6565 An Act relating to program evaluation; allowing

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 17-116 of Title 11, unless there
8080 is created a duplication in numbering, reads as follows:
8181 A. Any municipality that enters into an agreement or a contract
8282 with a third party for the assessment, evaluation, or audit of
8383 programs or services involving initiatives including but not limited
8484 to diversity, inclusion, antiracism, or social justice shall meet
8585 the following requirements:
8686 1. Municipalities shall be prohibited from utilizing informal
8787 agreements for assessment or evaluation;

139139 2. All contracts issued purs uant to this section must include
140140 provisions that require the contractor to prepare and deliver a
141141 public presentation of the contractor’s work product or analysis.
142142 The presentation shall be in compliance with the Oklahoma Open
143143 Meeting Act; and
144144 3. All contracts executed pursuant to this section shall
145145 include and require measurable objectives and benc hmarks to measure
146146 the effectiveness of the municipalities addressing stated
147147 initiatives.
148148 B. If a contractor hired by a municipality determines after
149149 conducting an independent assessment or evaluation that a
150150 municipality has created an environment that is not diverse,
151151 inclusive, or has failed to implement measures to address systemic
152152 racism, or has otherwise created a hostile environment, the
153153 municipality shall report the findings to the appropriate civil
154154 rights entity to ensure a full investigation is cond ucted and the
155155 municipality is brought into compliance .
156156 C. Any municipality that implements new policies, programs, or
157157 initiatives in response to an assessment or evaluation to address
158158 findings identified by a contractor shall be required to conduct a
159159 subsequent audit one (1) calenda r year after the completion date of
160160 the initial audit to determine the effectiven ess of the public
161161 entity’s response to the findings.

213213 D. A municipality may also e xecute contracts to receive
214214 training, professional development, or other services related but
215215 not limited to anti-discrimination, diversity, inclusion, or social
216216 justice.
217217 Municipalities shall be prohibited from using the same contract
218218 to procure both evaluation services and training.
219219 E. The work product of any contract between a contractor and
220220 municipality shall be made availa ble on the municipality’s website.
221221 The work product shall include but is not limited to reports,
222222 analysis, plans, and recommendations of the contr actor.
223223 F. Municipalities shall not implement new polices, programs, or
224224 initiatives until all relevant materials have been made available to
225225 the public for comment for at least thirty (30) days.
226226 G. Any plan, programs, initiatives, or proposals by
227227 municipalities to improve or address issues including but not
228228 limited to diversity, inclusion, ra cism, or social justice shall be
229229 posted publicly on the municipality’s website. Any training or
230230 professional development shall be pursuant to this section.
231231 H. At the conclusion of the municipality’s fiscal year, an
232232 evaluation of the implemented plan shall be conducted to assess the
233233 effectiveness of the municipality’s use of public funds t o address
234234 stated issues.

450450 agreements for assessment or evaluation;
451451 2. All contracts issued pursuant to this section must include
452452 provisions that the contractor shall deliver a public presentation
453453 of the contractor’s product or analysi s. The presentation shall be
454454 in compliance with the Oklahom a Open Meeting Act; and
455455 3. All contracts executed pursuant to this section shall
456456 include and require measurable objectives and benchmarks to measure
457457 the effectiveness of the agencies addressing stated initiatives.
