47	40		An Act relating to State Capitol building; providing
48	41		for the Office of Management and Enterprise Services
49	42		to promulgate rules for a flag flying program;
50	43		providing for request to fly flag over State Capitol;
51	44		authorizing OMES to develop fee st ructure; depositing
52	45		of certain fee to certain fund; providing for flags
53	46		allowed to be flown; providing for codification;
54	47		providing an effective date; and declaring an

59	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	53		SECTION 1. NEW LAW A new section of law to be codified
61	54		in the Oklahoma Statutes as Section 27 of Title 73, unless there is
62	55		created a duplication in numbering, reads as foll ows:
63	56		A. The Office of Management and Enterprise Services (OMES)
64	57		shall promulgate rules for a flag flying program enabling the people
65	58		of Oklahoma to request for a flag or flags to be flown at the
66	59		Oklahoma State Capitol building on specific days for commemo rative
67	60		purposes. Such flags shall be flown at the State Capitol based on
	61	+	availability and in conformity with the rules established by OMES on
	62	+	a first-come, first-served basis; provided, that the person
	63	+	requesting the flag completes all necessary forms and pays all

96		-	a first-come, first-served basis; provided, that the person
97		-	requesting the flag completes all necessary forms and pays all
98	90		necessary fees required by OMES for the implementation of this
99	91		section of law.
100	92		B. OMES is hereby authorized to develop a fee structure to
101	93		provide for the costs associated with the flag fl ying program
102	94		including but not limited to the cost of the purchase of the flag,
103	95		cost of employee service s and cost of certificate confi rming date
104	96		and time flag was flown. An additional fee of Twenty-five dollars
105	97		($25.00) per flag flown shall be charged an d deposited into the
106	98		Capitol Preservation Fund.
107	99		C. The flags available to be flown over the Oklahoma State
108	100		Capitol according to this s ection shall be:
109	101		1. The current flag of the State of Oklahoma ;
110	102		2. The current flag of the United States;
111	103		3. The original (Star & 46) flag of the State of Oklahoma ;
112	104		4. The original 13 Stars and Stripes flag of the United States
113	105		also known as the Betsy R oss flag;
114	106		5. The “An Appeal to Heaven” flag flown by General George
115	107		Washington;
116	108		6. The Gadsden flag also known as th e “Don’t Tread On Me” flag;
117	109		7. The POW/MIA flag;
118	110		8. The National Guard flag; and
	111	+	9. Any official flag for any branch of the United State s Armed
	112	+	Forces.
	113	+	SECTION 2. This act shall become effective July 1, 202 2.

148		-	SECTION 2. This act shall become effective July 1, 202 2.
149	140		SECTION 3. It being immediately necessary for the preservation
150	141		of the public peace, health or safety, an emergen cy is hereby
151	142		declared to exist, by reason whereof this act shall take effect and
152	143		be in full force from and after its passage and approval.
