2857 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3058 SECTION 1. AMENDATORY 63 O.S. 2021, Section 2 -309B, is
3159 amended to read as follows:

3360 Section 2-309B. For the purposes of the Anti -Drug Diversion
3461 Act:

3662 1. “Bureau” means the Oklahoma State Bureau of Narcotics and

53101 4. “Exception report” means an output of da ta indicating
54102 Schedule II controlled dangerous substance dispensation which is
55103 outside expected norms for a prescriber practicing a particular
56104 specialty or field of health care, for a dispenser doing business in
57105 a particular location, or for a recipient;

59106 5. “Recipient” means the person for whom a prescription is
60107 prescribed and who is the lawful inte nded ultimate user;
61-
62108 6. “Recipient’s agent” means a person who is authorized by the
63109 ultimate user to pick up the recipient’s medication and deliver it
64110 to the recipient or a person who c laims a prescription other than
65111 the person to whom the medication is pr escribed;

67112 7. “Recipient’s identification number” and “recipient’s agent’s
68113 identification number” means the unique number contained on a valid
69114 passport, military identification card, dr iver license, or
70115 identification card issued to a recipient pursuant to Section 6-105
71116 of Title 47 of the Oklahoma Statutes or similar statute of another
72117 state if the recipient is not a resident of the State of Oklahoma,

73145 or, if the recipient is less than ei ghteen (18) years old and has no
74146 such identification, the unique number contained on a valid
75147 passport, military identification card, driver license, or
76148 identification card issued to the recipient’s parent or guardian
77149 pursuant to Section 6-105 of Title 47 of the Oklahoma Statutes or
78150 similar statute of another state if the paren t or guardian is not a
79151 resident of the State of Oklahoma, or, if the controlled dangerou s
80152 substance is obtained for an animal, the unique number contained on
81153 the animal owner’s valid driver license or identification card
82154 issued pursuant to Section 6 -105 of Title 47 of the Oklahoma
83155 Statutes or similar statute of another state if the owner is n ot a
84156 resident of the State of Oklahoma. Nonresident drug outlets
85157 registered pursuant to the O klahoma Pharmacy Act and resident drug
86158 outlets defined in Section 353.1 of Title 59 of the Oklahoma
87159 Statutes are exempt from the picture identification requiremen t if
88160 the nonresident and resident drug outlets have obtained the
89161 identification of the patient through the prescription benefit plan

95164 8. “Registrant” means a person, persons , corporation or other
96165 entity who has been issued by the Director of the Oklahoma State
97166 Bureau of Narcotics and Dangerous Drugs Control a registration
98167 pursuant to Section 2-302 of this title; and

165263 B. This section shall not prevent access, at the discretion of
166264 the Director of the Oklahoma State Bureau of Narcotics and Dangerous
167265 Drugs Control, to investig ative information by peace officers and
168266 investigative agents of federal, state, trib al, county or municipal
169267 law enforcement agencies, district attorneys and the Attor ney
170268 General in furtherance of crimin al, civil or administrative

172297 jurisdictions, designated legal, communications, and an alytical
173298 employees of the Burea u, and to registrants in furtherance of
174299 efforts to guard against the diversion of contr olled dangerous
175300 substances.

179301 C. This section shall not prevent the disclosure, at the
180302 discretion of the Director of the Oklahoma State Bur eau of Narcotics
181303 and Dangerous Drugs Control, of statistical information gathered
182304 from the central repository to the g eneral public which shall be
183305 limited to types and quan tities of controlled substances dispensed
184306 and the county where dispensed for statistical, rese arch, substance
185307 abuse prevention, or educational purposes, provided that consumer
186308 confidentiality is not com promised.

188309 D. This section shall not prevent the discl osure, at the
189310 discretion of the Director of the Oklahoma State Bureau of Narcotics
190311 and Dangerous Drugs Control, of prescription-monitoring-program
191312 information to prescription-monitoring programs of othe r states
192313 provided a reciprocal data-sharing agreement is in place.

194314 E. The Department of Mental Health and Substance Abuse Services
195315 and the State Department of Health ma y utilize the information in
196316 the central repository for statistical, research, substanc e abuse
197317 prevention, or educational purposes, provided that consumer
198318 confidentiality is not compromised.

200346 F. Any unauthorized disclosure of any information collected at
201347 the central repository provided by the Anti -Drug Diversion Act shall
202348 be a misdemeanor. Violation of the provisions of this section shall
203349 be deemed willful neglect of duty and shall be grounds for removal
204350 from office.

206351 G. 1. Registrants shall have access t o the central repository
207352 for the purposes of patien t treatment and to aid in the
208353 determination in prescribing or screening new patients. The
209354 physician or designee shall provide, upon request by the patient,
210355 the history of the patient or the query histor y of the patient.

212356 2. a. Prior to prescribing or autho rizing for refill, if one
213357 hundred eighty (180) days have elapse d prior to the
214358 previous access and check, of opiates, synthetic
215359 opiates, semisynthetic opiates, benzodiazepin e or
216360 carisoprodol to a patient of record, registrants or
217361 members of their medical or administrative staff shall
218362 be required to access the informati on in the central
219363 repository to assess medical necessity and the
220364 possibility that the patient may be unlawful ly

223365 obtaining prescription drug s in violation of the
224366 Uniform Controlled Dangerous Sub stances Act. The duty
225367 to access and check shall not alter or o therwise amend
226368 appropriate medical standards of care. The registrant
227369 or medical provider shall note in the p atient file

228397 that the central repository has been checked and may
229398 maintain a copy of the information.

231399 b. The requirements set forth in subparagraph a of this
232400 paragraph shall not apply:

234401 (1) to medical practitioners who prescribe the
235402 controlled substances set forth in subparagraph a
236403 of this paragraph for hospice or end -of-life
237404 care, or
238-
239405 (2) for a prescription of a controlled su bstance set
240406 forth in subparagraph a of this paragraph that is
241407 issued by a practitioner for a patient residing
242408 in a nursing facility as d efined by Section 1-
243409 1902 of this title, provided that the
244410 prescription is issued to a resident of such
245411 facility.

247412 3. Registrants shall not be liabl e to any person for any cla im
248413 of damages as a result of accessing or failing to access the
249414 information in the central repository and no lawsuit may be
250415 predicated thereon.

252416 4. The failure of a r egistrant to access and check the ce ntral
253417 repository as require d under state or federal la w or regulation may,
254418 after investigation, be grounds for the licensing board of th e
255419 registrant to take disc iplinary action against the registrant.

257447 H. The State Board of Podiatric Medical Examiners, the State
258448 Board of Dentistry, the State Board of Medical Licensure and
259449 Supervision, the State Board of Examiners in Optometry, the State
260450 Oklahoma Board of Nursing, the Stat e Board of Osteopathic Examiners
261451 and the State Board of Veterinary Medical Examiners sh all have the
262452 sole responsibility for enforcement of the pro visions of subsection
263453 G of this section. Nothing in this section shall be construed s o as
264454 to permit the Director of the State Bureau of Narcot ics and

267455 Dangerous Drugs Control to assess administrati ve fines provided for
268456 in Section 2-304 of this title.

270457 I. The Director of the Oklahoma State Bureau of Narcotics and
271458 Dangerous Drugs Control, or a designee thereof, sha ll provide a
272459 monthly list to the D irectors of the State Board of Podiatric
273460 Medical Examiners, the State Board of Dentistry, the State Board of
274461 Medical Licensure and Supervision, the State Board of Examiners in
275462 Optometry, the State Oklahoma Board of Nursing, the Sta te Board of
276463 Osteopathic Examiners and the State Board of Veterinary Medical
277464 Examiners of the top twenty prescribers of controlled dangerous
278465 substances within their respective areas of jurisdiction. Upon
279466 discovering that a registrant is prescribing outside the limitations
280467 of his or her licensu re or outside of drug registration rules or
281468 applicable state laws, the respective licensing board shall be
282469 notified by the Bureau in writing. Suc h notifications may be
283470 considered complaints for the purpose of investig ations or other

284498 actions by the respect ive licensing board. Licensing boards sh all
285499 have exclusive jurisdiction to take action against a licensee for a
286500 violation of subsection G of this section.

288501 J. Information regarding fatal and non fatal overdoses, other
289502 than statistical information as requir ed by Section 2-106 of this
290503 title, shall be completely confidential. Access to this information
291504 shall be strictly limited to the Director of the Oklahoma State
292505 Bureau of Narcotics and Dangerous Drugs Control or desig nee, the
293506 Chief Medical Examiner, state agencies and boards provided in
294507 subsection A of this section, and the registrant that enters the
295508 information. Registrants shall not be liable to any person for a
296509 claim of damages for information reported pursuant to the provisions
297510 of Section 2-105 of this title.

299511 K. The Director of the Oklahom a State Bureau of Narcotics and
300512 Dangerous Drugs Control shall provide adequate means and procedures
301513 allowing access to central repository information for re gistrants
302514 lacking direct computer access.

304515 L. Upon completion of an investigation in which it is
305516 determined that a death was caused by an overdose, either
306517 intentionally or unintentionally, of a controlled da ngerous
307518 substance, the medical examiner shall be required to report t he
308519 decedent’s name and date of birth to t he Oklahoma State Bureau of

311520 Narcotics and Dangerous Drugs Control. The Oklahoma State Bureau of

317552 M. The Oklahoma State Bureau of Narcotics and Dangerous Drugs
318553 Control is authorized to provide unsolicited notification to the
319554 licensing board of a pharmacist or practitioner if a patient ha s
320555 received one or more prescripti ons for controlled substances in
321556 quantities or with a frequency inconsistent with generally
322557 recognized standards of safe practice. An unsolicited notification
323558 to the licensing board of the pr actitioner pursuant to this sec tion:

325559 1. Is confidential;

327560 2. May not disclose information that is confidential pursuant
328561 to this section; and

330562 3. May be in a summary form suffic ient to provide notice of the
331563 basis for the unsolicited notification.

333564 N. Except as otherwise provide d for in subsections A and B of
334565 this section, any information collected at the ce ntral repository,
335566 as outlined in Section 2-309C of this title, shall:

337567 1. Be confidential by law and privileged;

339568 2. Not be subject to the Oklahoma Open Records Act;
