116202 D. Except as otherwise provided by this section, no licensed
117203 managed feeding operation which applies for a new or expanding
118204 concentrated swine feeding operat ion license shall be located wit hin
119205 three (3) miles of the outside boundary of any area or facility
120206 owned or operated as a camp or recreational site by a nonprofit
121207 organization established prior to application of the concentrated
122208 swine feeding operation.

124209 E. 1. In determining whether an y such area or facility is a
125210 camp or recreational site, the State Board of Agriculture shall
126211 consider:

128212 a. whether a reasonable person, a fter considering the
129213 totality of the circumstances, would deter mine that
130214 the area or facility is predominately used for camping
131215 or recreational purposes,
132-
133216 b. the type of permanent structures or fixtures of a
134217 recreational nature located on the land,

138218 c. the frequency with which the site is used for
139219 recreational purposes,

141220 d. the types of activiti es which are conducted or engage d

144249 e. any other factors the Board deems directly relevant to
145250 the question of whether a site is recreational in
146251 nature.

148252 2. The setbacks contained in subsections B, C and D shall ap ply
149253 only if the property was owned or leased by such orga nization prior
150254 to the construction or establ ishment of the swine feeding operation.
151-
152255 F. The setback requirements contained in subsection s A, B, C or
153256 D of this section shall not apply to any property owner who executes
154257 a written waiver with the owner or ope rator of the swine feeding
155258 operation, under such terms and conditions as are agreed to by the
156259 parties. The written waiver shall be effe ctive upon recording of
157260 the waiver in the office of the county clerk in the county in wh ich
158261 the property is located. Th e filed waiver shall preclude
159262 enforcement of the setback requirements of subsection A, B, C or D
160263 of this section with regard to property described in the waiver and
161264 owned by the person executing the waiver. A change in owne rship of
162265 the applicable property or change in ownership of the property on
163266 which the swine feeding operation is located shall not affect the
164267 validity of the waiver.

166268 G. No licensed managed feeding operation established after June
167269 10, 1998 which applies for a new or expanding license shal l be
168270 located:

170271 1. Within three (3) miles of any designated scenic river area
171272 as specified by the Scenic Rivers Act;

191312 operations shall be measured from the closest corner of the walls of
192313 the occupied residence to the closest point of the nearest waste
193314 facility, as determined by the Oklahoma Department of Agriculture,
194315 Food, and Forestry. The property boundary line of the real property
195316 is not used unless it coincides with the closest point of the waste
196317 facility or occupied residence.

198318 I. The provisions of this section shall not apply to any swine
199319 feeding operation which has been lic ensed by or which had submitted
200320 an application to the Department on or prior to March 9, 1998. In
201321 addition, the provisions of t his section shall not apply to any
202322 swine feeding operation with a capacity of 2000 swine animal units
203323 or less which was establis hed prior to June 1, 1998.

239402 consideration, adoption or amendment of the classification of waters
240403 of the state and standards of purity and quality thereof, and shall
241404 have the opportunity to present written comment to the me mbers of
242405 the Oklahoma Water Resources Board Department of Environmental
243406 Quality at the same time staff recommendations are submitted to
244407 those members for Board review and consideration.

246408 B. 1. In addition to the requirements of subsection A of this
247409 section, each state environmental agency shall have promulgated by
248410 July 1, 2001, a Water Quality Standards Implementation Plan for its
249411 jurisdictional areas of environmental responsibility in compliance
250412 with the Administrative Procedures Act and pursuant to the
251413 provisions of this section. Each agency shall review its plan at
252414 least every three (3) years thereafter to determine whether
253415 revisions to the plan are necessary.

255416 2. Upon the request of any state environmental agency, the
256417 Oklahoma Water Resources Board Department of Environmental Quality
257418 shall provide consulting assistance to such agency in developing a
258419 Water Quality Standards Implementati on Plan as required by this
259420 subsection.

261421 3. Each Water Quality Standards Implementation Plan shall:
262-
263422 a. describe, generally, the processes, procedures and
264423 methodologies the state environmental agency will
265424 utilize to ensure that programs within its

320518 C. 1. Each state environmental agency with groundwater
321519 protection authority pursuan t to Article III of the Oklahoma
322520 Environmental Quality Act shall be the groundwater protection agency
323521 for activities within its jurisdictional areas of environmental
324522 responsibility.

326523 2. The Department of Environmental Quality shall cooperate with
327524 other state environmental agencies, as appropriate and necess ary, in
328525 the protection of such unassigned activities.

330526 3. Groundwater regulatory agencies shall develop groundwater

335557 4. Each groundwater protection agency shall promulgate such
336558 rules, and issue such permits, policies, directives or any other
337559 appropriate requirements, as necessary, to implement the
338560 requirements of this subsection.

340561 5. Groundwater protection a gencies shall take such action as
341562 may be necessary to assure that activities within their respective
342563 jurisdictional areas of environmental responsibility protect
343564 groundwater quality to support the uses of the state's water
344565 quality.

346566 6. In addition, each gr oundwater protection agency with
347567 enforcement authority is hereby authorized to:
348-
349568 a. engage the voluntary cooperation of all persons in the
350569 maintenance and protection of groundwater, and to
351570 advise, consult and cooperate with all persons, all
352571 agencies of the state, universities and colleges, the
353572 federal government or other states, and with
354-

356573 interstate agencies in the furtherance of the purposes
357574 of this subsection, and to this end and for the
358575 purposes of studies, scientific or other
359576 investigations, research, exp eriments and
360577 demonstrations pertaining thereto, receive and spend

366609 maintain and protect groundwater by cooperative groups
367610 or associations of municipal corporations, industries,
368611 industrial users and other users of groundwaters of
369612 the state, who, jointly or severally, are or may be
370613 impacting on the maintenance and protection of
371614 groundwater,

373615 c. encourage, participate in or conduct or cause to be
374616 conducted studies, scientific or other investigations,
375617 research, experiments and demonstrations relating to
376618 the maintenance and protection of grou ndwater, and to
377619 collect data with respect thereto, a ll as may be
378620 deemed advisable and necessary to carry out the
379621 purposes of this subsection, and to make reports and
380622 recommendations with respect thereto,

382623 d. conduct groundwater sampling, data collection,
383624 analyses and evaluations with sufficient frequency to
384625 ascertain the characteristics and quality of
385626 groundwater and the sufficiency of the groundwater
386627 protection programs established pursuant to this
387628 subsection, and

391658 securing support for, the maintenance and protection
392659 of groundwater.

394660 D. Each state environmental agency and each state agency with
395661 limited environmental responsibilities shall participate in the
396662 information management system developed by the Depart ment of

399663 Environmental Quality, pursuant to Section 1-4-107 of this title,
400664 with such information as the Department shall reasonably request.

402665 E. In each even-numbered year, in cooperation with other state
403666 environmental agencies participating in the monitori ng of water
404667 resources, the Oklahoma Water Resources Board Department of
405668 Environmental Quality shall provide a report on the status of water
406669 quality monitoring to the Legislature for review.

408670 SECTION 4. AMENDATORY 27A O.S. 2021, Section 1-3-101, is
409671 amended to read as follows:

411672 Section 1-3-101. A. The provisions of this section specify the
412673 jurisdictional areas of responsibility for each state environmental
413674 agency and state agencies with limited environmental responsibility.
414675 The jurisdictional areas of environmental responsibil ity specified
415676 in this section shall be in addition to those otherwise provided by
416677 law and assigned to the specific state environmental agency;
417678 provided that any rule, interagency agreement or executive order
418679 enacted or entered into prior to the effective d ate of this section

424712 1, 1993, nor nullify any obligations or agreements with private
425713 persons or parties entered into with any state environmen tal agency
426714 before July 1, 1993.

428715 B. Department of Environmental Quality. The Department of
429716 Environmental Quality shall have the following jurisdictional areas
430717 of environmental responsibility:

432718 1. All point source discharges of pollutants and storm water t o
433719 waters of the state which originate from mu nicipal, industrial,
434720 commercial, mining, transportation and utilities, construction,
435721 trade, real estate and finance, services, public administration,
436722 manufacturing and other sources, facilities and activities, e xcept
437723 as provided in subsections D and E of t his section;
438-
439724 2. All nonpoint source discharges and pollution except as
440725 provided in subsections D, E and F of this section;

444726 3. Technical lead agency for point source, nonpoint source and
445727 storm water pollution c ontrol programs funded under Section 106 of
446728 the federal Clean Water Act, for areas within the Department's

462765 groundwater associated with underground or aboveground
463766 storage tanks regulated by the Corporation Commission,

465767 c. those wells used for the recovery, injection o r
466768 disposal of mineral brines as defined in the Oklah oma
467769 Brine Development Act regulated by the Co mmission, and
468-
469770 d. any aspect of any CO2 sequestration facility ,
470771 including any associated CO2 injection well, over
471772 which the Commission is given jurisdiction pur suant to
472773 the Oklahoma Carbon Capture and Geologic Se questration
473774 Act;
474-
475775 8. Notwithstanding any othe r provision in this section or other
476776 environmental jurisdiction statute, sole and exclusive jurisdiction
477777 for air quality under the federal Clean Air Act and ap plicable state
478778 law, except for indoor air quality an d asbestos as regulated for
479779 worker safety by the federal Occupational Safety and Health Act and
480780 by Chapter 11 of Title 40 of the Oklahoma Statutes;

11931928 to maintain and protect such classifications, and other stand ards or
11941929 policies pertaining to the quality of such waters.

12482028 subsection B of this secti on, conduct a public meeting within a
12492029 central location within the area to be affecte d. The Board
