2857 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA:

3058 SECTION 1. NEW LAW A new section of law to be codified
3159 in the Oklahoma Statutes as Section 233.10a of Title 44, unless
3260 there is created a duplication in numb ering, reads as follows:

3461 The Military Department of the State of Ok lahoma may purchase
3562 computer hardware or software or any s ervices related to software
3663 development, software modifications , or any other services related
3764 to the operation and maintenance of comput er hardware or software or
3865 both independently and with out prior approval from the Office of

81144 The standards shall, upon adoption, be the minim um requirements
82145 applicable to all agencies. These standards shall be compatible
83146 with the standards establi shed for the Oklahoma Government
84147 Telecommunications Network. Individual agency st andards may be more
85148 specific than statewide requirements but shall in no case be less
86149 than the minimum mandatory standards. Where standards required of
87150 an individual agency of the state by agencies of the federal
88151 government are more strict than the state minimum standards, such
89152 federal requirements shall be applicable;

93153 4. Develop and maintain applicat ions for agencies not having
94154 the capacity to do so;

96155 5. Operate a data serv ice center to provide operations and
97156 hardware support for agencies requiring such services and for
98157 statewide systems;

100158 6. Maintain a directory of the following which have a value of
101159 Five Hundred Dollars ($500.00) or more: application systems, systems
102160 software, hardware, internal and external information technology,
103161 communication or tele communication equipment owned, leased, or
104162 rented for use in communi cation services for state govern ment,
105163 including communication services provided as part of any other total
106164 system to be used by the state or any of its agencies, and studies
107165 and training courses in use by all agencies of the st ate; and

112196 7. Assist agencies in the acquisition and utilization of
113197 information technology systems and hardware to effectuate the
114198 maximum benefit for the provision of services and accomplishment of
115199 the duties and responsibilities of agencies of the st ate;

117200 8. Coordinate for the executive branch of state government
118201 agency information technology activities, encourage joi nt projects
119202 and common systems, linking of agency systems thr ough the review of
120203 agency plans, review and approval of all statewide contr acts for
121204 software, hardware and information technology consulting services
122205 and development of a statewide plan and its i ntegration with the
123206 budget process to ensure that development s or acquisitions are
124207 consistent with statewide objectives and that propose d systems are
125208 justified and cost effective;

127209 9. Develop performance reporting guid elines for information
128210 technology facilities and conduct an annual review to compare agency
129211 plans and budgets with results and expenditures;

131212 10. Establish operations review procedures for information
132213 technology installations operated by agencies of the st ate for
133214 independent assessment of prod uctivity, efficiency, cost

141245 12. Provide system development and consultant support to state
142246 agencies on a contractual, cost reimbursement basis; and

144247 13. In conjunction with the Oklaho ma Office of Homeland
145248 Security, enforce the minimum information security an d internal
146249 control standards established by the Information Services Division.
147250 An enforcement team consisting of the Ch ief Information Officer of
148251 the Information Services Division or a designee, a representative of
149252 the Oklahoma Office of Homeland Security , and a representative of
150253 the Oklahoma State Bureau of Investigation shall enforce the minimum
151254 information security and internal control standards. If the
152255 enforcement team determin es that an agency is not in compliance with
153256 the minimum information securit y and internal control standards, the
154257 Chief Information Officer shall take immedia te action to mitigate
155258 the noncompliance, including the removal of t he agency from the
156259 infrastructure of the state until the agency becomes compliant,
157260 taking control of the in formation technology function of the agency
158261 until the agency is compliant, and tra nsferring the administration
159262 and management of the information tech nology function of the agency
160263 to the Information Services Division or another state agency.

162264 B. No agency of the executive branch of the state shall use
163265 state funds for or enter into any ag reement for the acquisition of
164266 any category of computer hardware, s oftware or any contract for
165267 information technology or telecommunication services and equipment,
166268 service costs, maintenance costs, or any other costs or fees

168297 without written authorization of the Chief Information Officer or a

171299 1. A purchase less than or equal to Five Tho usand Dollars
172300 ($5,000.00) if such product is purchased using a state purchase card
173301 and the product is listed on either t he Approved Hardware or
174302 Approved Software list located on the Office of Management and

177304 2. A purchase over Five Thousand Dollars ($5,000.00) and less
178305 than or equal to Twenty -five Thousand Dollars ($25,000.00) if such

181306 product is purchased using a state p urchase card, the product is
182307 listed on an information technology or telecommunications statewide
183308 contract, and the product is listed on either the Approved Hardware
184309 or Approved Software lis t located on the Office of Management and

188312 related to software development, softwar e modifications, or any
189313 other services related to the operation and maintenance of comput er
190314 hardware and software or both independently that is made by the
191315 Military Department of the State of Oklahoma.

193316 If written authorization is n ot obtained prior to incur ring an
194317 expenditure or entering into any agreement as required in this
195318 subsection or as required in Section 35.4 of th is title, the Office
196319 of Management and Enterprise Services may not process any claim

197347 associated with the expendi ture and the provisions of any agreement
198348 shall not be enforceable. The provisions of this subsection shall
199349 not be applicable to any member of T he Oklahoma State System of
200350 Higher Education, any public e lementary or secondary schools of the
201351 state, any technology center school distri ct as defined in Section
202352 14-108 of Title 70 of the Oklahoma Statutes, or CompSource Oklahoma
203353 Mutual Insurance Company .

205354 C. The Chief Information Officer and Information Service s
206355 Division of the Office of Management and Enterprise Services and all
207356 agencies of the executive branch o f the state shall not be required
208357 to disclose, directly or indi rectly, any information of a s tate
209358 agency which is decla red to be confidential or privil eged by state
210359 or federal statute or the disclosure of which is restricted by
211360 agreement with the United St ates or one of its agencies, nor
212361 disclose information technolog y system details that may perm it the
213362 access to confidential information or any informati on affecting
214363 personal security, personal identity, or physical security of stat e
215364 assets.
