8585 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8686 SECTION 1. AMENDATORY 70 O.S. 2021, Section 21-102.1, is
8787 amended to read as follows:
8888 Section 21-102.1. The Oklahoma Board of Private Vocational
8989 Schools is authorized to:
9090 1. Appoint and fix the c ompensation of a director who:
9191 a. shall employ and fix the duties and compensation of

144144 necessary to effectuate the provisions of Section 21-
145145 101 et seq. of this title, and
146146 b. may execute contracts on behalf of the Board;
147147 2. Promulgate rules to include but not be limited to the
148148 implementation of minimum standards for the operation of private
149149 schools and the requirements for application of a school, seminar or
150150 workshop for a license of state authoriz ation;
151151 3. Approve or disapprove:
152152 a. applications for state authori zation,
153153 b. other applications for licensing including
154154 applications for sustained licenses,
155155 c. requests for exemption, and
156156 d. requests for a definition exception;
157157 4. Issue a private school license to document state
158158 authorization or other licensing upon de termination that such school
159159 meets the standards fixed by the Board;
160160 5. Prescribe, except as is otherwise provided by law and
161161 subject to the provisions of the Administrative Procedures Act , such
162162 penalties as it may deem proper for the enforcement of Section 21-
163163 101 et seq. of this title, not to exceed One Thousand Dollars
164164 ($1,000.00);
165165 6. Fix minimum standards through promulgation of rules for
166166 private schools, which shall include standards for:
167167 a. courses of instruction and training,

219219 b. qualifications of instructors,
220220 c. financial stability,
221221 d. advertising practices, and
222222 e. refund of tuition and fees paid by students for
223223 courses of instruction or training not completed ,
224224 f. student academic records or transcripts, which shall
225225 be maintained for a period not less than forty (40)
226226 years following a student's completion of education or
227227 other cessation of school enrollment, when the
228228 training did or could have led to an initial
229229 occupational certification, diploma , or degree, and
230230 g. student continuing education co mpletion or attendance
231231 certificates or the equivalent, which shall be
232232 maintained for a period not less than seven (7) years
233233 following the student's attendance at a continuing
234234 education seminar or workshop providing required
235235 continuing education training for the student to
236236 maintain a profession al license or occupational
237237 certification;
238238 7. Where possible, to regulate degrees offered by distance
239239 education, make use of the State Regents for Higher Education's
240240 interstate reciprocity agreements to create a more efficient and
241241 cost-effective means of the regulation of private schools;

293293 8. Make use of interstate reciprocity agreements that
294294 reasonably satisfy the Board's minimum standards to appro ve state
295295 authorization or other license application, i f such agreements
296296 become available for other programs t he Board approves for state
297297 authorization or other license;
298298 9. Require an entity to repay any fees charged to the Board by
299299 a financial institution or the State Treasurer for a returned check
300300 or other failed form of payment;
301301 10. Develop and present mandatory annual compliance training to
302302 emphasize standards relating to the operation of a school and
303303 relicensing processes, and require attendance by a representative of
304304 each school, seminar or workshop;
305305 11. Develop and present or arrange for the presentation of
306306 optional training for schools to emphasize continuing development of
307307 school personnel and processes and to address emerging issu es;
308308 12. Provide all licensing forms free of charge via one or more
309309 electronic means, but shall charge for the pick up or m ailing of a
310310 hard-copy licensing application packet to a person requesting
311311 information about private school licensing requirements;
312312 13. Certify an electronic record or the printing of an
313313 electronically stored record as an original, subject to approval by
314314 the Oklahoma Archives and Records Commission and when in accordance
315315 with the record retention and destruction policy of the Board;

367367 14. Conduct announced or unannounced site visits to an
368368 applicant or licensed school or seminar including joint visits with
369369 an accrediting organization or federal or state agency;
370370 15. Invoice a travel fee to conduct site visits to an
371371 applicant, school, seminar or workshop;
372372 16. Collect or require the submission of da ta, including but
373373 not limited to:
374374 a. admissions,
375375 b. certification scores or passage rates,
376376 c. complaints or grievances,
377377 d. enrollment,
378378 e. funding,
379379 f. graduation,
380380 g. job longevity or retention,
381381 h. job placement,
382382 i. data required to be reported to the U.S. Department of
383383 Education, any state or federal agency or an
384384 accrediting organization, and
385385 j. other data, as necessary, to carry on the mission or
386386 duties of the Board, or to assist in the state 's
387387 workforce development initiatives; and
388388 17. Carry out such other duties as ne cessary to provide state
389389 authorization for private vocational schools, seminars, and

441441 workshops and such other schools that make offerings of courses or
442442 programs as permitted by Section 21-101 et seq. of this title.
443443 SECTION 2. AMENDATORY 70 O .S. 2021, Section 21 -105.2, is
444444 amended to read as follows:
445445 Section 21-105.2. After A. To obtain an initial license, a
446446 school, seminar, or workshop either voluntarily decides to cease
447447 offering all programs of instruction or is required to do so through
448448 proper enforcement of this act or the Oklah oma Board of Private
449449 Vocational Schools' minimum standards, the entity shall, before
450450 closure is complete, provide the Board with its appropriate
451451 arrangement for the permanent retention of students ' records shall
452452 designate an appropriate official to begin a nd continue to maintain
453453 student academic records, transc ripts, or continuing education
454454 completion or attendance certificates or the e quivalent to be
455455 protected against damage or loss by fire, water , theft, tampering,
456456 or other means. Records shall be retain ed for the time periods
457457 specified in Section 21 -102.1 of this title in the following manner:
458458 1. Physical copies;
459459 2. Using documented electronic means to maintain records off -
460460 premises;
461461 3. By contracting with anoth er person or utilizing some other
462462 reasonable and effective means, as approved by the Oklahoma Boa rd of
463463 Private Vocational Schools, for record retention; or

515515 4. By establishing a certificate of depos it that is drawn on a
516516 state or federal bank, savings and l oan, or credit union that is
517517 located in Oklahoma and properly authorized to conduct busin ess in
518518 this state in an amount not less than Twenty Thousand Dollars
519519 ($20,000.00) in favor of, or properly collateralized to, the
520520 Oklahoma Board of Private Vocational Sc hools. The certificate of
521521 deposit shall be used by the Board after the school closes to have
522522 student academic records and transcripts retrieved, recovered, and
523523 digitized by a commercial third -party vendor to maintain the
524524 records. After digitization of ha rd copies from a closed school is
525525 performed and verified, the hard copy records may be destroye d by
526526 any means that ensures student privacy is protected by the
527527 commercial entity.
528528 B. As part of its license renewal application, a school,
529529 seminar, or workshop shall annually submit documentation that its
530530 student academic record retention plan including any applicable
531531 certificate of deposit, is current.
532532 SECTION 3. This act shall become effective July 1, 2022.
533533 SECTION 4. It being immediately necessary for the preservati on
534534 of the public peace, health or safety, an emergency is hereby
535535 declared to exist, by reason whereof thi s act shall take effect and
536536 be in full force from and after its passage and approval.
