154154 resolution; and
155155 5. The right to disapprove a proposed per manent, promulgated or
156156 emergency rule at any time if the Legislature determines such rule
157157 to be an imminent harm to the health, safety or welfare of the
158158 public or the state or if the Legislature determines that a rule is
159159 not consistent with legislative int ent.
160160 C. All rulemaking authority delegated by the Legislature to
161161 executive branch agencies shall be used only to implement law or
162162 policy as set by the Legislature. With in three (3) years of the

218218 SECTION 2. AMENDATORY 75 O.S. 2011, Section 250.3, as
219219 amended by Section 2, Chapter 357, O.S.L. 2013 (75 O.S. Supp. 2020,
220220 Section 250.3), is amended to read as follows:
221221 Section 250.3. As used in the Administrative Procedures Ac t:
222222 1. “Administrative head” means an official or agency body
223223 responsible pursuant to law for issuing final agency orders;
224224 2. “Adopted” means a proposed emergency rule which has been
225225 approved by the agency but has not been approved or disapproved by
226226 the Governor as provided by Section 253 of this title, or a proposed
227227 permanent rule which has been approved by the agency , but has not
228228 been approved or disapproved by the Legislature or by dec laration of
229229 the Governor as provided by subsection D of Section 6 of this act
230230 308.3 of this title;
231231 3. “Agency” includes but is not limit ed to any constitutionally
232232 or statutorily created state board, bureau, commission, office,
233233 authority, public trust in which the state is a beneficiary, or
234234 interstate commission, except:
235235 a. the Legislature or any branch, committee or officer
236236 thereof, and
237237 b. the courts;

289289 4. “Emergency rule” means a rule that is made pursuant to
290290 Section 253 of this title;
291291 5. “Final rule” or “finally adopted rule” means a rule other
292292 than an emergency rule, whi ch has not been published pursuant to
293293 Section 255 of this title but is otherwise in compliance with the
294294 requirements of the Administrative Procedures Act, and is:
295295 a. approved by the Legislature pursuant to S ection 6 of
296296 this act 308.3 of this title, provided that any such
297297 joint resolution becomes law in accordance with
298298 Section 11 of Article VI of the Oklahoma Constitution,
299299 b. approved by the Governor pursuant to subsect ion D of
300300 Section 6 of this act 308.3 of this title,
301301 c. approved by a joint resolu tion pursuant to subsection
302302 B of Section 308 of this title, provided that any such
303303 resolution becomes law in accordance with Section 11
304304 of Article VI of the Oklahoma Constitution, or
305305 d. disapproved by a joint resolution pursuant to
306306 subsection B of Section 308 of this title or Section 6
307307 of this act 308.3 of this title, which has been vetoed
308308 by the Governor in accordance with Section 11 of
309309 Article VI of the Oklahoma Constitution and the veto
310310 has not been overridden;
311311 6. “Final agency order” means an order that include s findings
312312 of fact and conclusions of law pursuant to Section 312 of this

364364 title, is dispositive of an individual proceeding unless there is a
365365 request for rehearing, reopening , or reconsideration pursuant to
366366 Section 317 of this title and which is subject to judicial review;
367367 7. “Hearing examiner” means a person meeting the qualifications
368368 specified by Article II of the Administrative Procedures Act and who
369369 has been duly appointed by an agency to hold hearings and, as
370370 required, render orders or proposed orders ;
371371 8. “Individual proceeding” means the formal process employed by
372372 an agency having jurisdiction by law to resolve issues of law or
373373 fact between parties and which results in the exercise of discretion
374374 of a judicial nature;
375375 9. “License” includes the whole or part of any agency permit,
376376 certificate, approval, registration, c harter, or similar form of
377377 permission required by law;
378378 10. “Office” means the Office of the Secretary of State;
379379 11. “Order” means all or part of a formal or official decision
380380 made by an agency including but not limited to final agency orders;
381381 12. “Party” means a person or agency named and participating,
382382 or properly seeking and entitled by law to participate, in an
383383 individual proceeding;
384384 13. “Permanent rule” means a rule that is made pur suant to
385385 Section 303 of this title;

437437 14. “Person” means any individual, partnership, corporation,
438438 association, governmental subdivision , or public or private
439439 organization of any character other than an agency;
440440 15. “Political subdivision ” means a county, city, incorporated
441441 town or school district within this state;
442442 16. “Promulgated” means a finally adopted rule which has been
443443 filed and published in accordance with the provisions of the
444444 Administrative Procedures Act, or an emergency rule or preemptive
445445 rule which has been approved by the Governor;
446446 17. “Rule” means any agency statement or group of related
447447 statements of general applicability and future effect that
448448 implements, interprets or prescribes law or policy as delegated by
449449 the Legislature, or describes the procedure or practice requirements
450450 of the agency. The term “rule” includes the amendment or revocation
451451 of an effective rule but does not include:
452452 a. the issuance, renewal, denial, suspension or
453453 revocation or other sanction of an individual specific
454454 license,
455455 b. the approval, disapproval or pres cription of rates.
456456 For purposes of this subparagraph, the term “rates”
457457 shall not include fees or charges fixed by an agency
458458 for services provided by that agency including but not
459459 limited to fees charged for licen sing, permitting,
460460 inspections or publicatio ns,

521521 18. “Rulemaking” means the process employed by an agency for
522522 the formulation of a rule; and
523523 19. “Secretary” means the Secretary of State.
524524 SECTION 3. This act shall become effective November 1, 2021.
