An Act relating to the Department of Mental Health 
and Substance Abuse Services; requiring that portions 
of certain appropriated fun ds be used for certain 
purposes; creating pilot programs; authorizing 
request for early transfers of certain funds for 
specific purpose; providing for laps e of funds under 
certain conditions; requiring certain budget 
procedures; and prohibiting certain bud get 
procedures. 
 
 
 
 
 
SUBJECT:  Department of Mental Health and Substance Abuse Services 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
 
SECTION 1.  From the funds appropriated to the Departmen t of 
Mental Health and Substance Abuse Services in Enrolled House Bill 
No. 2900 of the 1st Session of the 58th Oklahoma Legislature, the 
sum of One Million Five Hundred Forty-one Thousand Two Hundred 
Fifty-two Dollars ($1,541,252.00) shall be used for prog ram growth. 
 
SECTION 2.  From the funds appropriated to the Department of 
Mental Health and Substance Abuse Services in Enrolled House Bill 
No. 2900 of the 1st Session of the 58th Oklahoma Legislat ure, the 
sum of Five Hundred Thousand Dollars ($500,000.00) shall be used to 
carry out the provisions of Enrolled Senate Bill No. 848 of the 1st 
Session of the 58th Oklahoma Legislature .

SECTION 3.  From the funds appropriated to the Depart ment of 
Mental Health and Substance Abuse Se rvices in Enrolled House Bill 
No. 2900 of the 1st Session of the 58th Oklahom a Legislature, the 
sum of Two Million Dollars ($2,000,000.00) shall be used to carry 
out the provisions of Enrolled House Bill No. 2877 of the 1st 
Session of the 58th Oklahoma Leg islature. 
 
SECTION 4.  From the funds appropriated to the Department of 
Mental Health and Substance Abuse Services in Enrolled House Bill 
No. 2900 of the 1st Session of the 58th Oklahoma Legislatur e, the 
agency shall increase the amount of crisis intervention training 
sessions offered to members of law enforcemen t. 
 
SECTION 5.  From the funds appropriated to the Department of 
Mental Health and Substance Abuse Services in Enrolled Hous e Bill 
No. 2900 of the 1st Session of the 58th Oklahoma Legislatur e, the 
sum of Two Million Thirty-four Thousand Dollars ($2,034,000.00) 
shall be used to expand connectivity programs between law 
enforcement officers, mental health providers and Oklahomans in a 
mental health crisis . 
 
SECTION 6.  From the funds appropriated to the Department of 
Mental Health and Substance Abuse Service s in Enrolled House Bill 
No. 2900 of the 1st Session of the 58th Oklahoma Legislature, the 
sum of Seven Million Five Hundred Thousand Dollars ($7,500,000.00) 
shall be used to expand the number of mental health crisis centers 
and urgent care centers. 
 
SECTION 7.  From the funds appropriated to the Department of 
Mental Health and Substance Abuse Services in Enrolled House Bill 
No. 2900 of the 1st Session of the 58th Oklahoma Legislature, the 
sum of Two Million Nine Hundred Sixty-six Thousand Dollars 
($2,966,000.00) shall be used for additional mobile crisi s teams to 
respond and diffuse crisis situations in communities. 
 
SECTION 8.  From the funds appropriated to the Departm ent of 
Mental Health and Substance Abuse Services in Enrol led House Bill 
No. 2900 of the 1st Session of the 58th Oklahoma Legislature, t he 
sum of Five Hundred T housand Dollars ($500,000.00) shall be used to 
maintain five pilot programs to provide offenders incarcerated in 
county jails in the State of Oklahoma acc ess to United States Food

and Drug Administration-approved, evidence-based, medication-
assisted treatment for opioid and alcohol dependence .  Treatment may 
be administered while the inmate is confin ed in the county jail and 
when participating in outpatient care upon release.  Funding may 
only be used for medical evaluations, the purc hase of United States 
Food and Drug Administration-approved medication to t reat opioid or 
alcohol dependency, individua l and group counseling services, 
cognitive behavioral ther apies and necessary medical and behavioral 
health staff needed to implement the program. 
 
SECTION 9.  The Commissioner of the Department of Mental Health 
and Substance Abuse Services may request through the Director of the 
Office of Management and Enterprise Services the early transfer by 
the Oklahoma Tax Commission of tax colle ctions to the General 
Revenue Fund for the purpose of early alloc ation to the Department's 
disbursing funds to alleviate cash-flow problems. 
 
SECTION 10. Appropriations made by Enrolled House Bill No. 2900 
of the 1st Session of the 58th Oklahoma Legislature, not including 
appropriations made for capital o utlay purposes, may be budgeted for 
the fiscal year ending June 30, 202 2 (hereafter FY-22) or may be 
budgeted for the fiscal year ending June 30, 202 3 (hereafter FY-23).  
Funds budgeted for F Y-22 may be encumbered only through June 30, 
2022, and must be expended by November 15, 2022.  Any funds 
remaining after November 15, 202 2, and not budgeted for FY -23, shall 
lapse to the credit of the proper fund for the then current fiscal 
year.  Funds budgeted for FY-23 may be encumbered only through June 
30, 2023.  Any funds remaining after November 15, 202 3, shall lapse 
to the credit of the proper fund for the then current fiscal year.  
These appropriations shall not be budg eted in both fiscal years 
simultaneously.  Funds budgeted in FY-22, and not required to pay 
obligations for that fiscal year, may be bud geted for FY-23, after 
the agency to which the funds have be en appropriated has prepared 
and submitted a budget work pro gram revision removing these f unds 
from the FY-22 budget work program and after such revision h as been 
approved by the Office of Managem ent and Enterprise Services.
