2755 BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:

2956 SECTION 1. AMENDATORY 17 O.S. 2021, Section 304, is
3057 amended to read as follows:

3258 Section 304. The provisions of the Oklahoma Petroleum Storage
3359 Tank Consolidation Act shall not apply to:
60+1. Septic tank systems;
61+2. Pipeline facilities;
62+3. Surface impoundments, pits, ponds or lagoons;
63+4. Stormwater and wastewater coll ection systems;
64+5. Flow-through process tank systems;

80143 under Subtitle C of the federal Solid Waste Dis posal Act, 42 U.S.C.,
81144 Section 6921 et seq., or substances regulated as hazardous wastes
82145 under the Oklahoma Hazardous Waste Management Act; and

84146 15. 16. Fuel storage facilities and associat ed equipment used
85147 in wholesale or bulk distribution activities that are supplied by a
86148 pipeline and from which fuel may be removed at a rack.

88149 SECTION 2. This act shall become effective November 1, 2022.
