An Act relating to abortion; amending Section 18,
Chapter 308, O.S.L. 2021, which relates to contingent
effective date; modifying applicability of ce rtain
provisions; modifying conditions under which certain
provisions will become effective; repealing Sections
2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16,
and 17, Chapter 308, O.S.L. 2021, which relate to
abortion; and declaring an emergency.
SUBJECT: Abortion
BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:
SECTION 1. AMENDATORY Section 18, Chapter 308, O.S.L.
2021, is amended to read as foll ows:
Section 18. This act Section 1, Chapter 308, O.S.L. 2021 shall
only become effective on and after the certification of when the
Attorney General certifies that:
1. The United States Supreme Court overrules the central
holding of has overruled in whole or in part Roe v. Wade, 410 U.S.
113 (1973), reaffirmed by and Planned Parenthood of Southeastern
Pennsylvania v. Casey, 505 U.S. 833 (1992), thereby restoring to
such that the State of Oklahoma the authority to prohibit abortion
may enforce Section 861 of Title 21 of the Oklahoma Statute s or
enact a similar statute prohi biting abortion throughout pregnancy;
or

2. An amendment to the United States Con stitution is adopted
that restores to such that the State of Oklahoma the authority to
prohibit abortion may enforce Section 861 of Title 21 of the
Oklahoma Statutes or enac t a similar statute prohibiting abortion
throughout pregnancy.
SECTION 2. REPEALER Section s 2, 3, 4, 5, 6, 7, 8, 9, 10,
11, 12, 13, 14, 15, 16, and 17, Chapter 308, O.S.L. 2021, are hereby
repealed.
SECTION 3. It being immediately necessary for the preservation
of the public peace, health or safety, an emergency is hereby
declared to exist, by reason whereof this act shall take effect and
be in full force from and after its passage and approval.
