3963 BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:

4164 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1105A, is
4265 amended to read as follows:

4466 Section 1105A. A. On or before July 1, 2022, the Oklahoma Tax
4567 Commission shall implement a program which will permit the

5097 release a lien on a motor vehicle in lieu of submission and
5198 maintenance of paper documents as otherwise provided in the
5299 provisions of Section 1101 et seq. of Title 47 of the Oklahoma
53100 Statutes. The Tax Commission shal l enter into a competitive
54101 contract with a qualified third-party service provider (System
55102 Developer), subject to the provisions of the Oklahoma Central
56103 Purchasing Act, Section 85.1 et s eq. of Title 74 of the Oklahoma
57104 Statutes, to provide necessary hardware, software and services
58105 facilitating the interconnection between motor license agents and
59106 electronic title service providers described in subsection B o f this
60107 section for a certificate of title and for filing or releasing a
61108 lien pursuant to the procedures prescribed by the Oklahoma Tax
62109 Commission. The provisions of this section shall apply to
63110 applications for certificates of title issued and liens filed after
64111 June 30, 2022. The Tax Commission shall promulgate rules to
65112 implement the provisions of this section.

67113 B. The program authorized under subsection A of this section
68114 shall include, but not be limited to, procedures:

70115 1. For the delivery of a certificate of t itle, on a paper
71116 document or in an electronic format, to the s ecured party having the
72117 primary perfected security interest in a vehicle in lieu of delivery
73118 to the record owner, notwithstanding the provisions of Section 11 01
74119 et seq. of Title 47 of the Oklaho ma Statutes. Provided, when
75120 electronic transmission of liens and lien satisfactions is used, a

76148 certificate of title need not be issued or printed until the last
77149 lien is satisfied and a clear certificate of title is issu ed to the
78150 owner of the vehicle at th eir request;

80151 2. Establishing qua lifications for third-party electronic title
81152 service providers offering electronic lien services. The vendor
82153 selected in subsection A of this section shall not be considered an
83154 electronic title service provider and shall n ot operate or own an
84155 electronic title service provider;

86156 3. Establishing reasonable fees, if necessary, to be charged by
87157 service providers or contractors for the establishment, maintenance
88158 and operation of the electronic lien title program;

92159 4. Providing access to the electronic certifica te of title
93160 records including liens on record, for licensed motor vehicle
94161 dealers and lienholders who participate in the program
95162 notwithstanding the provisions of Section 1109 of Title 47 of the

98164 5. Allowing motor license agents to parti cipate in the
99165 electronic lien title program. Participating motor license agents
100166 shall receive all fees provided by the Oklahoma Vehicle License and
101167 Registration Act unless otherwise prov ided in Section 1132A of Title
102168 47 of the Oklahoma Statutes; and

107198 C. As used in this section and Section 1101 et seq. of Title 47
108199 of the Oklahoma Statutes:

110200 1. “Deliver” or “delivery” means, with respect to a certificate
111201 of title or lien, either the physical delivery of a paper document
112202 or the electronic delivery of a document in an electronic format;

114203 2. “Electronic format” means an electronic or digital format or
115204 medium of any document, re cord or other information; and
116-
117205 3. “Possess” or “possession” means, with respect to a
118206 certificate of title or lien, to hold or otherwise exercise control
119207 over a document which is in either a physical or electronic format.

121208 D. Any documents created, stored , or delivered under the
122209 electronic lien title program as provided in this section shall be
123210 considered presumed valid including any signatures which are
124211 generated electronically or contained on a scanned copy. A
125212 certified copy of the Oklahoma Ta x Commission’s electronic record of
126213 a motor vehicle certificate of title or lien is admissible in any
127214 civil, criminal, or administrative proceeding in this state as
128215 evidence of the existence and contents of the certificate of title
129216 or lien.

131217 E. The Tax Commission is authorized to expend funds necessary
132218 for the implementation of the pr ogram provided in subsection A of
133219 this section from available monies in the Oklahoma Tax Commission

140250 F. In the development of the prog ram provided in subsection A
141251 of this section, the Oklahoma Tax Commission shall consult
142252 interested parties including, but not limited to, represent atives of
143253 the Oklahoma Automobile Dealers Association, the Oklahoma Bankers
144254 Association, the Oklahoma Credit Union Association of Oklahoma, and
145255 the Oklahoma Tag Agent Coalition.

147256 SECTION 2. NEW LAW A new section of law to be codified
148257 in the Oklahoma Statutes as Section 4003A of Title 63, unless there
149258 is created a duplication in numbering, reads as follows:

151259 On or before July 1, 2022, the Oklahoma Tax Commission shall

153261 storage, and delivery of boat and motor certifi cates of title and
154262 allow a lienholder to perf ect, assign, and release a lien on a boat
155263 or motor in lieu of submission and maintenance of paper documents as
156264 otherwise provided in the provisions of Section 4008 et seq. of
157265 Title 63 of the Oklahoma Statutes. The provisions of this section
158266 shall apply to certificates of title issued an d liens filed after
159267 June 30, 2022. The Tax Commission shall promulgate rules to
160268 implement the provisions of this section.

162269 SECTION 3. This act shall become effectiv e July 1, 2022.

164270 SECTION 4. It being immediately necessary for the preservation
165271 of the public peace, health or safety, an emergency is hereby
