6154 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
6255 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-740.17, is
6356 amended to read as follows:
6457 Section 1-740.17. A. The State Department of Health shall
6558 make:
6659 1. Make grants, from funds appropriated by the Legislature
6760 specifically for this purpose for the Choosing Child birth Act, to a
6861 grant-supervising entity for the purpose of reimbursing private
62+organizations in Oklahoma this state for the reasonable expenses of
63+programs providing the following services: listed in subsection B of
64+this section; or

96-organizations in Oklahoma this state for the reasonable expenses of
97-programs providing the following services: listed in subsection B of
98-this section; or
9991 2. With funds appropriated b y the Legislature for the Choosing
10092 Childbirth Act, enter into contracts directly with private
10193 organizations in this state for the purpose of providing the
10294 services listed in subsection B of this section.
10395 B. Services provided pursuant to the Choosing Childbirth Act
10496 shall include:
10597 1. Providing information on, referral to and a ssistance in
10698 securing the services of relevant existing programs or agencies that
10799 assist women in Oklahoma this state to carry their children to term,
108100 and/or providing services that as sist women to carry their children
109101 to term including, but not limited to, agencies and programs that
110102 will provide medical attention for the pregnant woman for the
111103 duration of her pregnancy, nutritional support serv ices, housing
112104 assistance, adoption service s, education and employment assistance
113105 and parenting education and support services ;
114106 2. Providing women in Oklahoma this state, in person and
115107 through community outreach, informa tion and/or services that
116108 encourage and assist them to carry their children to term; and
117109 3. Providing services including, but not limited to, healthcare
118110 services to mothers and infants for the purpose of reducing the
119111 rates of maternal mortality and infant mortality in this state by
112+three percent (3%) within five (5) years of the ef fective date of
113+this act not later than July 1, 2026; provided, however, no funds

147-three percent (3%) within five (5) years of the ef fective date of
148-this act not later than July 1, 2026; provided, however, no funds
149140 shall be provided to an organization that provides, or whose
150141 affiliates provide, abortion services.
151142 B. C. To be eligible for a service grant or a contract, an
152143 organization shall:
153144 1. Be registered with the Oklahoma Secretary of State as a not-
154145 for-profit corporation located in Oklahoma;
155146 2. Have If the Department utilizes a grant-supervising entity,
156147 have the grant amount approved by a grant-supervising entity;.
157148 3. For services described in paragraphs 1 and 2 of subsection A
158149 B of this section, provide each pregnant w oman counseled with
159150 accurate information on the developmental characteristics of unborn
160151 children including offering the pri nted information described in
161152 Section 1-738.3 of Title 63 of the Oklahoma Statutes;
162153 4. 3. Assure that the grant's sole purposes are any funds
163154 provided pursuant to the Choosing Childbirth Act are used only to
164155 assist and encourage women to carry their chil dren to term and to
165156 maximize their potenti als thereafter as provided in paragraphs 1 and
166157 2 of subsection B of thi s section or to reduce the rates of maternal
167158 mortality and infant mortality in this state as provided in
168159 paragraph 3 of subsection A B of this section; and
169160 5. 4. Assure that none of th e funds provided pursuant to the
170161 Choosing Childbirth Act, nor any other funds or services provided by
162+the organization, are used to encourage or counsel a woman to have

198-the organization, are used to encourage or counsel a woman to have
199189 an abortion not necessary to prevent her death , to provide her such
200190 an abortion or to refer her for such an abortion.
201191 SECTION 2. AMENDATORY 63 O.S. 2021, Section 1 -740.18, is
202192 amended to read as follows:
203193 Section 1-740.18. The State Department of Health shall make
204194 grants to a grant-supervising entity under the Choosi ng Childbirth
205195 Act from funds appropriated by the Legislature specifically for this
206196 purpose. The State Department of He alth
207197 A. If the State Department of Health utilizes a grant-
208198 supervising entity to implement the Choosing Childbirth Act, the
209199 Department shall annually monitor and review the grant-supervising
210200 entity to assure that the grant -supervising entity carefully adheres
211201 to the purposes and requirements of the Choosing Ch ildbirth Act, and
212202 it shall cease funding a grant-supervising entity that fa ils to do
213203 so if the Department proves specific findings of noncompliance,
214204 subject to judicial review.
215205 B. If the Department contracts directly with privat e
216206 organizations in this state to implement the Choosing Childbirth
217207 Act, the Department shall annually monito r and review the
218208 organizations to assure that the organizations carefully adhere to
219209 the purposes and requirements of the Choosing Childbirth Act, and it
220210 shall cease funding an organization that fails to do so if the
211+Department proves specific findings of n oncompliance, subject to
212+judicial review.

250239 SECTION 3. This act shall become effective July 1, 2022.
251240 SECTION 4. It being immediately necessary for the pre servation
252241 of the public peace, health or safety, an emergency is hereb y
253242 declared to exist, by reason whereof this act shall take eff ect and
254243 be in full force from and after its passage and a pproval.
