290290 24. Domestic assault and battery against a pregnant woman with
291291 knowledge of pregnancy and as a result, miscarriage or injury to the
292292 unborn child, as provided for in Section 644 of this title ,
293293 shall be required to serve not less than eighty -five percent (85%)
294294 of any sentence of imp risonment imposed by the judicial system prior
295295 to becoming eligible for consi deration for parole. Persons
296296 convicted of these offe nses shall not be eligible for earned credits
297297 or any other type of credits which have the effect of reducing the
298298 length of the sentence to less than eighty -five percent (85%) of the
299299 sentence imposed.
300300 SECTION 2. AMENDATORY 21 O.S. 2011 , Section 644, as last
301301 amended by Section 1, Chapter 200, O.S.L. 2019 (21 O.S. Supp. 2020,
302302 Section 644), is amended to rea d as follows:
303303 Section 644. A. Assault shall be pu nishable by imprisonment in
304304 a county jail not exceeding thirty (30) days, or by a fine of not
305305 more than Five Hundred Dollars ($500.00), or by both such fine and
306306 imprisonment.
307307 B. Assault and battery shall be punishable by imprisonment in a
308308 county jail not exceeding ninety (90) day s, or by a fine of not more
309309 than One Thousand Dollars ($1,000.00), or by both such fine and
310310 imprisonment.
311311 C. Any person who c ommits any assault and battery against a
312312 current or former intimate partner or a family or household memb er
313313 as defined by Section 60.1 of Title 22 of the Oklahoma Statutes

365365 shall be guilty of domestic abuse. Upon conviction, the defendant
366366 shall be punished by imprisonment in the county jail for not more
367367 than one (1) year, or by a fine not exceeding Five Thous and Dollars
368368 ($5,000.00), or by both such fine and imprisonment. Upon conviction
369369 for a second or subsequent offense, the person shall be punished by
370370 imprisonment in the custo dy of the Department of Correct ions for not
371371 more than four (4) years, or by a fine not exceeding Five Thous and
372372 Dollars ($5,000.00), or by both such fine and imprisonment. The
373373 provisions of Section 51.1 of this title shall apply to a ny second
374374 or subsequent offense.
375375 D. 1. Any person wh o, with intent to do bodily harm and
376376 without justifiable or excusable cause, commits any assault,
377377 battery, or assault and battery upon an intimate partner or a family
378378 or household member as defined by S ection 60.1 of Title 22 of the
379379 Oklahoma Statutes with any sharp or dangerous weapon, upon
380380 conviction, is guilty of domestic assaul t or domestic assault and
381381 battery with a dangerous weapon which shall be a felony and
382382 punishable by imprisonment in the custod y of the Department of
383383 Corrections not exceeding ten ( 10) years, or by imprisonment in a
384384 county jail not exceeding one (1) year. The provisions of Section
385385 51.1 of this title shall apply to any second or subsequent
386386 conviction for a violation of this paragr aph.
387387 2. Any person who, without such cause, shoots an intimate
388388 partner or a family or household member a s defined by Section 60.1

440440 of Title 22 of the Oklahoma Statutes by means of any deadly weapon
441441 that is likely to produce death shall, upon conviction, be guilty of
442442 domestic assault and battery with a deadly weapon which shall be a
443443 felony punishable by impris onment in the custody of the Department
444444 of Corrections not exceeding life. The provisions of Section 51.1
445445 of this title shall apply to any second or s ubsequent conviction fo r
446446 a violation of this paragraph .
447447 E. Any person convicted of domestic abuse commit ted against a
448448 pregnant woman with knowledge of the pregnancy shall be guilty of a
449449 misdemeanor, punishable by imprisonment in the county jail for not
450450 more than one (1) year.
451451 Any person convicted of a second or subsequent offense of
452452 domestic abuse against a pregnant woman with knowl edge of the
453453 pregnancy shall be guilty of a felony, punishable by imprisonment in
454454 the custody of the Department of Corrections for not less than ten
455455 (10) years.
456456 Any person convicted of domestic abuse committed against a
457457 pregnant woman with knowledge of the pregnancy and a miscarriage
458458 occurs or injury to the unborn child occurs shall be guilty of a
459459 felony, punishable by imprisonmen t in the custody of the Department
460460 of Corrections for not less than twenty (20) years.
461461 F. Any person convicted of domestic abuse as defined in
462462 subsection C of this section that results in great bodily injury to
463463 the victim shall be guilty of a felony and p unished by imprisonment

516516 ten (10) years, or by imprisonment in th e county jail for not more
517517 than one (1) year. The provisions of Section 51.1 of this title
518518 shall apply to any second or subse quent conviction of a v iolation of
519519 this subsection.
520520 G. Any person convicted of domestic abuse as defined in
521521 subsection C of this section that was committed in the presence of a
522522 child shall be punished by imprisonment in the county jail for not
523523 less than six (6) months nor more than one (1) year, or by a fine
524524 not exceeding Five Thousand Dollars ($5,000.00), o r by both such
525525 fine and imprisonment. Any person convicted of a second or
526526 subsequent domestic abuse as defined in subsection C of this section
527527 that was committed in the pres ence of a child shall be punish ed by
528528 imprisonment in the custody of the Department of Corrections for not
529529 less than one (1) year nor more than five (5) years, or by a fine
530530 not exceeding Seven Thousand Dollars ($7,000.00), or by both such
531531 fine and imprisonment. The provisions of Section 51.1 of this title
532532 shall apply to any second or su bsequent offense. For ev ery
533533 conviction of a domestic abuse crime in violation of any provision
534534 of this section committed against an intimate partner o r a family or
535535 household member as defined by Section 6 0.1 of Title 22 of the
536536 Oklahoma Statutes, the court shall:
537537 1. Specifically order as a condition of a suspended or deferred
538538 sentence that a defendant participate in counseling or undergo

590590 treatment to bring about the cessation of domestic abuse as
591591 specified in paragraph 2 of this subsection;
592592 2. a. The court shall require the defend ant to complete an
593593 assessment and follow the recommendations of a
594594 batterers' intervention program certified by the
595595 Attorney General. If the defendan t is ordered to
596596 participate in a batterers' intervention program, the
597597 order shall require the defendant to attend the
598598 program for a minimum of fifty -two (52) weeks,
599599 complete the program, and be evaluated before and
600600 after attendance of the program by progra m staff.
601601 Three unexcused absen ces in succession or seven
602602 unexcused absences in a period of fifty-two (52) weeks
603603 from any court-ordered batterers' intervention program
604604 shall be prima facie evidence of the violation of the
605605 conditions of probation for the di strict attorney to
606606 seek acceleration or revocation of any probation
607607 entered by the court.
608608 b. A program for anger management, couples counseling, or
609609 family and marital counseling shall not solely qualify
610610 for the counseling or treatmen t requirement for
611611 domestic abuse pursuant to this subs ection. The
612612 counseling may be ordered in addition to counseling
613613 specifically for the treatment of domestic abuse or

666666 sufficient evaluation and attendance at required
667667 counseling sessions, the domestic violence t reatment
668668 program or licensed professional determine s that the
669669 defendant does not evaluate as a perpetrator of
670670 domestic violence or does evaluate as a perpetrator of
671671 domestic violence and should complete other programs
672672 of treatment simultaneously or prior t o domestic
673673 violence treatment, including but not li mited to
674674 programs related to the mental health, apparent
675675 substance or alcohol abuse or inability or refusal to
676676 manage anger, the defendant shall be ord ered to
677677 complete the counseling as per the recommendat ions of
678678 the domestic violence treatment program or licensed
679679 professional;
680680 3. a. The court shall set a review hearing no more than one
681681 hundred twenty (120) days after the defendant is
682682 ordered to participate in a domestic abuse counseling
683683 program or undergo treatment for domestic abuse to
684684 assure the attendance and compliance of the defendant
685685 with the provisions of this subsection and the
686686 domestic abuse counseling or treatment requirements.
687687 The court may suspend sentencing of th e defendant
688688 until the defendant has presented proof to the court

741741 abuse by an individual licensed practitioner or a
742742 domestic abuse treatment program certified by the
743743 Attorney General and attendance at wee kly sessions of
744744 such program. Such proof shall be presented to the
745745 court by the defendant no later than on e hundred
746746 twenty (120) days after the defendant is ordered to
747747 such counseling or treatment. At such time, the court
748748 may complete sentencing, beginni ng the period of the
749749 sentence from the date that proof of enrollment is
750750 presented to the court, and schedul e reviews as
751751 required by subparagraphs a and b of this paragraph
752752 and paragraphs 4 and 5 of this subsection. Three
753753 unexcused absences in succession o r seven unexcused
754754 absences in a period of fifty-two (52) weeks from any
755755 court-ordered domestic abuse counse ling or treatment
756756 program shall be prima facie evidence of the violation
757757 of the conditions of probation for the district
758758 attorney to seek acceleratio n or revocation of any
759759 probation entered by the court.
760760 b. The court shall set a se cond review hearing after the
761761 completion of the counseling or treatment to assure
762762 the attendance and compliance of the defendant with
763763 the provisions of this subsection and th e domestic

815815 abuse counseling or treatment requirements. The court
816816 shall retain continuing jurisdiction over the
817817 defendant during the course of ordered counseling
818818 through the final review hearing;
819819 4. The court may set subsequent or o ther review hearings as the
820820 court determines necessary to assure the defendant attends and fully
821821 complies with the provisions of t his subsection and the domestic
822822 abuse counseling or treatment requirements;
823823 5. At any review hearing, if the defendant is not
824824 satisfactorily attendi ng individual counseling or a d omestic abuse
825825 counseling or treatment program or is not in compliance with a ny
826826 domestic abuse counseling or treatment requirements, the court may
827827 order the defendant to further or continue counseling, t reatment, or
828828 other necessary services. The court may revoke all or any part of a
829829 suspended sentence, def erred sentence, or probat ion pursuant to
830830 Section 991b of Title 22 of the Oklahoma Statutes and subject the
831831 defendant to any or all remaining portions o f the original sentence ;
832832 6. At the first review heari ng, the court shall require the
833833 defendant to appear in court. Thereafter, f or any subsequent review
834834 hearings, the court may accept a report on the progress of the
835835 defendant from individual counseling, domestic abuse counseli ng, or
836836 the treatment program. There shall be no requirement for the victim
837837 to attend review hearings; and

889889 7. If funding is available, a referee may be appointed and
890890 assigned by the presiding judge of the district court to hear
891891 designated cases set for re view under this subsection. Re asonable
892892 compensation for the referees shall be fix ed by the presiding judge .
893893 The referee shall meet the requirements and perform all duties in
894894 the same manner and procedure as set forth in Sections 1 -8-103 and
895895 2-2-702 of Title 10A of the Oklahoma Statute s pertaining to referees
896896 appointed in juvenile proc eedings.
897897 The defendant may be required to pay all or part of the cost of
898898 the counseling or treatment, in the discretion of the court.
899899 H. As used in subsection G of this sect ion, "in the presence of
900900 a child" means in the physical presence of a child; or ha ving
901901 knowledge that a chi ld is present and may see or hear an act of
902902 domestic violence. For the purposes of subsections C and G of this
903903 section, "child" may be any child whe ther or not related to the
904904 victim or the defendant.
905905 I. For the purposes of subsec tions C and G of this sec tion, any
906906 conviction for assault and battery against an intimate partner or a
907907 family or household member as defined by Section 60.1 of Title 22 of
908908 the Oklahoma Statutes shall const itute a sufficient basis for a
909909 felony charge:
910910 1. If that conviction is rend ered in any state, county or
911911 parish court of record of this or any other state; or

963963 2. If that conviction is rendered in any m unicipal court of
964964 record of this or any other state fo r which any jail time was
965965 served; provided, no conv iction in a municipal cou rt of record
966966 entered prior to November 1, 1997, shall constitute a prior
967967 conviction for purposes of a felony charge.
968968 J. Any person who commits any a ssault and battery with intent
969969 to cause great bodily harm by strangulation or atte mpted
970970 strangulation against an intimate partner or a family or household
971971 member as defined by Section 60.1 of Title 22 of the Oklahoma
972972 Statutes shall, upon conviction, be gui lty of domestic abuse by
973973 strangulation and shall be punished by imprisonment in th e custody
974974 of the Department of Corrections for a period of not less than one
975975 (1) year nor more than three (3) years, or by a fine of not more
976976 than Three Thousand Dollars ($3, 000.00), or by both such fine a nd
977977 imprisonment. Upon a second or subsequent convi ction for a
978978 violation of this section, the defendant shall be punished by
979979 imprisonment in the custody of the Department of Corrections for a

10411041 K. Any district court of this state and any judge thereof shall
10421042 be immune from any liability or prosecution for issuing an order
10431043 that requires a defen dant to:
10441044 1. Attend a treatment program for domestic a busers certified by
10451045 the Attorney General;
10461046 2. Attend counseling or treatment services ordered as part of
10471047 any suspended or deferred sentence or probation; and
10481048 3. Attend, complete, and be evaluated befor e and after
10491049 attendance by a treatment program for dome stic abusers, certified by
10501050 the Attorney General.
10511051 L. There shall be no charg e of fees or costs to any victim of
10521052 domestic violence, stalking, or sexual assault in connection with
10531053 the prosecution of a dom estic violence, stalkin g, or sexual assault
10541054 offense in this state.
10551055 M. In the course of prosecuting any c harge of domestic abuse,
10561056 stalking, harassment, rape, or violation of a protective order, the
10571057 prosecutor shall provide the court, prior to sentencing or any plea
10581058 agreement, a local history and any other ava ilable history of past
10591059 convictions of the defendant within the last ten (10) years relating
10601060 to domestic abuse, stalking, harassment, rape, violation of a

11141114 N. Any plea of guilty or fi nding of guilt for a violation of
11151115 subsection C, F, G, I or J of this section shall constitute a
11161116 conviction of the offense for the purpose of this act or any other
11171117 criminal statute under which the existe nce of a prior convicti on is
11181118 relevant for a period of ten (10) years following the completion of
11191119 any court imposed probationary te rm; provided, the person has not,
11201120 in the meantime, been convicted of a misdemeanor involving moral
11211121 turpitude or a felony.
11221122 O. For purposes of subsect ion F of this section, "great bodily
11231123 injury" means bone fracture, protracted and o bvious disfigurement,
11241124 protracted loss or impairment of the function of a body part, organ
11251125 or mental faculty, or substantial risk of death.
11261126 P. Any pleas of guilty or nolo con tendere or finding of guilt
11271127 to a violation of any provision of this section shall constitute a
11281128 conviction of the offense for the purpose of any subsection of this
11291129 section under which the existence of a prior conviction is relevant
11301130 for a period of ten (10) years following the completion of any
11311131 sentence or court imposed probationary term.
