64+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
65+SECTION 1. AMENDATORY 47 O.S. 2021, Section 1 -133.3, is
66+amended to read as follows:
67+Section 1-133.3 Motorized scooter.
68+A. A "motorized scooter" is any vehicle having:
69+1. Not more than three wheels in contact with the ground;

96+2. Handlebars and a foot sup port or seat for the use of the
97+operator; and
98+3. A power source that is capable of propelling th e vehicle at
99+a maximum design speed of not more than twenty-five (25) thirty-five
100+(35) miles per hour on leve l ground, and:
101+a. if the power source is a combustion e ngine, has a
102+piston or rotor displacement of thirty-five fifty
103+cubic centimeters (35 cu cm) (50 cc) or less
104+regardless of the number of chambers in th e power
105+source, or
106+b. if the power source is ele ctric, has a power output of
107+not more than one thousand (1,000) watts is programmed
108+by the manufacturer not to exceed thirty-five (35)
109+miles per hour on level ground.
110+Regardless of power source, local governments may set maximum speed
111+requirements by local ordinance.
112+B. For purposes of this sect ion, an electric personal assistive
113+mobility device, as d efined in Section 1-114A of this title,
114+bicycle, electric-assisted bicycle, or motorized bicycle, as defined
115+in Section 1-104 of this title, shall not be consi dered a motorized
116+scooter.
117+C. A motorized scooter shall not be required to be registered
118+under the laws of this state.

145+1. The operator of a motorized scooter shall be at least
146+fourteen (14) years of age unless an older age is required by local
147+ordinance.
148+2. The operator of a motorized scooter shall not be required to
149+possess a driver license or unless required by local ordin ance.
150+3. The operator of a motorized scooter sh all not be required to
151+comply with the vehicle insurance or financi al responsibility laws
152+of this state unless required by local ordin ance, and shall observe
153+all applicable traffic safety regulations when driving on a public
154+roadway as required by statute and local ordinances.
155+D. Municipalities shall have authority to regulate the usage of
156+motorized scooters on all public roadways, trails, sidewalks, and
157+other public spaces, and to determine appropriate locations for use .
158+SECTION 2. This act shall become effective November 1, 2022."
