7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law to be codified
8181 in the Oklahoma Statutes as Section 777 of Title 74, unless there is
8282 created a duplication in numbering, reads as follows:
8383 A. There is hereby created the Oklahoma Commission on Race and
8484 Equality. The Commission shall consist of thirty (30) members. The
8585 members shall be appointed as follows : seven members shall be
8686 appointed by the Governor, seven members shall be appointed by t he
8787 President Pro Tempore of the Senate , seven members shall be
8888 appointed by the Speaker of the House of Repres entatives, and nine
8989 members shall be app ointed by the Oklahoma Legislative Black Caucus .

141141 All members shall be appointed by the appropriat e appointing
142142 authority for a term of three (3) years commencing with the date
143143 that the previous appointee ’s term expired. Each member shall serve
144144 no more than three terms. The member shall only serve two
145145 consecutive terms and shall be inactive for a period of on e (1) year
146146 prior to serving the maximum three-term limit. In making such
147147 appointments, consideration shall be give n to making the membership
148148 broadly representative of the geographic areas of the state and the
149149 several racial and et hnic groups residing in t he state. Each member
150150 shall hold office until the successor of the member is appointed and
151151 has qualified. A member of the Commission may be removed by the
152152 appropriate appointing authority for cause. A member appointed to
153153 fill a vacancy occurring before the expiration of a term of a member
154154 separated from the Commission for any cause shall b e appointed for
155155 the remainder of the term of the member whose offic e has been so
156156 vacated. Members of the Commission shall receive no salary but
157157 shall be entitled to tr avel reimbursement as provided by t he State
158158 Travel Reimbursement Act from funds available to the appropriate
159159 appointing authority.
160160 B. The Office of Manage ment and Enterprise Services shall
161161 provide staff support to the Oklahoma Commission on Race and
162162 Equality and make arrangements for sui table meeting space for the
163163 Commission as needed.

215215 C. The President Pro Tempore of the Senate shall name the chair
216216 of the Oklahoma Commission on Race and Equal ity, and the Speaker of
217217 the House of Representatives shall name the vice-chair. Any other
218218 officers deemed necessary sh all be elected from among the members at
219219 the first meeting of the Commission. Thereafter, at the fi rst
220220 meeting of each fiscal year, the Commission shall elect a chair, a
221221 vice-chair and such other offi cers deemed necessary to conduct the
222222 business of the Commission from among its members. The Commission
223223 shall meet at least once every three (3) months and at such other
224224 times as called by the chair or by a majority of the Commission.
225225 D. The Oklahoma Comm ission on Race and Equality shal l have the
226226 power and the duty to:
227227 1. Advise on equality issues relating to racial discrimination
228228 and bias, state agencies and employees, communities, organizations
229229 and businesses of this state which desire the services of t he
230230 Commission;
231231 2. Monitor legislation to determine whether legislation is
232232 discriminatory toward one race or ethni city or whether the race or
233233 ethnicity of an individual would have an effect o n the enforcement
234234 of the legislation;
235235 3. Act as a resource and a clearinghouse for research on issues
236236 related to racial discrimination and bias;
237237 4. Act as a resource in any state appointments to commissions
238238 and boards for diversity ;

290290 5. Conduct meetings and se minars within the state as
291291 appropriate to support the goals and duties of the Commission; and
292292 6. Report to the Governor, the Presiden t Pro Tempore of the
293293 Senate, and the Speaker of the House of Representatives of its
294294 activities. The report may include recommendations concerning
295295 needed legislation or regulatory changes relating to racial
296296 discrimination and bias.
297297 SECTION 2. NEW LAW A new section of law to be codified
298298 in the Oklahoma Statutes as Section 777.1 of Title 74, unless there
299299 is created a duplication in numbering, reads as follows:
300300 There is hereby created in the State Treasury a revolving fund
301301 for the Office of Management and Enterprise Services designated the
302302 “Oklahoma Commission on Race and Equality Revolving Fund”. The fund
303303 shall be a continuing fund, not subject to fiscal year limitations,
304304 and shall consist of all gifts and d onations contributed to sup port
305305 the work of the Oklahoma Commission on Race and Equality. All
306306 monies accrued to the credit of the fund are hereby appropriated and
307307 may be budgeted and expended by the Director of the Office of
308308 Management and Enterprise Servi ces on behalf of the Okla homa
309309 Commission on Race and Equality for the purposes prescribed by the
310310 Legislature in creating the Commission. Expenditures from the fund
311311 shall be made upon warrants issued by the State Treasurer against
312312 claims filed as prescribed by law with the Direct or of the Office of
313313 Management and Enterprise Services for approval and paym ent.
