5748 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHO MA:
5849 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-706a, is
5950 amended to read as follows:
6051 Section 1-706a. A. This section shall be known and may be
6152 cited as the "No Patient Left Alone Act ".
6253 B. Subject to the provisions of subsections D and E of this
6354 section, each minor who is admitted to a hospital licensed pursuant
6455 to Section 1-702 of Title 63 of the Oklahoma Statutes this title has
6556 the right to have a:
57+1. A parent, guardian or person standing in lo co parentis who
58+shall have the ability to be present while the minor patient is
59+receiving hospital care; and
60+2. A pastor, minister, spiritual advisor, or other religious
61+leader designated by the parent, guardian or person standing in loco

93-1. A parent, guardian or person standing in lo co parentis who

96-2. A pastor, minister, spiritual advisor, or other religious

10090 C. Subject to the provisions of s ubsections D and E of this
10191 section, each adult who is admit ted to a hospital licensed pursuant
10292 to Section 1-702 of Title 63 of the Oklahoma Statutes this title has
10393 the right to designate a:
10494 1. A spouse, family member or caregiver who sh all have the
10595 ability to be physically present while the adult patient is
10696 receiving hospital care; and
10797 2. A pastor, minister, spiritual advisor, or other religious
10898 leader who shall have the ability to be present while the adult
10999 patient is receiving hospital care.
110100 D. A hospital may establish visitation policies that limit or
111101 restrict visitation when:
112102 1. The presence of visitors would be medica lly or
113103 therapeutically cont raindicated in the best clinical judgment of
114104 health care professionals;
115105 2. The presence of visitors would interfere with the care of or
116106 rights of any patient;
107+3. Visitors are engaging in disruptive, threatening or violent
108+behavior toward any staff member , patient or other visitor; or
109+4. Visitors are noncompliant with hospital policy.
110+E. A hospital may require visitors to wear personal protective
111+equipment, provided that any such required equipment shall be

144-3. Visitors are engaging in disruptive, threatening or violent
145-behavior toward any staff member , patient or other visitor; or
146-4. Visitors are noncompliant with hospital policy.
147-E. A hospital may require visitors to wear personal protective
148-equipment, provided that any such required equipment shall be
149138 provided by the hospital. A hospital may requi re visitors to comply
150139 with reasonable safety protocols and rules of conduct. The hospita l
151140 may revoke visitation rights for failure to comply with this
152141 section.
153142 F. Nothing in this section shall be construed to require a
154143 hospital to allow a visitor to ente r an operating room, isolation
155144 room, isolation unit, behavioral health setting or other t ypically
156145 restricted area or to remain present during the administration of
157146 emergency care in critical situations. Nothing in this sect ion
158147 shall be construed to requir e a hospital to allow a visitor access
159148 beyond the rooms, units or wards in which the pati ent the visitor is
160149 visiting is receiving care or beyond general common areas in the
161150 hospital.
162151 G. The rights specified in this section may not be terminated,
163152 suspended or waived by the hospital, the State Department of Health
164153 or any governmental entity, no twithstanding declarations of
165154 emergency declared by the Governor or the Legis lature. No hospital
166155 licensed pursuant to Section 1 -702 of Title 63 of the Oklahoma
156+Statutes this title shall require a patient to waive the rights
157+specified in this section.
158+H. Each hospital licensed pursuant to Section 1-702 of Title 63
159+of the Oklahoma Statutes this title shall post on its website
160+informational materials developed by the State Department of Healt h

202190 I. Unless expressly required by federal law or regulation, the
203191 State Department of Health or any other state agency shall not take
204192 any action against a ho spital for:
205193 1. Giving a visitor individual access to a hospital-controlled
206194 property or location;
207195 2. Failing to protect or otherwise ensure the safety or comfort
208196 of a visitor given access to a hospital -controlled property or
209197 location;
210198 3. Failing to follo w the guidelines of the Centers for Disease
211199 Control and Prevention or other federal guide lines that require or
212200 recommend restricting visitor access; or
213201 4. The acts or omissions of any visitor who is given access to
214202 a hospital-controlled property or locati on.
215203 SECTION 2. It being immediately necessary for the preservation
216204 of the public peace, health or safety, an emergency is hereby
205+declared to exist, by reason whereof this act shall take effect and
206+be in full force from and after its passage and approval.
