49	42		private organizations for provision of certain
50	43		services; amending 63 O.S. 2021, Section 1-740.18,
51	44		which relates to grant complian ce and monitoring;
52	45		requiring Department to monitor and review
53	46		organizations and directing termination of funding
54	47		under certain circumstances; updating statutory
55	48		language; providing an effectiv e date; and declaring
56	49		an emergency.

61	54		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
62	55		SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-740.17, is
63	56		amended to read as follows:
64	57		Section 1-740.17. A. The State Department of Health shall
65	58		make:
66	59		1. Make grants, from funds appropriated by the Legislature
67	60		specifically for this purpose for the Choosing Child birth Act, to a
68	61		grant-supervising entity for the purpose of reimbursing private
	62	+	organizations in Oklahoma this state for the reasonable expenses of
	63	+	programs providing the following services: listed in subsection B of
	64	+	this section; or

96		-	organizations in Oklahoma this state for the reasonable expenses of
97		-	programs providing the following services: listed in subsection B of
98		-	this section; or
99	91		2. With funds appropriated b y the Legislature for the Choosing
100	92		Childbirth Act, enter into contracts directly with private
101	93		organizations in this state for the purpose of providing the
102	94		services listed in subsection B of this section.
103	95		B. Services provided pursuant to the Choosing Childbirth Act
104	96		shall include:
105	97		1. Providing information on, referral to and a ssistance in
106	98		securing the services of relevant existing programs or agencies that
107	99		assist women in Oklahoma this state to carry their children to term,
108	100		and/or providing services that as sist women to carry their children
109	101		to term including, but not limited to, agencies and programs that
110	102		will provide medical attention for the pregnant woman for the
111	103		duration of her pregnancy, nutritional support serv ices, housing
112	104		assistance, adoption service s, education and employment assistance
113	105		and parenting education and support services ;
114	106		2. Providing women in Oklahoma this state, in person and
115	107		through community outreach, informa tion and/or services that
116	108		encourage and assist them to carry their children to term; and
117	109		3. Providing services including, but not limited to, healthcare
118	110		services to mothers and infants for the purpose of reducing the
119	111		rates of maternal mortality and infant mortality in this state by
	112	+	three percent (3%) within five (5) years of the ef fective date of
	113	+	this act not later than July 1, 2026; provided, however, no funds

147		-	three percent (3%) within five (5) years of the ef fective date of
148		-	this act not later than July 1, 2026; provided, however, no funds
149	140		shall be provided to an organization that provides, or whose
150	141		affiliates provide, abortion services.
151	142		B. C. To be eligible for a service grant or a contract, an
152	143		organization shall:
153	144		1. Be registered with the Oklahoma Secretary of State as a not-
154	145		for-profit corporation located in Oklahoma;
155	146		2. Have If the Department utilizes a grant-supervising entity,
156	147		have the grant amount approved by a grant-supervising entity;.
157	148		3. For services described in paragraphs 1 and 2 of subsection A
158	149		B of this section, provide each pregnant w oman counseled with
159	150		accurate information on the developmental characteristics of unborn
160	151		children including offering the pri nted information described in
161	152		Section 1-738.3 of Title 63 of the Oklahoma Statutes;
162	153		4. 3. Assure that the grant's sole purposes are any funds
163	154		provided pursuant to the Choosing Childbirth Act are used only to
164	155		assist and encourage women to carry their chil dren to term and to
165	156		maximize their potenti als thereafter as provided in paragraphs 1 and
166	157		2 of subsection B of thi s section or to reduce the rates of maternal
167	158		mortality and infant mortality in this state as provided in
168	159		paragraph 3 of subsection A B of this section; and
169	160		5. 4. Assure that none of th e funds provided pursuant to the
170	161		Choosing Childbirth Act, nor any other funds or services provided by
	162	+	the organization, are used to encourage or counsel a woman to have

199	189		an abortion not necessary to prevent her death , to provide her such
200	190		an abortion or to refer her for such an abortion.
201	191		SECTION 2. AMENDATORY 63 O.S. 2021, Section 1 -740.18, is
202	192		amended to read as follows:
203	193		Section 1-740.18. The State Department of Health shall make
204	194		grants to a grant-supervising entity under the Choosi ng Childbirth
205	195		Act from funds appropriated by the Legislature specifically for this
206	196		purpose. The State Department of He alth
207	197		A. If the State Department of Health utilizes a grant-
208	198		supervising entity to implement the Choosing Childbirth Act, the
209	199		Department shall annually monitor and review the grant-supervising
210	200		entity to assure that the grant -supervising entity carefully adheres
211	201		to the purposes and requirements of the Choosing Ch ildbirth Act, and
212	202		it shall cease funding a grant-supervising entity that fa ils to do
213	203		so if the Department proves specific findings of noncompliance,
214	204		subject to judicial review.
215	205		B. If the Department contracts directly with privat e
216	206		organizations in this state to implement the Choosing Childbirth
217	207		Act, the Department shall annually monito r and review the
218	208		organizations to assure that the organizations carefully adhere to
219	209		the purposes and requirements of the Choosing Childbirth Act, and it
220	210		shall cease funding an organization that fails to do so if the
	211	+	Department proves specific findings of n oncompliance, subject to
	212	+	judicial review.

250	239		SECTION 3. This act shall become effective July 1, 2022.
251	240		SECTION 4. It being immediately necessary for the pre servation
252	241		of the public peace, health or safety, an emergency is hereb y
253	242		declared to exist, by reason whereof this act shall take eff ect and
254	243		be in full force from and after its passage and a pproval.
