89	89	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
90	90	SECTION 1. NEW LAW A new section of law to be codified
91	91	in the Oklahoma Statutes as Section 1-740.31 of Title 63, unless
92	92	there is created a duplication in numbering, reads as follows:
93	93	This act shall be known and may be cited as the Every Mother
94	94	Matters Act.

146	146	SECTION 2. NEW LAW A new section of law to be codified
147	147	in the Oklahoma Statutes as Section 1-740.32 of Title 63, unless
148	148	there is created a duplication in numbering, reads as follows:
149	149	A. In addition to the informed consent requirements relating to
150	150	abortion provided under Title 63 of the Oklahoma Statutes, except
151	151	during a medical emergency, and before the abortion is performed or
152	152	induced, the physician who is to perform or induce an abortion shall
153	153	confirm the pregnant woman received a pre-abortion resource access
154	154	assistance offer, as required by this section, by verifying the
155	155	unique identifying number as provided by subsection F of this
156	156	section, devoid of the woman ’s personally identifiable information,
157	157	as provided by the State Department of Health .
158	158	B. A care agent providing a resource access assistance offer
159	159	under this section:
160	160	1. Shall be:
161	161	a. licensed as a counselor, doctor, psychologist, social
162	162	worker, nurse, advanced practice registered nurse,
163	163	community health worker, physician assistant, or
164	164	marriage and family therapist, or
165	165	b. acting under the supervision of an individual
166	166	described by subparagraph a of this paragraph ;
167	167	2. Shall:
168	168	a. be authorized under a contract with the Department to
169	169	provide resource access assistance offers and support

222	222	this section,
223	223	b. complete a training program on identifying and
224	224	assisting victims of human trafficking using a
225	225	standardized curriculum approved by the Department ,
226	226	and
227	227	c. comply with state and federal medical records privacy
228	228	laws;
229	229	3. In the last two years, shall not:
230	230	a. have performed or induced a n abortion, or
231	231	b. have served as a director, board member, officer,
232	232	volunteer, or employee for an abortion facility
233	233	licensed by the Department; and
234	234	4. Shall not refer a woman to an abortio n provider.
235	235	C. The resource access assistance offer shall be provided by
236	236	and on behalf of this state at no cost to the pregnant woman from a
237	237	care agent who meets the qualifications described by subsection B of
238	238	this section. The care agent during a resourc e access assistance
239	239	offer shall provide:
240	240	1. An assessment of eligibility for and offer of assistance in
241	241	obtaining support services other than abortion for the woman or
242	242	unborn child’s biological father including housing, employment,
243	243	resume development, ch ild care, prenatal and postpartum medical
244	244	care, mental health or behavioral counse ling, adoption services,

297	297	substance or alcohol abuse prevention assistance, and health benef it
298	298	plan coverage;
299	299	2. Education on available public and private resources to
300	300	address the woman’s or biological father ’s socioeconomic needs; and
301	301	3. Screening for:
302	302	a. family violence, abuse, and neglect victimization,
303	303	b. coercion of abortion , and
304	304	c. human trafficking victimization.
305	305	D. A care agent who obtains information that the pregnant woman
306	306	is a victim of human trafficking or coercion of abortion may:
307	307	1. Submit a report to the appropriate law enforcement agency of
308	308	the suspected human trafficking or co ercion of abortion if, before
309	309	submitting the report, the care agent:
310	310	a. provides a written disclosure to the pregnant woman
311	311	that the woman’s identifying information will be
312	312	provided in the report, and
313	313	b. after receiving the written disclosure described by
314	314	subparagraph a of this paragraph, the pregnant woman
315	315	consents to the care agent submitting the report; or
316	316	2. Provide to the pregnant woman information on the methods
317	317	available for the woman to report human trafficking or coercion of
318	318	abortion to the approp riate law enforcement agency.

370	370	E. A care agent shall request a unique identifying number
371	371	devoid of the pregnant woman ’s personally identifiable information
372	372	from the system developed by the Department to certify that the
373	373	woman received the resource access a ssistance offer.
374	374	F. The Department shall develop and maintain an authentication
375	375	system that provides the pregnant woman a u nique identifying number
376	376	required under this section. The system shall:
377	377	1. Allow a care agent to request a unique identifying number
378	378	for the pregnant woman;
379	379	2. Allow a physician who is to perform or induce an abortion to
380	380	verify the unique identifying nu mber;
381	381	3. Ensure that the identity of an individual pregnant woman,
382	382	care agent, or physician who is to perform or induce the abortion is
383	383	not disclosed in the authentication system; and
384	384	4. Remove any personal information for the pregnant woman, care
385	385	agent, or physician as soon as the information is not needed to
386	386	verify the unique identifying number.
387	387	G. The Department shall establish a single toll-free telephone
388	388	number through which a woman seeking an abortion in this state may
389	389	receive a resource access assistance offer on a twenty-four-hour
390	390	basis. The Department shall ensure the placed call automatically
391	391	routes the woman to a care age nt at a contracting agency to provide
392	392	the resource access assistance offer.
393	393	H. The pregnant woman:

446	446	a. provide any information to the care agent or
447	447	contracting agency, or
448	448	b. initiate or complete services offered under this
449	449	section to obtain an abortion;
450	450	2. May decline services under this section at any time; and
451	451	3. If accepting a resource access assistance offer, shall
452	452	retain access to the offer until the s econd anniversary of the date
453	453	of acceptance, regardless of the woman ’s pregnancy.
454	454	SECTION 3. NEW LAW A new section of law to be codified
455	455	in the Oklahoma Statutes as Section 1-740.33 of Title 63, unless
456	456	there is created a duplication in numbering, reads as follows:
457	457	A. Before the abortion begins, documentation of the receipt of
458	458	the resource access assistance offer required under Section 2 of
459	459	this act shall be placed in the pregnant woman ’s medical records.
460	460	B. Documentation of the receipt of the resource access
461	461	assistance offer required under Section 2 of this act shall be
462	462	retained by the facility where the abortion is performed until:
463	463	1. The seventh anniversary of the date it is signed; or
464	464	2. If the pregnant woman is a minor, the later of:
465	465	a. the seventh anniversary of the date it is signed, or
466	466	b. the woman’s 21st birthday.

521	521	A. The State Commissioner of H ealth shall adopt rules as
522	522	necessary to implement this act.
523	523	B. Not later than July 1, 2023, the State Department of Health
524	524	shall contract with one or more contracting agencies that employ
525	525	care agents throughout this state to provide the pre-abortion
526	526	resource access assistance of fer and assistance in obtaining support
527	527	services described by Section 2 of this act.
528	528	C. The Department shall implement this act subject to
529	529	availability of funding .
530	530	SECTION 5. This act shall become effective Novembe r 1, 2022.
