85	85	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
86	86	SECTION 1. AMENDATORY 70 O.S. 2021, Section 21-102.1, is
87	87	amended to read as follows:
88	88	Section 21-102.1. The Oklahoma Board of Private Vocational
89	89	Schools is authorized to:
90	90	1. Appoint and fix the c ompensation of a director who:
91	91	a. shall employ and fix the duties and compensation of
92	92	such clerical or other assistants as are reasonably

144	144	necessary to effectuate the provisions of Section 21-
145	145	101 et seq. of this title, and
146	146	b. may execute contracts on behalf of the Board;
147	147	2. Promulgate rules to include but not be limited to the
148	148	implementation of minimum standards for the operation of private
149	149	schools and the requirements for application of a school, seminar or
150	150	workshop for a license of state authoriz ation;
151	151	3. Approve or disapprove:
152	152	a. applications for state authori zation,
153	153	b. other applications for licensing including
154	154	applications for sustained licenses,
155	155	c. requests for exemption, and
156	156	d. requests for a definition exception;
157	157	4. Issue a private school license to document state
158	158	authorization or other licensing upon de termination that such school
159	159	meets the standards fixed by the Board;
160	160	5. Prescribe, except as is otherwise provided by law and
161	161	subject to the provisions of the Administrative Procedures Act , such
162	162	penalties as it may deem proper for the enforcement of Section 21-
163	163	101 et seq. of this title, not to exceed One Thousand Dollars
164	164	($1,000.00);
165	165	6. Fix minimum standards through promulgation of rules for
166	166	private schools, which shall include standards for:
167	167	a. courses of instruction and training,

220	220	c. financial stability,
221	221	d. advertising practices, and
222	222	e. refund of tuition and fees paid by students for
223	223	courses of instruction or training not completed ,
224	224	f. student academic records or transcripts, which shall
225	225	be maintained for a period not less than forty (40)
226	226	years following a student's completion of education or
227	227	other cessation of school enrollment, when the
228	228	training did or could have led to an initial
229	229	occupational certification, diploma , or degree, and
230	230	g. student continuing education co mpletion or attendance
231	231	certificates or the equivalent, which shall be
232	232	maintained for a period not less than seven (7) years
233	233	following the student's attendance at a continuing
234	234	education seminar or workshop providing required
235	235	continuing education training for the student to
236	236	maintain a profession al license or occupational
237	237	certification;
238	238	7. Where possible, to regulate degrees offered by distance
239	239	education, make use of the State Regents for Higher Education's
240	240	interstate reciprocity agreements to create a more efficient and
241	241	cost-effective means of the regulation of private schools;

293	293	8. Make use of interstate reciprocity agreements that
294	294	reasonably satisfy the Board's minimum standards to appro ve state
295	295	authorization or other license application, i f such agreements
296	296	become available for other programs t he Board approves for state
297	297	authorization or other license;
298	298	9. Require an entity to repay any fees charged to the Board by
299	299	a financial institution or the State Treasurer for a returned check
300	300	or other failed form of payment;
301	301	10. Develop and present mandatory annual compliance training to
302	302	emphasize standards relating to the operation of a school and
303	303	relicensing processes, and require attendance by a representative of
304	304	each school, seminar or workshop;
305	305	11. Develop and present or arrange for the presentation of
306	306	optional training for schools to emphasize continuing development of
307	307	school personnel and processes and to address emerging issu es;
308	308	12. Provide all licensing forms free of charge via one or more
309	309	electronic means, but shall charge for the pick up or m ailing of a
310	310	hard-copy licensing application packet to a person requesting
311	311	information about private school licensing requirements;
312	312	13. Certify an electronic record or the printing of an
313	313	electronically stored record as an original, subject to approval by
314	314	the Oklahoma Archives and Records Commission and when in accordance
315	315	with the record retention and destruction policy of the Board;

368	368	applicant or licensed school or seminar including joint visits with
369	369	an accrediting organization or federal or state agency;
370	370	15. Invoice a travel fee to conduct site visits to an
371	371	applicant, school, seminar or workshop;
372	372	16. Collect or require the submission of da ta, including but
373	373	not limited to:
374	374	a. admissions,
375	375	b. certification scores or passage rates,
376	376	c. complaints or grievances,
377	377	d. enrollment,
378	378	e. funding,
379	379	f. graduation,
380	380	g. job longevity or retention,
381	381	h. job placement,
382	382	i. data required to be reported to the U.S. Department of
383	383	Education, any state or federal agency or an
384	384	accrediting organization, and
385	385	j. other data, as necessary, to carry on the mission or
386	386	duties of the Board, or to assist in the state 's
387	387	workforce development initiatives; and
388	388	17. Carry out such other duties as ne cessary to provide state
389	389	authorization for private vocational schools, seminars, and

442	442	programs as permitted by Section 21-101 et seq. of this title.
443	443	SECTION 2. AMENDATORY 70 O .S. 2021, Section 21 -105.2, is
444	444	amended to read as follows:
445	445	Section 21-105.2. After A. To obtain an initial license, a
446	446	school, seminar, or workshop either voluntarily decides to cease
447	447	offering all programs of instruction or is required to do so through
448	448	proper enforcement of this act or the Oklah oma Board of Private
449	449	Vocational Schools' minimum standards, the entity shall, before
450	450	closure is complete, provide the Board with its appropriate
451	451	arrangement for the permanent retention of students ' records shall
452	452	designate an appropriate official to begin a nd continue to maintain
453	453	student academic records, transc ripts, or continuing education
454	454	completion or attendance certificates or the e quivalent to be
455	455	protected against damage or loss by fire, water , theft, tampering,
456	456	or other means. Records shall be retain ed for the time periods
457	457	specified in Section 21 -102.1 of this title in the following manner:
458	458	1. Physical copies;
459	459	2. Using documented electronic means to maintain records off -
460	460	premises;
461	461	3. By contracting with anoth er person or utilizing some other
462	462	reasonable and effective means, as approved by the Oklahoma Boa rd of
463	463	Private Vocational Schools, for record retention; or

515	515	4. By establishing a certificate of depos it that is drawn on a
516	516	state or federal bank, savings and l oan, or credit union that is
517	517	located in Oklahoma and properly authorized to conduct busin ess in
518	518	this state in an amount not less than Twenty Thousand Dollars
519	519	($20,000.00) in favor of, or properly collateralized to, the
520	520	Oklahoma Board of Private Vocational Sc hools. The certificate of
521	521	deposit shall be used by the Board after the school closes to have
522	522	student academic records and transcripts retrieved, recovered, and
523	523	digitized by a commercial third -party vendor to maintain the
524	524	records. After digitization of ha rd copies from a closed school is
525	525	performed and verified, the hard copy records may be destroye d by
526	526	any means that ensures student privacy is protected by the
527	527	commercial entity.
528	528	B. As part of its license renewal application, a school,
529	529	seminar, or workshop shall annually submit documentation that its
530	530	student academic record retention plan including any applicable
531	531	certificate of deposit, is current.
532	532	SECTION 3. This act shall become effective July 1, 2022.
533	533	SECTION 4. It being immediately necessary for the preservati on
534	534	of the public peace, health or safety, an emergency is hereby
535	535	declared to exist, by reason whereof thi s act shall take effect and
536	536	be in full force from and after its passage and approval.
