8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9090 SECTION 1. AMENDATORY 47 O.S. 2021, Section 6-115, is
9191 amended to read as follows:
9292 Section 6-115. A. Except as otherwise provided in this
9393 section, every drive r license shall be issued for a peri od of either

146146 licensee is an alien, the license shall be issued for a period which
147147 does not exceed the lesser of:
148148 1. Four (4) years or eight (8) years; or
149149 2. The expiration date on the valid documentation author izing
150150 the presence of the applicant or licensee in the United States, as
151151 required by paragraph 9 of subsection A of Section 6-103 of this
152152 title.
153153 B. Except as otherwise provided in this section, the expiration
154154 date of an initial licens e shall be no more th an either four (4)
155155 years or eight (8) years from the last day of the month of iss uance
156156 or no more than either four (4) years or eight (8) years from the
157157 last day of the birth month of the applicant i mmediately preceding
158158 the date of issuance, if requested b y the applicant.
159159 C. Except as otherwise provided in this section, the expiratio n
160160 date of a renewal license shall be:
161161 1. For a renewal during the month of expiration, either four
162162 (4) years or eight (8) years from the last day of the m onth of
163163 expiration of the expiring license or either four (4) or eight (8)
164164 years from the last day o f the birth month of the licensee
165165 immediately preceding the expiration date of the expiring license,
166166 if requested by the licensee; or
167167 2. For a renewal prio r to the month of exp iration, as provided
168168 by rule of the Department, either four (4) or eight (8) years from
169169 the last day of the month of expiration of the current license;

221221 provided, no license shall be issued with an ex piration date of more
222222 than five (5) years from the date o f renewal on a four (4) year
223223 license or nine (9) years from the date of renewa l on an eight (8)
224224 year license.
225225 D. Notwithstanding the provisions of subsection E of Section
226226 1550.42 of Title 21 of the Oklahoma Statutes, any Oklahoma driv er
227227 license that is not more than one (1) year past the date of
228228 expiration provided on the driver l icense shall be presumed to be a
229229 valid form of identification for the purposes of renewing an
230230 Oklahoma driver license.
231231 E. Except as otherwise provided in thi s section, every driv er
232232 license shall be renewable by the licensee upon application to
233233 either the Department of Public Safety or a motor license agent,
234234 furnishing the current mailing address of the person and payment of
235235 the required fee, if the perso n is otherwise eligible for renewal.
236236 If the licensee is an alien, the licensee s hall appear before a
237237 driver license examiner of the Department and shall be issued a
238238 renewal driver license for a period which does not exceed th e lesser
239239 of:
240240 1. Four (4) years or eight (8) years; or
241241 2. The expiration date on the valid documentation authorizing
242242 the presence of the applicant or licensee in the Uni ted States, as
243243 required by paragraph 9 of subsection A of Section 6-103 of this

296296 F. All applicants for renewals of driver licenses who have
297297 proven collision records or apparent physical defects may be
298298 required to take an examination as specified by the Commissioner of
299299 Public Safety.
300300 G. When a person makes application for a driver li cense, or
301301 makes application to renew a driver license, and the pers on has been
302302 convicted of, or received a deferred judgment for, any offense
303303 required to register pursuan t to the Sex Offenders Registration Act,
304304 the driver license shall be valid for a perio d of one (1) year from
305305 the month of issuance, but may be renewed ye arly during the time the
306306 person is registered on the Sex Offen der Registry. Notwithstanding
307307 any other provision of law, the cost for such license shall be the
308308 same as for other driver lice nses and renewals.
309309 H. Upon an application for a driver license or a renewal of a
310310 driver license, proof of coverage under a motor vehicle liability
311311 policy as defined pursuant to Section 7-324 of this title shall be
312312 submitted with such application .
313313 H. I. The Department of Public Safety sha ll promulgate rules
314314 prescribing forms of identification acceptable fo r the renewal of an
315315 Oklahoma driver license.
316316 SECTION 2. AMENDATORY 47 O.S. 2021, Section 6-120, is

369369 Section 6-120. A. The Department of Public Safety is hereby
370370 authorized to cancel, deny, or disqualify the driver license,
371371 driving privilege or application of any indivi dual who:
372372 1. Fails to comply with any of the requirements of S ection 6-
373373 119 of this title within thirty (30) days after being notified by
374374 the Department;
375375 2. Is unable to demonstrate the ability to operate a motor
376376 vehicle as provided by this title or whose driving constitutes a
377377 danger to the welfare and safety of pers ons using the streets and
378378 highways of the State of Oklahoma this state; or
379379 3. Fails to pass an examination pursuant to Sections 6 -110, 6-
380380 115 or 6-119 of this title.
381381 B. If a person is required t o be examined pursuant to Sections
382382 6-110, 6-115 or 6-119 of this title, the Department shall impose the
383383 appropriate restriction or restrictions on the license that are
384384 necessary to ensure the safe operation of a motor vehicle as
385385 provided under Section 6 -113 of this title.
386386 C. If the motor vehicle liability policy, as defined pursuant
387387 to Section 7-324 of this title, used to obtain a driver license is
388388 canceled, the insurance company administering the p olicy shall
389389 notify the Department within ten (10) days of cancellat ion. Upon
390390 notice by an insurance c ompany to the Department, the person covered
391391 under the policy shall provide the Department wit h proof of
392392 applicable coverage within thirty (30) days of cancelation. Failure

444444 to provide proof of coverage within thirty (30) days shall result in
445445 the revocation of the person’s driver license. The Department shall
446446 promulgate rules to effectuate the pro visions of this subsecti on.
447447 C. D. Any person whose driver license or d riving privilege is
448448 canceled, denied, or disqualified under the pro visions of this
449449 section shall have the right to an appeal as provided in Section 6 -
450450 211 of this title.
451451 D. E. Any person whose Class A, B, or C driver license or
452452 driving privilege is disqual ified under the provisions of this
453453 section shall relinquish to the Department the Class A, B, or C
454454 driver license and may replace it with a Class D dri ver license, if
455455 the person is otherwise qualified for a Class D d river license.
456456 SECTION 3. AMENDATORY 47 O.S. 2021, Section 7-324, is
457457 amended to read as follows:
458458 Section 7-324. (a) A. Certification. A “motor vehicle
459459 liability policy” as the term is used in this a rticle shall mean an
460460 “owner’s policy” or an, “operator’s policy”, or “non-owner’s policy
461461 as defined pursuant to Section 7-613 of this title, of liability
462462 insurance, certified as provided in Section 7 -321 or Section 7-322
463463 of this title as proof of financial responsibility, and issued ,
464464 except as otherwise provided in Section 7-322 of this title, by an
465465 insurance carrier duly authorized to trans act business in this
466466 state, to or for the benefit of the person named therein as insured.

518518 (b) B. Owner’s policy. Such owner’s policy of liability
519519 insurance:
520520 1. Shall designate by expli cit description or by appropriate
521521 reference all vehicles with respect to which coverage is thereby to
522522 be granted; and
523523 2. Shall insure the person named therein and any other person
524524 except as herein provided, as insure d, using any such vehicle or
525525 vehicles with the express or implied permission of such named
526526 insured, against loss from the liability imposed by law for damages
527527 arising out of the ownership, maintenance or use of such vehicle or
528528 vehicles within the United St ates of America or the Dominion of
529529 Canada, subject to limi ts exclusive of interest and costs, with
530530 respect to each such vehicle, as follows: Twenty-five Thousand
531531 Dollars ($25,000.00) because of bodily injury to or death of on e
532532 person in any one accident a nd, subject to said limit for one
533533 person, Fifty Thousand Dollars ($50,000.00) because of bodily injury
534534 to or death of two or more persons in any one accident, and Twenty-
535535 five Thousand Dollars ($25,000.00) because of injury to or
536536 destruction of property of others in any one accident .; and
537537 3. May by agreement in a separate written endorsement between
538538 any named insured and the insurer exclude as insured any person or
539539 persons designated by name from coverage under the policy.
540540 (c) C. Operator’s policy. Such operat or’s policy of liability
541541 insurance shall insure the person named as insured therein against

593593 loss from the liability imposed upon him the person by law for
594594 damages arising out of the use by him the person of any motor
595595 vehicle not owned by him the person, within the same territorial
596596 limits and subject to the s ame limits of liability as are set forth
597597 above in subsection B of this section with respect to an owner ’s
598598 policy of liability insurance.
599599 D. Non-owner’s policy. A non-owner’s policy of liability
600600 insurance, as defined by section 4 of this act, shall insure the
601601 person named as insured therein against loss from the liability
602602 imposed upon the person by law for damages arising o ut of the use by
603603 the person of any motor vehicle not owned by the person, within the
604604 same territorial limits and subject to the same li mits of liability
605605 as are set forth in subsection B of this section with respect to an
606606 owner or operator’s policy of liability insurance.
607607 (d) E. Required statements in policies. Such motor vehicle
608608 liability policy shall state the name and address of the n amed
609609 insured, the coverage afforded by the po licy, the premium charged
610610 therefor, the policy period and the limits of liab ility, and shall
611611 contain an agreement or be en dorsed that insurance is provided
612612 thereunder in accordance with the coverage defined in t his chapter
613613 as respects bodily injury and dea th or property damage, or both, and
614614 is subject to all the provisions of this title.
615615 (e) F. Policy need not insure workmen’s workers' compensation.
616616 Such motor vehicle liability policy need not insure any liabil ity

668668 under any workmen’s workers' compensation law nor any liability on
669669 account of bodily injury to or death of an employee of the insured
670670 while engaged in the emplo yment, other than domest ic, of the
671671 insured, or while engaged in the operation, maintenance o r repair of
672672 any such vehicle nor any liability for damage to property owned by,
673673 rented to, in charge of or transported by the insured.
674674 (f) G. Provisions incorporated in policy. Every motor vehicle
675675 liability policy shall be subject to the following provis ions which
676676 need not be contained the rein:
677677 1. The liability of the insurance carrier with respect to the
678678 insurance required by this title s hall become absolute wheneve r
679679 injury or damage cover ed by said motor vehicle liability policy
680680 occurs; said policy may not be canceled or annulled as to s uch
681681 liability by any agreement between the insurance carrier and the
682682 insured after the occurrence of th e injury or damage; no state ment
683683 made by the insured or on his the insured's behalf and no violation
684684 of said the policy shall defeat or void said policy.
685685 2. The satisfaction by the insured of a jud gment for such
686686 injury or damage shall not be a condition precedent to the ri ght or
687687 duty of the insurance carrier to make payme nt on account of such
688688 injury or damage.
689689 3. The insurance carrier shall have the right to settle an y
690690 claim covered by the policy, and if such settlement is made in good
691691 faith, the amount thereof shall be de ductible from the limits of

743743 liability specified in paragraph 2 of subsection (b) B of this
744744 section.
745745 4. The policy, the written application therefor, if any, and
746746 any rider or endorse ment which does not conflict with the provisions
747747 of this title shall constit ute the entire contract between the
748748 parties.
749749 (g) H. Excess or additional coverage. Any policy w hich grants
750750 the coverage required for a motor vehi cle liability policy may also
751751 grant any lawful coverage in excess of or in addition to the
752752 coverage specified for a motor vehicle liability policy and such
753753 excess or additional coverage shall not be subject to the provisions
754754 of this title. With respect to a policy which grants such exces s or
755755 additional coverage, the term “motor vehicle liability policy ” shall
756756 apply only to that part of the co verage which is required by this
757757 section.
758758 (h) I. Reimbursement provision permitted. Any motor vehicle
759759 liability policy may provide that the insured shall reimburse the
760760 insurance carrier for any payment the insurance carrier would not
761761 have been obligated to make under the terms of the policy except for
762762 the provisions of this title.
763763 (i) J. Proration of insurance permit ted. Any motor vehicle
764764 liability policy may provide for the prorating of the insurance
765765 thereunder with other valid and collectible insurance.

817817 (j) K. Multiple policies. The requirements for a motor vehicl e
818818 liability policy may be fulfilled by the policie s of one or more
819819 insurance carriers which policies together meet such requirements.
820820 (k) L. Binders. Any binder issued pending the issuance of a
821821 motor vehicle liability policy shall be deemed to fulfill th e
822822 requirements for such a policy.
823823 SECTION 4. NEW LAW A new section of law to be codified
824824 in the Oklahoma Statutes as Section 7-613 of Title 47, unless there
825825 is created a duplication i n numbering, reads as follows:
826826 A. As used in this title, “non-owner’s policy” means a policy
827827 of motor vehicle liability insu rance for a person who does not own a
828828 vehicle that insures the person for damages arising out of the
829829 operation or use by the person of any motor vehicle , subject to the
830830 same limits of liability required in an o wner’s or operator’s
831831 policy.
832832 B. A non-owner’s policy of liability insurance shall be subject
833833 to the provisions of Section 7-324 of this title.
834834 C. Every carrier, upon issuing a non-owner’s policy, or a
835835 renewal thereof, shall issue to the insured person a written non-
836836 owner’s security verification for m of a size which may conveniently
837837 be carried upon the person, con taining the following minim um
838838 information:
839839 1. The name, address o f the carrier, and the five -digit
840840 National Association of Insurance Commissioners (NAIC) company co de;

892892 2. The name, address , and telephone number of the person or
893893 office where an inquiry ma y be made to verify the exi stence of
894894 security;
895895 3. The name of the named insured; provided, the address of the
896896 named insured shall not be included;
897897 4. A notice that in accordance with the C ompulsory Insurance
898898 Law, liability coverage has been issued for th e named insured;
899899 5. A statement reflecting the form may be carrie d in lieu of an
900900 owner’s form pursuant to the Com pulsory Insurance Law while
901901 operating a motor vehic le. The form shall be pr oduced upon request
902902 of any peace officer or representative of the Department of Public
903903 Safety. In case of an accident, the form sha ll be shown upon
904904 request of a person affected by an accident with a vehicle operated
905905 by the insured;
906906 6. The inclusive dates of liability coverage; and
907907 7. The policy number.
908908 D. A carrier may provide any additional i nformation consistent
909909 with the Compulsory Insurance Law of this state in non-owner’s
910910 security verification form but shall not be required to list the
911911 actual amounts of liability coverage thereon. The security
912912 verification form shall not constitute nor be construed as any part
913913 of an insurance policy or renewal.
914914 E. The Insurance Department m ay approve security verification
915915 forms in electronic format and paper format .

967967 F. On or after the effective date of this act, a person who
968968 applies for a driver license o r renewal thereof and who does not own
969969 a vehicle shall provide the motor license agen t proof of coverage
970970 under a non-owner’s policy as defined pursuant to subsection A of
971971 this section.
972972 G. A person covered by a non-owner’s policy shall carry proof
973973 of security at any time that the person is operating a motor
974974 vehicle. Proof of security of a non-owner’s policy shall be
975975 produced for inspection upon request by any law enforcement officer
976976 or representative of the Department of Public Safety , and in case of
977977 an accident, the proof shall be shown upon r equest of any person
978978 affected by the accident.
979979 SECTION 5. This act shall become ef fective November 1, 2022.
