3363 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3564 SECTION 1. NEW LAW A new section of law to be codified
3665 in the Oklahoma Statutes as Section 307.6 of Title 36, unless there
3766 is created a duplication in numb ering, reads as follows:

3967 A. There is hereby created in the State Treasury a revolv ing
4068 fund for the Oklahoma Insurance Department, to be designated the
4169 “Insurance Department Pharmacy B enefits Manager Revolving Fund”.

4297 The fund shall be a continuing fund, not subject to fiscal year
4398 limitation, and shall consist of any monies d eposited to the fund as
4499 provided in subsection B of this section. All monies accruing to
45100 the credit of the fund are hereby appropriated and may be budgeted
46101 and expended by the Department for the purpose of licensing,

49102 regulating and investigating abuse, negligence, crim inal conduct, or
50103 other violations of insurance laws and regulations, and ensuring
51104 compliance with the same. Warrants for expenditures from the
52105 revolving fund shall be drawn by the State Treasurer, based on
53106 claims signed by an authorized employee or employees of the
54107 Insurance Department, and filed with the Director of the Office of
55108 Management and Enterp rise Services.

57109 B. The Department shall deposit all the monies obtained from
58110 the licensure and regulation of Pharmacy Benefits Manager s,
59111 including, but not l imited to, any fees, fines, set tlement or
60112 consent order proceeds, or other penalties assessed and c ollected
61113 into the Insurance Department Pharmacy Benefits Manager Revolving
62114 Fund created in subsection A of th is act. Provided, in each fiscal
63115 year the first Five Hundred Thousand Dollars ($500,000.00) which
64116 would otherwise have been deposited to this fund shall be
65117 transferred to the General Revenue Fund.

67118 SECTION 2. It being immediately necessary for the preservation
68119 of the public peace, healt h or safety, an emergency is hereby
