5952 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6053 SECTION 1. NEW LAW A new section of law to be codified
6154 in the Oklahoma Statutes as Section 27 of Title 73, unless there is
6255 created a duplication in numbering, reads as foll ows:
6356 A. The Office of Management and Enterprise Services (OMES)
6457 shall promulgate rules for a flag flying program enabling the people
6558 of Oklahoma to request for a flag or flags to be flown at the
6659 Oklahoma State Capitol building on specific days for commemo rative
6760 purposes. Such flags shall be flown at the State Capitol based on
61+availability and in conformity with the rules established by OMES on
62+a first-come, first-served basis; provided, that the person
63+requesting the flag completes all necessary forms and pays all

95-availability and in conformity with the rules established by OMES on
96-a first-come, first-served basis; provided, that the person
97-requesting the flag completes all necessary forms and pays all
9890 necessary fees required by OMES for the implementation of this
9991 section of law.
10092 B. OMES is hereby authorized to develop a fee structure to
10193 provide for the costs associated with the flag fl ying program
10294 including but not limited to the cost of the purchase of the flag,
10395 cost of employee service s and cost of certificate confi rming date
10496 and time flag was flown. An additional fee of Twenty-five dollars
10597 ($25.00) per flag flown shall be charged an d deposited into the
10698 Capitol Preservation Fund.
10799 C. The flags available to be flown over the Oklahoma State
108100 Capitol according to this s ection shall be:
109101 1. The current flag of the State of Oklahoma ;
110102 2. The current flag of the United States;
111103 3. The original (Star & 46) flag of the State of Oklahoma ;
112104 4. The original 13 Stars and Stripes flag of the United States
113105 also known as the Betsy R oss flag;
114106 5. The “An Appeal to Heaven” flag flown by General George
115107 Washington;
116108 6. The Gadsden flag also known as th e “Don’t Tread On Me” flag;
117109 7. The POW/MIA flag;
118110 8. The National Guard flag; and
111+9. Any official flag for any branch of the United State s Armed
112+Forces.
113+SECTION 2. This act shall become effective July 1, 202 2.

148-SECTION 2. This act shall become effective July 1, 202 2.
149140 SECTION 3. It being immediately necessary for the preservation
150141 of the public peace, health or safety, an emergen cy is hereby
151142 declared to exist, by reason whereof this act shall take effect and
152143 be in full force from and after its passage and approval.
