23	51		provisions; requiring that certain electronic
24	52		documents be presumed valid; requiring the Oklahoma
25	53		Tax Commission to implement a program for electronic
26	54		certificates of title and asso ciated liens; updating
27	55		statutory language; providing for codification;
28	56		providing an effective date; and declaring an

39	63		BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:

41	64		SECTION 1. AMENDATORY 47 O.S. 2021, Section 1105A, is
42	65		amended to read as follows:

44	66		Section 1105A. A. On or before July 1, 2022, the Oklahoma Tax
45	67		Commission shall implement a program which will permit the
46	68		electronic filing, storage, and delivery of motor ve hicle

50	97		release a lien on a motor vehicle in lieu of submission and
51	98		maintenance of paper documents as otherwise provided in the
52	99		provisions of Section 1101 et seq. of Title 47 of the Oklahoma
53	100		Statutes. The Tax Commission shal l enter into a competitive
54	101		contract with a qualified third-party service provider (System
55	102		Developer), subject to the provisions of the Oklahoma Central
56	103		Purchasing Act, Section 85.1 et s eq. of Title 74 of the Oklahoma
57	104		Statutes, to provide necessary hardware, software and services
58	105		facilitating the interconnection between motor license agents and
59	106		electronic title service providers described in subsection B o f this
60	107		section for a certificate of title and for filing or releasing a
61	108		lien pursuant to the procedures prescribed by the Oklahoma Tax
62	109		Commission. The provisions of this section shall apply to
63	110		applications for certificates of title issued and liens filed after
64	111		June 30, 2022. The Tax Commission shall promulgate rules to
65	112		implement the provisions of this section.

67	113		B. The program authorized under subsection A of this section
68	114		shall include, but not be limited to, procedures:
69		-
70	115		1. For the delivery of a certificate of t itle, on a paper
71	116		document or in an electronic format, to the s ecured party having the
72	117		primary perfected security interest in a vehicle in lieu of delivery
73	118		to the record owner, notwithstanding the provisions of Section 11 01
74	119		et seq. of Title 47 of the Oklaho ma Statutes. Provided, when
75	120		electronic transmission of liens and lien satisfactions is used, a

76	148		certificate of title need not be issued or printed until the last
77	149		lien is satisfied and a clear certificate of title is issu ed to the
78	150		owner of the vehicle at th eir request;

80	151		2. Establishing qua lifications for third-party electronic title
81	152		service providers offering electronic lien services. The vendor
82	153		selected in subsection A of this section shall not be considered an
83	154		electronic title service provider and shall n ot operate or own an
84	155		electronic title service provider;

86	156		3. Establishing reasonable fees, if necessary, to be charged by
87	157		service providers or contractors for the establishment, maintenance
88	158		and operation of the electronic lien title program;

92	159		4. Providing access to the electronic certifica te of title
93	160		records including liens on record, for licensed motor vehicle
94	161		dealers and lienholders who participate in the program
95	162		notwithstanding the provisions of Section 1109 of Title 47 of the
96	163		Oklahoma Statutes;

98	164		5. Allowing motor license agents to parti cipate in the
99	165		electronic lien title program. Participating motor license agents
100	166		shall receive all fees provided by the Oklahoma Vehicle License and
101	167		Registration Act unless otherwise prov ided in Section 1132A of Title
102	168		47 of the Oklahoma Statutes; and

104	169		6. For the acceptance and use of electronic or digital
105	170		signatures.

107	198		C. As used in this section and Section 1101 et seq. of Title 47
108	199		of the Oklahoma Statutes:

110	200		1. “Deliver” or “delivery” means, with respect to a certificate
111	201		of title or lien, either the physical delivery of a paper document
112	202		or the electronic delivery of a document in an electronic format;
113		-
114	203		2. “Electronic format” means an electronic or digital format or
115	204		medium of any document, re cord or other information; and
116		-
117	205		3. “Possess” or “possession” means, with respect to a
118	206		certificate of title or lien, to hold or otherwise exercise control
119	207		over a document which is in either a physical or electronic format.

121	208		D. Any documents created, stored , or delivered under the
122	209		electronic lien title program as provided in this section shall be
123	210		considered presumed valid including any signatures which are
124	211		generated electronically or contained on a scanned copy. A
125	212		certified copy of the Oklahoma Ta x Commission’s electronic record of
126	213		a motor vehicle certificate of title or lien is admissible in any
127	214		civil, criminal, or administrative proceeding in this state as
128	215		evidence of the existence and contents of the certificate of title
129	216		or lien.

131	217		E. The Tax Commission is authorized to expend funds necessary
132	218		for the implementation of the pr ogram provided in subsection A of
133	219		this section from available monies in the Oklahoma Tax Commission

140	250		F. In the development of the prog ram provided in subsection A
141	251		of this section, the Oklahoma Tax Commission shall consult
142	252		interested parties including, but not limited to, represent atives of
143	253		the Oklahoma Automobile Dealers Association, the Oklahoma Bankers
144	254		Association, the Oklahoma Credit Union Association of Oklahoma, and
145	255		the Oklahoma Tag Agent Coalition.

147	256		SECTION 2. NEW LAW A new section of law to be codified
148	257		in the Oklahoma Statutes as Section 4003A of Title 63, unless there
149	258		is created a duplication in numbering, reads as follows:

151	259		On or before July 1, 2022, the Oklahoma Tax Commission shall
152	260		implement a program which will permit the electronic filing,
153	261		storage, and delivery of boat and motor certifi cates of title and
154	262		allow a lienholder to perf ect, assign, and release a lien on a boat
155	263		or motor in lieu of submission and maintenance of paper documents as
156	264		otherwise provided in the provisions of Section 4008 et seq. of
157	265		Title 63 of the Oklahoma Statutes. The provisions of this section
158	266		shall apply to certificates of title issued an d liens filed after
159	267		June 30, 2022. The Tax Commission shall promulgate rules to
160	268		implement the provisions of this section.

162	269		SECTION 3. This act shall become effectiv e July 1, 2022.

164	270		SECTION 4. It being immediately necessary for the preservation
165	271		of the public peace, health or safety, an emergency is hereby
