7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 10 O.S. 2021, Section 404, is
8181 amended to read as follows:
8282 Section 404. A. 1. The Department Director of Human Services,
8383 in consultation with the Oklahoma Commission on Children and Youth,
8484 shall appoint advisory committees of repre sentatives of licensed
8585 child care facilities , representatives of associations relating to
8686 child care, and others to recommend minimum requirements and
8787 desirable standards for promulgation by the Department Director, to
8888 provide advice, recommendations, and guidance regarding concerns
8989 brought by child care facilities, and to assist facilities in

141141 meeting minimum requirements . A majority of any committee appointed
142142 to recommend requirements and standards shall be representatives of
143143 the type of licensed chil d care programs that are the subject of the
144144 requirements and standards.
145145 2. Committee members shall be appointed for a three-year term,
146146 with a two-consecutive-term limit. The committees shall include
147147 representation for all categories of facilities licensed by the
148148 Department and shall be comprised as follows:
149149 a. the Residential Children 's Services subcommittee shall
150150 include at a minimum:
151151 (1) a representative of a state wide organization
152152 representing children in care arrangements
153153 outside their own home,
154154 (2) a representative of a statewide organization
155155 providing residential services to youth in state
156156 custody,
157157 (3) a recipient or former recipient of youth services
158158 for children in state custody,
159159 (4) a representative of a statewide organizatio n
160160 promoting adoption servi ces,
161161 (5) a parent or guardian providing foster car e to a
162162 child or children in state custody,

439439 and other members as determined by the Department of
440440 Human Services and the Commis sion on Children and
441441 Youth
442442 terms as provided by b ylaws of the advisory committees.
443443 3. The Department shall create a Child Care Facility Peer
444444 Review Board whose p urpose shall be to participate in the
445445 Department's grievance process. A majority of the Board shall be
446446 representatives of child care facilities . The Department Director
447447 shall promulgate rules specifying the duties of the Child Care
448448 Facility Peer Review B oard in the grievance process.
449449 4. The advisory committee Director shall designate two people
450450 advisory committee m embers to serve on the Departm ent's Stars
451451 Administrative Review Panel. At least one designee shall be the
452452 owner or operator of a licensed chi ld care center.
453453 5. The following stand ing advisory committees shall be created
454454 for the purpose of expanding the opportu nity for child care prog ram
455455 operators to identify quality imp rovement resources, express
456456 concerns facing the child care industry, and re commend issues for
457457 consideration by the D irector:
458458 a. an advisory committee for family child care homes,
459459 b. an advisory committee for child care centers, day
460460 camps, drop-in programs, after-school programs, summer
461461 programs, part-day programs, programs for si ck

514514 duration programs,
515515 c. an advisory committee for residential programs and
516516 child placing agencies, and
517517 d. an advisory committee whose focus is the Quality
518518 Rating and Improvement System (QRIS).
519519 B. Child care facilities shall not allow children to be left
520520 alone in the care of any person under eighteen (18) years of age
521521 without supervision or si xteen (16) years of age with supervision as
522522 delineated by the Department's rules promulgated by the Director .
523523 Child care centers and family child care homes shall not:
524524 1. Use soft or loose bedding, including, bu t not limited to,
525525 blankets, in sleeping equipment or in sleeping areas used only for
526526 infants;
527527 2. Allow toys or educational devices in sleeping equipment or
528528 in a sleeping area used only for infants; or
529529 3. Place a child in sleeping equipment or in a sleepi ng area
530530 which has not been previously approved for use as such by the
531531 Department.
532532 Nothing in this act shall be construed as removing, reducing, or
533533 otherwise changing any rules, standards, or other requirements
534534 relating to safe sleep or child safety .
535535 C. The Department Director shall promulgate rules estab lishing
536536 minimum requirements and desirable standards as may be deemed

588588 necessary or advisable to carry out the pr ovisions of the Oklahoma
589589 Child Care Facilities Licensing Act .
590590 D. Such rules shall not be promulgated until after consultation
591591 with the State Department of Health, the State Department of
592592 Education, the Oklahoma State Bureau of Investigation, the State
593593 Fire Marshal, the Commission on Children and Youth, the Oklahoma
594594 Department of Mental Hea lth and Substance Abuse Services and any
595595 other agency deemed necessary by the Department Director. Not less
596596 than sixty (60) days ' notice, by regular mail, shall be given to all
597597 current licensees before any changes are made in such rules.
598598 E. In order to improve t he standards of child care, the
599599 Department shall advise and cooperate with licensees, the governing
600600 bodies and staff of licensed child care facilities and assist the
601601 staff through advice of progressive methods and procedures, and
602602 suggestions for the improv ement of services.
603603 F. The Department may particip ate in federal programs for child
604604 care services, and enter into agreements or plans on behalf of the
605605 state for that purpose, in accordance with federal laws and
606606 regulations.
607607 SECTION 2. This act shall become effective November 1, 2022.
