AS INTRODUCED 
 
An Act relating to the state Medicaid program; 
requiring Department of Human Servi ces to report 
certain information relating to home- and community-
based services; providing for codification; providing 
an effective date; and declaring an emergency . 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA: 
SECTION 1.    NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 1020.1 of Title 56, unless there 
is created a duplication in numbering, reads as follows: 
A.  The Department of Human Services shall, by January 1 of each 
year, report the following information on the Department’s Internet 
website and to the President Pro Tempore of the Senate and the 
Speaker of the House of Representatives: 
1.  Payments made to providers in the prior fiscal year for 
home- and community-based services for people with intellectual 
disabilities including the amount of incentive p ayments made to 
providers and metrics used for incentive payments; and

2.  A strategic plan for serving more individuals with 
intellectual disabilities through home- and community-based services 
including goals and progress tow ard achieving such goals. 
B.  The Department shall, by the fifth day of each month, 
publish on the Department ’s website the following information: 
1.  The number of individual s with intellectual disabilitie s 
currently receiving home- and community-based services; 
2.  Services provided to individuals with intellectual 
disabilities through home- and-community based services ; 
3.  The number of individuals with intellectual disabilitie s who 
stopped receiving services in the prior month including: 
a. the number of individuals removed from each home- and 
community-based services waiver for individuals with 
intellectual disabilitie s, 
b. the reasons for removal and number of individuals 
removed for each reason, and 
c. how many individuals were removed within one (1) year 
of beginning receipt of services, the reasons for 
removal, and the number of individuals removed for 
each reason; and 
4.  Total expenditures of home- and community-based services for 
individuals with intellectual disabilities by month and year to 
date, categorized by waiver. 
SECTION 2.  This act shall become effective July 1, 2022.

SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and after its passage and approval.
