4538 An Act relating to utility vehicles; amending 47 O.S.
4639 2021, Section 11-1116, which relates to self -
4740 propelled or motor-driven and operated vehicles on
4841 streets, highways, and roadways within unincorporated
4942 areas; modifying statutory reference; prohibiting
5043 certain vehicles exceeding specific speed when
5144 operated on streets and highways; modi fying where
5245 certain vehicles may be operated; and providing an
5346 effective date.

5750 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5851 SECTION 1. AMENDATORY 47 O.S. 2021, Section 11 -1116, is
5952 amended to read as follows:
6053 Section 11-1116. A. The self-propelled or motor-driven and
6154 operated vehicles described in this section shall be prohibited from
6255 operating or shall be limited in operation on the streets and
6356 highways of this sta te.
6457 B. Self-propelled or motor-driven cycles, known and commonly
6558 referred to as "minibikes" and other similar trade names, shall be
59+prohibited from operating on the streets and highways of this state,
60+except:
61+1. When used in a parade; or

93-prohibited from operating on the streets and highways of this state,
94-except:
95-1. When used in a parade; or
9688 2. When registered, as required by s ubsection E of Section 1151
9789 of this title, and operated in this state b y food vendor services
9890 upon streets having a speed limit of thirty (30) miles per hour or
9991 less.
10092 All minibikes offered for sale in this state shall bear the
10193 following notice to the custo mer: "This machine is not manufactured
10294 or sold for operation on the pub lic streets or highways . Since it
10395 is not provided with equipment required by law for street or highway
10496 use, all persons are cautioned that any operation of thi s vehicle
10597 upon a public street or highway will be in violation of the motor
10698 vehicle laws of this state and will subject the violator to arrest."
10799 C. Golf carts and utility vehicles, as defined by Section 1102
108100 of this title, shall not be operated on the st reets and highways of
109101 this state except:
110102 1. Golf carts or utility vehicles owned by the Oklahoma Tourism
111103 and Recreation Department, and operated by employees or agents of
112104 the Department or employees of independent management companies
113105 working on behalf of the Department, may be op erated on the streets
114106 and highways of this state during daylight hours or under rules
115107 developed by the Oklahoma Tourism and Recreation Commission, when
116108 the streets and highways are located within the boundaries of a
109+state park. The Department shall have w arning signs placed at the
110+entrance and other locations at those state parks allowing golf
111+carts or utility vehicles to be operated on the streets and highways

144-state park. The Department shall have w arning signs placed at the
145-entrance and other locations at those state parks allowing golf
146-carts or utility vehicles to be operated on the streets and highways
147138 of this state located within the boundaries of those state parks .
148139 The warning signs shall state that golf carts and utility vehicles
149140 may be operating on streets and h ighways and that motor v ehicle
150141 operators shall take special precautions to be alert for the
151142 presence of golf carts or utility vehicles on the streets and
152143 highways;
153144 2. The municipal governing body has adopted an ordinance
154145 governing the operation of golf ca rts and/or utility vehic les on
155146 city streets; provided, such ordinances shall include necessary
156147 vehicle lighting and safety requirements;
157148 3. Golf carts or utility vehicles may operate o n state highways
158149 only if making a perpendicular crossing of a state hig hway located
159150 within the boundaries of a municipality which has adopted an
160151 ordinance governing the operation of golf carts and/or utility
161152 vehicles;
162153 4. The board of county commissioners of a county has approved
163154 the operation of golf cart and/or utility vehi cle traffic on
164155 roadways within the county, and:
165156 a. the roadway has a posted speed limit of twenty -five
166157 (25) miles per hour or less,
167158 b. the roadway is located in an unincorporated area, and
159+c. appropriate signage, cautioning motorists of the
160+possibility of golf cart or utility veh icle traffic,
161+is erected by the board of county commissioners ; or

195-c. appropriate signage, cautioning motorists of the
196-possibility of golf cart or utility veh icle traffic,
197-is erected by the board of county commissioners ; or
198188 5. Street-legal utility vehicles that are registered as a m otor
199189 vehicle pursuant to subsection B of Section 1 1-171.1 of this act
200190 title may be operated on the street s and highways of this s tate.
201191 Provided, however, when traveling on U.S. highways street-legal
202192 utility vehicles are restricted to those posted at fifty (5 0) miles
203193 per hour or less. Street-legal utility vehicles shall not be
204194 operated on the National System of I nterstate and Defense Highways
205195 or U.S. highways.
206196 D. All-terrain vehicles shall not be operated on the streets
207197 and highways of this state, except:
208198 1. On unpaved roads which are located within the boundaries of
209199 any property of the Forest Service of the Uni ted States Department
210200 of Agriculture;
211201 2. On highways if:
212202 a. the vehicle needs to make a direct crossing of the
213203 highway while the vehicle is traveling upon a
214204 regularly traveled trail and needs to continue travel
215205 from one area of the trail to another and, i f the
216206 vehicle comes to a complete stop, yields the right -of-
217207 way to all oncoming traffic that constitutes an
218208 immediate hazard, and crosses the highway at an angle
209+of approximately ninety (90) degrees to the direction
210+of the street or highway . This exception shall not
211+apply to divided highways or highways with a posted

246-of approximately ninety (90) degrees to the direction
247-of the street or highway . This exception shall not
248-apply to divided highways or highways with a posted
249238 speed limit of more than thirty -five (35) miles per
250239 hour in the area of the crossing,
251240 b. the vehicle needs to travel on a highway in order to
252241 cross a railroad track . In that event, the all -
253242 terrain vehicle may travel for not more than three
254243 hundred (300) feet on a highway to cross a railroad
255244 track,
256245 c. the operator of the all -terrain vehicle making the
257246 crossing at a highway has a valid driver license, and
258247 d. the operator of the vehicle makes a c rossing on a
259248 highway during daylight hours only;
260249 3. On streets and highways within a municipality if the
261250 municipal governing body has adopted an ordinance governing the
262251 operation of golf carts, utility vehicles or all -terrain vehicles on
263252 streets and highways within the municipality; or
264253 4. On roadways within unincorporated a reas of a county if those
265254 roadways are not part of the state highway system or the National
266255 System of Interstate and Defense Highways; provided, however, that
267256 the driver is a licensed d river.
268257 E. Mopeds, as defined by Section 1-133.2 of this title, may be
269258 operated on the streets and highways of this state if:
259+1. The municipal governing body has adopted an ordinance
260+governing the operation of mopeds on city streets; provided, such

297-1. The municipal governing body has adopted an ordinance
298-governing the operation of mopeds on city streets; provided, such
299287 ordinances shall include necessary vehicle lighting and safety
300288 requirements; or
301289 2. The board of county commissioners of a county has approved
302290 the operation of mopeds on roadways w ithin the county, not including
303291 roadways within a municipality.
304292 SECTION 2. This act shall become effective November 1, 2022.
