7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA:
7676 SECTION 1. NEW LAW A new section of law to be codified
7777 in the Oklahoma Statutes as Section 34.204 of Title 62, unless there
7878 is created a duplication in numbering, reads as follows:
7979 A. As used in this section:
8080 1. "State agencies that provide, contract for, or otherwise
8181 fund mental health services" includes:
8282 a. the Department of Mental Health and Substance Abuse
8383 Services,
8484 b. the State Department of Health ,
8585 c. the Oklahoma Health Care Authority,
8686 d. the Department of Human Services,
8787 e. the Oklahoma Department of Veterans Affair s,

142142 h. The Oklahoma State System of Higher Education ,
143143 i. the Department of Corrections,
144144 j. the Insurance Department of the State of Oklahoma , and
145145 k. the Office of Juvenile Affairs ; and
146146 2. "Mental health services" means programs or services directly
147147 or indirectly related to the research, prevention or detection of
148148 mental health and substance use pr oblems, and all services necessary
149149 to treat, care for, control, supervise and rehabilitate persons with
150150 mental illness and substance use disorders .
151151 B. On or before September 30, 2021, all state agencies that
152152 provide, contract for, or otherwise fund mental health services
153153 shall report to the Office of Management and Enterprise Services
154154 (OMES):
155155 1. All mental health services provided by the agency. The
156156 name, purpose and primary funding source or sources of each service
157157 shall be included;
158158 2. A financial summary of spending amounts by meth od of finance
159159 associated with each program. The financial summary shall include
160160 annual spending on each se rvice in each of the last five (5) state

213213 3. Outcome summaries for mental health services. Summaries
214214 shall include target population or populations, numbers served and
215215 relevant metrics associated with the performance of the program.
216216 C. On or before November 30, 2021, OMES shall compile agency
217217 reports and submit a unified report to the President Pro Tempore of
218218 the Senate, the Speaker of t he House of Representatives, the
219219 Legislative Office of Fiscal Transparency and the Governor, and make
220220 the report available to the public. The unified report shall
221221 coherently organize and display agency informati on and provide a
222222 summary of statewide spendi ng by agency and type of service.
223223 D. The Department of Mental Health and Substance Abuse Services
224224 shall provide technical assistance to the agencies and OMES as
225225 necessary for the compilation of this report.
226226 SECTION 2. This act shall becom e effective July 1, 2021.
227227 SECTION 3. It being immediately necessary for the preservat ion
228228 of the public peace, health or safety, an emergency is hereb y
229229 declared to exist, by reason whereof this ac t shall take effect and
230230 be in full force fro m and after its passage and approval.
