28	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

30	58		SECTION 1. AMENDATORY 63 O.S. 2021, Section 2 -309B, is
31	59		amended to read as follows:

33	60		Section 2-309B. For the purposes of the Anti -Drug Diversion
34	61		Act:

36	62		1. “Bureau” means the Oklahoma State Bureau of Narcotics and
37	63		Dangerous Drugs Contr ol;

39	64		2. “Dispenser” means a person who distributes a Schedule II
40	65		controlled dangerous substance, but does not include a licensed
41	66		hospital pharmacy or a licensed nurse o r medication aide who

45	96		3. “Dispenser’s registration number” means the dispenser’s
46	97		Oklahoma State Bureau of Narcotics and Dangerous Drugs Control

49	98		registration number or, in the case of a pharmacist, the National
50	99		Association of Boards of Pharmacy number for the pharmacy wher e the
51	100		dispensation is made;

53	101		4. “Exception report” means an output of da ta indicating
54	102		Schedule II controlled dangerous substance dispensation which is
55	103		outside expected norms for a prescriber practicing a particular
56	104		specialty or field of health care, for a dispenser doing business in
57	105		a particular location, or for a recipient;
58		-
59	106		5. “Recipient” means the person for whom a prescription is
60	107		prescribed and who is the lawful inte nded ultimate user;
61		-
62	108		6. “Recipient’s agent” means a person who is authorized by the
63	109		ultimate user to pick up the recipient’s medication and deliver it
64	110		to the recipient or a person who c laims a prescription other than
65	111		the person to whom the medication is pr escribed;
66		-
67	112		7. “Recipient’s identification number” and “recipient’s agent’s
68	113		identification number” means the unique number contained on a valid
69	114		passport, military identification card, dr iver license, or
70	115		identification card issued to a recipient pursuant to Section 6-105
71	116		of Title 47 of the Oklahoma Statutes or similar statute of another
72	117		state if the recipient is not a resident of the State of Oklahoma,

75	147		passport, military identification card, driver license, or
76	148		identification card issued to the recipient’s parent or guardian
77	149		pursuant to Section 6-105 of Title 47 of the Oklahoma Statutes or
78	150		similar statute of another state if the paren t or guardian is not a
79	151		resident of the State of Oklahoma, or, if the controlled dangerou s
80	152		substance is obtained for an animal, the unique number contained on
81	153		the animal owner’s valid driver license or identification card
82	154		issued pursuant to Section 6 -105 of Title 47 of the Oklahoma
83	155		Statutes or similar statute of another state if the owner is n ot a
84	156		resident of the State of Oklahoma. Nonresident drug outlets
85	157		registered pursuant to the O klahoma Pharmacy Act and resident drug
86	158		outlets defined in Section 353.1 of Title 59 of the Oklahoma
87	159		Statutes are exempt from the picture identification requiremen t if
88	160		the nonresident and resident drug outlets have obtained the
89	161		identification of the patient through the prescription benefit plan

92	162		of the patient forms of identificat ion listed in 8 CFR
93	163		274a.2(b)(1)(v)(A) and (B);

95	164		8. “Registrant” means a person, persons , corporation or other
96	165		entity who has been issued by the Director of the Oklahoma State
97	166		Bureau of Narcotics and Dangerous Drugs Control a registration
98	167		pursuant to Section 2-302 of this title; and

107	200		repository pursuant to t he Anti-Drug Diversion Act shall be
108	201		confidential and shall not be ope n to the public. Access to the
109	202		information shall be limited to:

112	204		70 of the Oklahoma Statutes who are employed as investigati ve agents
113	205		of the Oklahoma State Bureau of Narcotics and Dangerous Dru gs

156	256		6. At the discretion of the Director of the Oklahoma State
157	257		Bureau of Narcotics and Dangerous Dru gs Control, medical
158	258		practitioners and their staff, including those employed by the
159	259		federal government in this state ; and

161	260		7. The members of the Opioi d Overdose Fatality Rev iew Board for
162	261		the purpose of carrying out the duties prescribed by Section 2 -1001
163	262		of this title.

165	263		B. This section shall not prevent access, at the discretion of
166	264		the Director of the Oklahoma State Bureau of Narcotics and Dangerous
167	265		Drugs Control, to investig ative information by peace officers and
168	266		investigative agents of federal, state, trib al, county or municipal
169	267		law enforcement agencies, district attorneys and the Attor ney
170	268		General in furtherance of crimin al, civil or administrative

173	298		employees of the Burea u, and to registrants in furtherance of
174	299		efforts to guard against the diversion of contr olled dangerous

179	301		C. This section shall not prevent the disclosure, at the
180	302		discretion of the Director of the Oklahoma State Bur eau of Narcotics
181	303		and Dangerous Drugs Control, of statistical information gathered
182	304		from the central repository to the g eneral public which shall be
183	305		limited to types and quan tities of controlled substances dispensed
184	306		and the county where dispensed for statistical, rese arch, substance
185	307		abuse prevention, or educational purposes, provided that consumer
186	308		confidentiality is not com promised.

188	309		D. This section shall not prevent the discl osure, at the
189	310		discretion of the Director of the Oklahoma State Bureau of Narcotics
190	311		and Dangerous Drugs Control, of prescription-monitoring-program
191	312		information to prescription-monitoring programs of othe r states
192	313		provided a reciprocal data-sharing agreement is in place.

194	314		E. The Department of Mental Health and Substance Abuse Services
195	315		and the State Department of Health ma y utilize the information in
196	316		the central repository for statistical, research, substanc e abuse
197	317		prevention, or educational purposes, provided that consumer
198	318		confidentiality is not compromised.

200	346		F. Any unauthorized disclosure of any information collected at
201	347		the central repository provided by the Anti -Drug Diversion Act shall
202	348		be a misdemeanor. Violation of the provisions of this section shall
203	349		be deemed willful neglect of duty and shall be grounds for removal
204	350		from office.

206	351		G. 1. Registrants shall have access t o the central repository
207	352		for the purposes of patien t treatment and to aid in the
208	353		determination in prescribing or screening new patients. The
209	354		physician or designee shall provide, upon request by the patient,
210	355		the history of the patient or the query histor y of the patient.
211		-
212	356		2. a. Prior to prescribing or autho rizing for refill, if one
213	357		hundred eighty (180) days have elapse d prior to the
214	358		previous access and check, of opiates, synthetic
215	359		opiates, semisynthetic opiates, benzodiazepin e or
216	360		carisoprodol to a patient of record, registrants or
217	361		members of their medical or administrative staff shall
218	362		be required to access the informati on in the central
219	363		repository to assess medical necessity and the
220	364		possibility that the patient may be unlawful ly
221		-

223	365		obtaining prescription drug s in violation of the
224	366		Uniform Controlled Dangerous Sub stances Act. The duty
225	367		to access and check shall not alter or o therwise amend
226	368		appropriate medical standards of care. The registrant
227	369		or medical provider shall note in the p atient file

229	398		maintain a copy of the information.

231	399		b. The requirements set forth in subparagraph a of this
232	400		paragraph shall not apply:

234	401		(1) to medical practitioners who prescribe the
235	402		controlled substances set forth in subparagraph a
236	403		of this paragraph for hospice or end -of-life
237	404		care, or
238		-
239	405		(2) for a prescription of a controlled su bstance set
240	406		forth in subparagraph a of this paragraph that is
241	407		issued by a practitioner for a patient residing
242	408		in a nursing facility as d efined by Section 1-
243	409		1902 of this title, provided that the
244	410		prescription is issued to a resident of such
245	411		facility.

247	412		3. Registrants shall not be liabl e to any person for any cla im
248	413		of damages as a result of accessing or failing to access the
249	414		information in the central repository and no lawsuit may be
250	415		predicated thereon.

252	416		4. The failure of a r egistrant to access and check the ce ntral
253	417		repository as require d under state or federal la w or regulation may,
254	418		after investigation, be grounds for the licensing board of th e
255	419		registrant to take disc iplinary action against the registrant.

257	447		H. The State Board of Podiatric Medical Examiners, the State
258	448		Board of Dentistry, the State Board of Medical Licensure and
259	449		Supervision, the State Board of Examiners in Optometry, the State
260	450		Oklahoma Board of Nursing, the Stat e Board of Osteopathic Examiners
261	451		and the State Board of Veterinary Medical Examiners sh all have the
262	452		sole responsibility for enforcement of the pro visions of subsection
263	453		G of this section. Nothing in this section shall be construed s o as
264	454		to permit the Director of the State Bureau of Narcot ics and

267	455		Dangerous Drugs Control to assess administrati ve fines provided for
268	456		in Section 2-304 of this title.

270	457		I. The Director of the Oklahoma State Bureau of Narcotics and
271	458		Dangerous Drugs Control, or a designee thereof, sha ll provide a
272	459		monthly list to the D irectors of the State Board of Podiatric
273	460		Medical Examiners, the State Board of Dentistry, the State Board of
274	461		Medical Licensure and Supervision, the State Board of Examiners in
275	462		Optometry, the State Oklahoma Board of Nursing, the Sta te Board of
276	463		Osteopathic Examiners and the State Board of Veterinary Medical
277	464		Examiners of the top twenty prescribers of controlled dangerous
278	465		substances within their respective areas of jurisdiction. Upon
279	466		discovering that a registrant is prescribing outside the limitations
280	467		of his or her licensu re or outside of drug registration rules or
281	468		applicable state laws, the respective licensing board shall be
282	469		notified by the Bureau in writing. Suc h notifications may be
283	470		considered complaints for the purpose of investig ations or other

285	499		have exclusive jurisdiction to take action against a licensee for a
286	500		violation of subsection G of this section.

288	501		J. Information regarding fatal and non fatal overdoses, other
289	502		than statistical information as requir ed by Section 2-106 of this
290	503		title, shall be completely confidential. Access to this information
291	504		shall be strictly limited to the Director of the Oklahoma State
292	505		Bureau of Narcotics and Dangerous Drugs Control or desig nee, the
293	506		Chief Medical Examiner, state agencies and boards provided in
294	507		subsection A of this section, and the registrant that enters the
295	508		information. Registrants shall not be liable to any person for a
296	509		claim of damages for information reported pursuant to the provisions
297	510		of Section 2-105 of this title.

299	511		K. The Director of the Oklahom a State Bureau of Narcotics and
300	512		Dangerous Drugs Control shall provide adequate means and procedures
301	513		allowing access to central repository information for re gistrants
302	514		lacking direct computer access.
303		-
304	515		L. Upon completion of an investigation in which it is
305	516		determined that a death was caused by an overdose, either
306	517		intentionally or unintentionally, of a controlled da ngerous
307	518		substance, the medical examiner shall be required to report t he
308	519		decedent’s name and date of birth to t he Oklahoma State Bureau of

311	520		Narcotics and Dangerous Drugs Control. The Oklahoma State Bureau of
312	521		Narcotics and Dangerous Drugs Control shall be re quired to maintain

317	552		M. The Oklahoma State Bureau of Narcotics and Dangerous Drugs
318	553		Control is authorized to provide unsolicited notification to the
319	554		licensing board of a pharmacist or practitioner if a patient ha s
320	555		received one or more prescripti ons for controlled substances in
321	556		quantities or with a frequency inconsistent with generally
322	557		recognized standards of safe practice. An unsolicited notification
323	558		to the licensing board of the pr actitioner pursuant to this sec tion:

325	559		1. Is confidential;
326		-
327	560		2. May not disclose information that is confidential pursuant
328	561		to this section; and
329		-
330	562		3. May be in a summary form suffic ient to provide notice of the
331	563		basis for the unsolicited notification.

333	564		N. Except as otherwise provide d for in subsections A and B of
334	565		this section, any information collected at the ce ntral repository,
335	566		as outlined in Section 2-309C of this title, shall:

337	567		1. Be confidential by law and privileged;
338		-
339	568		2. Not be subject to the Oklahoma Open Records Act;
340		-
341	569		3. Not be subject to subpoena; and
342		-
343	570		4. Not be subject to d iscovery or admissible in evide nce in any
344	571		private civil action.
