8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9090 SECTION 1. AMENDATORY 70 O.S. 2021, Section 5-139, is
9191 amended to read as follows:
9292 Section 5-139. School districts shall make payroll deductions
9393 for either or both professional organization dues and politica l

146146 to the provisions of Section 2 of this act and shall transmit
147147 deducted funds to the organizatio n designated by the school district
148148 employee. Such deductions shall be on a ten -month basis unless
149149 otherwise designated by the employee organization but shall not
150150 exceed one (1) year without reauthorization. However, a school
151151 employee may request at any time in writing, including by email or
152152 fax, for the school district to immediately terminat e or initiate
153153 payroll deductions to a professional organization. Upon rec eipt of
154154 any written request, the school district shall within five (5)
155155 business days or by the next pay period, whichever is earlier,
156156 terminate or initiate any future payroll deducti ons of the
157157 requesting school employee to a professional organization. Upo n
158158 receipt of a written request, the school district shall notify the
159159 professional organization of the initiation or termination of
160160 payroll deductions within fifteen (15) business day s. If the
161161 request is to terminate a deduction, the school district shall not
162162 make any advance payments to any professional organization of any
163163 future dues on behalf of the school employee, and no further deb t
164164 from the school employee to the professional o rganization shall
165165 accrue. No school district policy or negotiated agreeme nt shall
166166 place any other conditions or requirements, including but not
167167 limited to personal hand delivery, upon any employee to initiat e or
168168 terminate any payroll deduction to a professional organization

221221 provided for in Section 2 of this act. Any school distric t policy
222222 or provision in a negotiated agreement that places additio nal
223223 conditions or requirements on initiation or termination be yond those
224224 outlined in this section or as provided for in Section 2 of this act
225225 shall be null and void. A school district which fails to terminate
226226 payroll deductions for an employee in accordance with this section
227227 shall immediately reimburse the employ ee the amount of all payroll
228228 deductions made by the school district after the employee’s request,
229229 and the amount due the employee shall double every th irty (30) days
230230 until paid in full.
231231 SECTION 2. NEW LAW A new section of law to be codified
232232 in the Oklahoma Statutes as Section 5-139a of Title 70, unless there
233233 is created a duplication in numbering, reads as follows:
234234 A. This section shall be known and may be cited as the “Teacher
235235 Paycheck Protection Act”.
236236 B. Authorization for professional org anization dues and
237237 political contributions as provided for in Section 5 -139 of Title 70
238238 of the Oklahoma Statutes shall be on a for m prescribed by the
239239 Secretary of Education and contain a statement in fourteen-point
240240 boldface font reading:
241241 “The State of Oklahoma wishes to make you aware that you have a
242242 First Amendment right, as recognized by the U.S. Supreme Court, to
243243 refrain from joining and paying d ues or making politica l
244244 contributions to a professional employee organization. Membership

296296 and payment of dues or political contributions are voluntary and you
297297 may not be discriminated against for your refusal to join or
298298 financially support a professional employee organization or your
299299 decision to join and pay such an organization . By signing this
300300 form, you are authorizing your employer to deduct dues and/or
301301 political contributions f rom your salary in the amounts specified in
302302 accordance with your professional employee organization’s bylaws.
303303 You may revoke this authorization at any time. ”
304304 C. Authorization containing an employee’s full name, position,
305305 professional organization, and signature shall be submitted to the
306306 school district. The school district sha ll confirm the
307307 authorization by emailing the employee ’s school district-provided
308308 email address and shall wait for confirmation of the authorization
309309 before starting any d eduction. If the employee does not possess a
310310 school district-provided email address, t he school district may use
311311 other means it deems appropriate to confirm the authorization.
312312 D. An authorization shall expire at the start of the first full
313313 pay period each school year unless it was authorized or reauthorized
314314 during the previous school year.
315315 E. The provisions of this section shall apply to any new
316316 collective bargaining agreement or contract entered into or any
317317 existing collective bargaining agreement or contract that is
318318 modified, extended, af fected by a new or changed memorandum of
319319 understanding, amendment, or is otherwise changed or altered in any

371371 way after the effective date of this act. The prov isions of this
372372 section shall not affect any collective bargaining agreement
373373 currently in effect, the terms of which shall remain valid until the
374374 adoption of a new collective bargaining agreement or a modification,
375375 extension, or alteration of an existing bargaining agreement occurs.
376376 SECTION 3. It being immediately necessa ry for the preservation
377377 of the public peace, health or safety, an emergency is hereby
378378 declared to exist, by reason whereof this resolution shall take
379379 effect and be in full force from and after its passage and approval.
