8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9090 SECTION 1. NEW LAW A new section of law to be codified
9191 in the Oklahoma Statutes as Section 1-740.31 of Title 63, unless
9292 there is created a duplication in numbering, reads as follows:
9393 This act shall be known and may be cited as the Every Mother
9494 Matters Act.

146146 SECTION 2. NEW LAW A new section of law to be codified
147147 in the Oklahoma Statutes as Section 1-740.32 of Title 63, unless
148148 there is created a duplication in numbering, reads as follows:
149149 A. In addition to the informed consent requirements relating to
150150 abortion provided under Title 63 of the Oklahoma Statutes, except
151151 during a medical emergency, and before the abortion is performed or
152152 induced, the physician who is to perform or induce an abortion shall
153153 confirm the pregnant woman received a pre-abortion resource access
154154 assistance offer, as required by this section, by verifying the
155155 unique identifying number as provided by subsection F of this
156156 section, devoid of the woman ’s personally identifiable information,
157157 as provided by the State Department of Health .
158158 B. A care agent providing a resource access assistance offer
159159 under this section:
160160 1. Shall be:
161161 a. licensed as a counselor, doctor, psychologist, social
162162 worker, nurse, advanced practice registered nurse,
163163 community health worker, physician assistant, or
164164 marriage and family therapist, or
165165 b. acting under the supervision of an individual
166166 described by subparagraph a of this paragraph ;
167167 2. Shall:
168168 a. be authorized under a contract with the Department to
169169 provide resource access assistance offers and support

221221 services on behalf of this state in accordance with
222222 this section,
223223 b. complete a training program on identifying and
224224 assisting victims of human trafficking using a
225225 standardized curriculum approved by the Department ,
226226 and
227227 c. comply with state and federal medical records privacy
228228 laws;
229229 3. In the last two years, shall not:
230230 a. have performed or induced a n abortion, or
231231 b. have served as a director, board member, officer,
232232 volunteer, or employee for an abortion facility
233233 licensed by the Department; and
234234 4. Shall not refer a woman to an abortio n provider.
235235 C. The resource access assistance offer shall be provided by
236236 and on behalf of this state at no cost to the pregnant woman from a
237237 care agent who meets the qualifications described by subsection B of
238238 this section. The care agent during a resourc e access assistance
239239 offer shall provide:
240240 1. An assessment of eligibility for and offer of assistance in
241241 obtaining support services other than abortion for the woman or
242242 unborn child’s biological father including housing, employment,
243243 resume development, ch ild care, prenatal and postpartum medical
244244 care, mental health or behavioral counse ling, adoption services,

296296 financial assistance, abuse or neglect prevention assistance,
297297 substance or alcohol abuse prevention assistance, and health benef it
298298 plan coverage;
299299 2. Education on available public and private resources to
300300 address the woman’s or biological father ’s socioeconomic needs; and
301301 3. Screening for:
302302 a. family violence, abuse, and neglect victimization,
303303 b. coercion of abortion , and
304304 c. human trafficking victimization.
305305 D. A care agent who obtains information that the pregnant woman
306306 is a victim of human trafficking or coercion of abortion may:
307307 1. Submit a report to the appropriate law enforcement agency of
308308 the suspected human trafficking or co ercion of abortion if, before
309309 submitting the report, the care agent:
310310 a. provides a written disclosure to the pregnant woman
311311 that the woman’s identifying information will be
312312 provided in the report, and
313313 b. after receiving the written disclosure described by
314314 subparagraph a of this paragraph, the pregnant woman
315315 consents to the care agent submitting the report; or
316316 2. Provide to the pregnant woman information on the methods
317317 available for the woman to report human trafficking or coercion of
318318 abortion to the approp riate law enforcement agency.

370370 E. A care agent shall request a unique identifying number
371371 devoid of the pregnant woman ’s personally identifiable information
372372 from the system developed by the Department to certify that the
373373 woman received the resource access a ssistance offer.
374374 F. The Department shall develop and maintain an authentication
375375 system that provides the pregnant woman a u nique identifying number
376376 required under this section. The system shall:
377377 1. Allow a care agent to request a unique identifying number
378378 for the pregnant woman;
379379 2. Allow a physician who is to perform or induce an abortion to
380380 verify the unique identifying nu mber;
381381 3. Ensure that the identity of an individual pregnant woman,
382382 care agent, or physician who is to perform or induce the abortion is
383383 not disclosed in the authentication system; and
384384 4. Remove any personal information for the pregnant woman, care
385385 agent, or physician as soon as the information is not needed to
386386 verify the unique identifying number.
387387 G. The Department shall establish a single toll-free telephone
388388 number through which a woman seeking an abortion in this state may
389389 receive a resource access assistance offer on a twenty-four-hour
390390 basis. The Department shall ensure the placed call automatically
391391 routes the woman to a care age nt at a contracting agency to provide
392392 the resource access assistance offer.
393393 H. The pregnant woman:

445445 1. Is not required to:
446446 a. provide any information to the care agent or
447447 contracting agency, or
448448 b. initiate or complete services offered under this
449449 section to obtain an abortion;
450450 2. May decline services under this section at any time; and
451451 3. If accepting a resource access assistance offer, shall
452452 retain access to the offer until the s econd anniversary of the date
453453 of acceptance, regardless of the woman ’s pregnancy.
454454 SECTION 3. NEW LAW A new section of law to be codified
455455 in the Oklahoma Statutes as Section 1-740.33 of Title 63, unless
456456 there is created a duplication in numbering, reads as follows:
457457 A. Before the abortion begins, documentation of the receipt of
458458 the resource access assistance offer required under Section 2 of
459459 this act shall be placed in the pregnant woman ’s medical records.
460460 B. Documentation of the receipt of the resource access
461461 assistance offer required under Section 2 of this act shall be
462462 retained by the facility where the abortion is performed until:
463463 1. The seventh anniversary of the date it is signed; or
464464 2. If the pregnant woman is a minor, the later of:
465465 a. the seventh anniversary of the date it is signed, or
466466 b. the woman’s 21st birthday.

518518 SECTION 4. NEW LAW A new section of law to be codified
519519 in the Oklahoma Statutes as Section 1-740.34 of Title 63, unless
520520 there is created a duplication in numbering, reads as follows:
521521 A. The State Commissioner of H ealth shall adopt rules as
522522 necessary to implement this act.
523523 B. Not later than July 1, 2023, the State Department of Health
524524 shall contract with one or more contracting agencies that employ
525525 care agents throughout this state to provide the pre-abortion
526526 resource access assistance of fer and assistance in obtaining support
527527 services described by Section 2 of this act.
528528 C. The Department shall implement this act subject to
529529 availability of funding .
530530 SECTION 5. This act shall become effective Novembe r 1, 2022.
