33	63		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

35	64		SECTION 1. NEW LAW A new section of law to be codified
36	65		in the Oklahoma Statutes as Section 307.6 of Title 36, unless there
37	66		is created a duplication in numb ering, reads as follows:

39	67		A. There is hereby created in the State Treasury a revolv ing
40	68		fund for the Oklahoma Insurance Department, to be designated the
41	69		“Insurance Department Pharmacy B enefits Manager Revolving Fund”.

42	97		The fund shall be a continuing fund, not subject to fiscal year
43	98		limitation, and shall consist of any monies d eposited to the fund as
44	99		provided in subsection B of this section. All monies accruing to
45	100		the credit of the fund are hereby appropriated and may be budgeted
46	101		and expended by the Department for the purpose of licensing,

49	102		regulating and investigating abuse, negligence, crim inal conduct, or
50	103		other violations of insurance laws and regulations, and ensuring
51	104		compliance with the same. Warrants for expenditures from the
52	105		revolving fund shall be drawn by the State Treasurer, based on
53	106		claims signed by an authorized employee or employees of the
54	107		Insurance Department, and filed with the Director of the Office of
55	108		Management and Enterp rise Services.

57	109		B. The Department shall deposit all the monies obtained from
58	110		the licensure and regulation of Pharmacy Benefits Manager s,
59	111		including, but not l imited to, any fees, fines, set tlement or
60	112		consent order proceeds, or other penalties assessed and c ollected
61	113		into the Insurance Department Pharmacy Benefits Manager Revolving
62	114		Fund created in subsection A of th is act. Provided, in each fiscal
63	115		year the first Five Hundred Thousand Dollars ($500,000.00) which
64	116		would otherwise have been deposited to this fund shall be
65	117		transferred to the General Revenue Fund.

67	118		SECTION 2. It being immediately necessary for the preservation
68	119		of the public peace, healt h or safety, an emergency is hereby
