57 | 50 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

58 | 51 | | SECTION 1. AMENDATORY 47 O.S. 2021, Section 11 -1116, is |
---|
59 | 52 | | amended to read as follows: |
---|
60 | 53 | | Section 11-1116. A. The self-propelled or motor-driven and |
---|
61 | 54 | | operated vehicles described in this section shall be prohibited from |
---|
62 | 55 | | operating or shall be limited in operation on the streets and |
---|
63 | 56 | | highways of this sta te. |
---|
64 | 57 | | B. Self-propelled or motor-driven cycles, known and commonly |
---|
65 | 58 | | referred to as "minibikes" and other similar trade names, shall be |
---|
96 | 88 | | 2. When registered, as required by s ubsection E of Section 1151 |
---|
97 | 89 | | of this title, and operated in this state b y food vendor services |
---|
98 | 90 | | upon streets having a speed limit of thirty (30) miles per hour or |
---|
99 | 91 | | less. |

100 | 92 | | All minibikes offered for sale in this state shall bear the |

101 | 93 | | following notice to the custo mer: "This machine is not manufactured |
---|
102 | 94 | | or sold for operation on the pub lic streets or highways . Since it |
---|
103 | 95 | | is not provided with equipment required by law for street or highway |
---|
104 | 96 | | use, all persons are cautioned that any operation of thi s vehicle |
---|
105 | 97 | | upon a public street or highway will be in violation of the motor |
---|
106 | 98 | | vehicle laws of this state and will subject the violator to arrest." |
---|
107 | 99 | | C. Golf carts and utility vehicles, as defined by Section 1102 |
---|
108 | 100 | | of this title, shall not be operated on the st reets and highways of |
---|
109 | 101 | | this state except: |
---|
110 | 102 | | 1. Golf carts or utility vehicles owned by the Oklahoma Tourism |
---|
111 | 103 | | and Recreation Department, and operated by employees or agents of |
---|
112 | 104 | | the Department or employees of independent management companies |
---|
113 | 105 | | working on behalf of the Department, may be op erated on the streets |
---|
114 | 106 | | and highways of this state during daylight hours or under rules |
---|
115 | 107 | | developed by the Oklahoma Tourism and Recreation Commission, when |
---|
116 | 108 | | the streets and highways are located within the boundaries of a |
---|
147 | 138 | | of this state located within the boundaries of those state parks . |
---|
148 | 139 | | The warning signs shall state that golf carts and utility vehicles |
---|
149 | 140 | | may be operating on streets and h ighways and that motor v ehicle |
---|
150 | 141 | | operators shall take special precautions to be alert for the |
---|
151 | 142 | | presence of golf carts or utility vehicles on the streets and |
---|
152 | 143 | | highways; |
---|
153 | 144 | | 2. The municipal governing body has adopted an ordinance |
---|
154 | 145 | | governing the operation of golf ca rts and/or utility vehic les on |
---|
155 | 146 | | city streets; provided, such ordinances shall include necessary |
---|
156 | 147 | | vehicle lighting and safety requirements; |
---|
157 | 148 | | 3. Golf carts or utility vehicles may operate o n state highways |
---|
158 | 149 | | only if making a perpendicular crossing of a state hig hway located |
---|
159 | 150 | | within the boundaries of a municipality which has adopted an |
---|
160 | 151 | | ordinance governing the operation of golf carts and/or utility |
---|
161 | 152 | | vehicles; |
---|
162 | 153 | | 4. The board of county commissioners of a county has approved |
---|
163 | 154 | | the operation of golf cart and/or utility vehi cle traffic on |
---|
164 | 155 | | roadways within the county, and: |
---|
165 | 156 | | a. the roadway has a posted speed limit of twenty -five |
---|
166 | 157 | | (25) miles per hour or less, |
---|
167 | 158 | | b. the roadway is located in an unincorporated area, and |
---|
198 | 188 | | 5. Street-legal utility vehicles that are registered as a m otor |
---|
199 | 189 | | vehicle pursuant to subsection B of Section 1 1-171.1 of this act |
---|
200 | 190 | | title may be operated on the street s and highways of this s tate. |

201 | 191 | | Provided, however, when traveling on U.S. highways street-legal |
---|
202 | 192 | | utility vehicles are restricted to those posted at fifty (5 0) miles |
---|
203 | 193 | | per hour or less. Street-legal utility vehicles shall not be |
---|
204 | 194 | | operated on the National System of I nterstate and Defense Highways |
---|
205 | 195 | | or U.S. highways. |
---|
206 | 196 | | D. All-terrain vehicles shall not be operated on the streets |
---|
207 | 197 | | and highways of this state, except: |
---|
208 | 198 | | 1. On unpaved roads which are located within the boundaries of |
---|
209 | 199 | | any property of the Forest Service of the Uni ted States Department |
---|
210 | 200 | | of Agriculture; |
---|
211 | 201 | | 2. On highways if: |
---|
212 | 202 | | a. the vehicle needs to make a direct crossing of the |
---|
213 | 203 | | highway while the vehicle is traveling upon a |
---|
214 | 204 | | regularly traveled trail and needs to continue travel |
---|
215 | 205 | | from one area of the trail to another and, i f the |
---|
216 | 206 | | vehicle comes to a complete stop, yields the right -of- |
---|
217 | 207 | | way to all oncoming traffic that constitutes an |
---|
218 | 208 | | immediate hazard, and crosses the highway at an angle |
---|
249 | 238 | | speed limit of more than thirty -five (35) miles per |
---|
250 | 239 | | hour in the area of the crossing, |
---|
251 | 240 | | b. the vehicle needs to travel on a highway in order to |
---|
252 | 241 | | cross a railroad track . In that event, the all - |
---|
253 | 242 | | terrain vehicle may travel for not more than three |
---|
254 | 243 | | hundred (300) feet on a highway to cross a railroad |
---|
255 | 244 | | track, |
---|
256 | 245 | | c. the operator of the all -terrain vehicle making the |
---|
257 | 246 | | crossing at a highway has a valid driver license, and |
---|
258 | 247 | | d. the operator of the vehicle makes a c rossing on a |
---|
259 | 248 | | highway during daylight hours only; |
---|
260 | 249 | | 3. On streets and highways within a municipality if the |
---|
261 | 250 | | municipal governing body has adopted an ordinance governing the |
---|
262 | 251 | | operation of golf carts, utility vehicles or all -terrain vehicles on |
---|
263 | 252 | | streets and highways within the municipality; or |
---|
264 | 253 | | 4. On roadways within unincorporated a reas of a county if those |
---|
265 | 254 | | roadways are not part of the state highway system or the National |
---|
266 | 255 | | System of Interstate and Defense Highways; provided, however, that |
---|
267 | 256 | | the driver is a licensed d river. |
---|
268 | 257 | | E. Mopeds, as defined by Section 1-133.2 of this title, may be |

269 | 258 | | operated on the streets and highways of this state if: |
