113105 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
114106 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1550.42, is
115107 amended to read as follows:
116108 Section 1550.42. A. The following entities may create, publish
117109 or otherwise manufacture an identification document, identificati on
118110 card, or identification certificate and may possess an engraved
119111 plate or other such device fo r the printing of such identification;
120112 provided, the name of the issuing entity shall be clearly printed
121113 upon the face of the identification:
122114 1. Businesses, companies, corporations, service organizations
123115 and federal, state and local governmental agencies for employee
124116 identification which is designed to identify the bearer as an
125117 employee;
126118 2. Businesses, companies, corporations and service
127119 organizations for custo mer identification which is designed to
128120 identify the bearer as a customer or member;
129121 3. Federal, state and local government agencies for purpos es
130122 authorized or required by law or any legitimate purpose cons istent

161154 4. Any public school or state or private educati onal
162155 institution, as defined by Sections 1 -106, 21-101 or 3102 of Title
163156 70 of the Oklahoma Statutes, to id entify the bearer as an
164157 administrator, faculty member, student or employee;
165158 5. Any professional organization or labor union to identify the
166159 bearer as a member of the professional organization or lab or union;
167160 and
168161 6. Businesses, companies or corporations w hich manufacture
169162 medical-alert identification for the wearer thereof.
170163 B. All identification documents as provided for in paragraph 3
171164 or 4 of subsection A of this section shall be issued only to Unit ed
172165 States citizens, nationals and legal permanent residen t aliens.
173166 C. The provisions of subsect ion B of this section shall not
174167 apply when an applicant presents, in person, valid documentary
175168 evidence of:
176169 1. A valid, unexpired immigrant or nonimmigrant vis a status for
177170 admission into the United States;
178171 2. A pending or approved application for asylum in the United
179172 States;
180173 3. Admission into the Uni ted States in refugee status;

210204 6. A pending application for adjustment of sta tus to legal
211205 permanent residence status or condi tional resident status.
212206 Upon approval, the applicant may be iss ued an identification
213207 document provided for in pa ragraph 3 or 4 of subsection A of this
214208 section. Such identification document shall be valid onl y during
215209 the period of time of the authorized st ay of the applicant in the
216210 United States or, if there is no def inite end to the period of
217211 authorized stay, a per iod of one (1) year. Any identification
218212 document issued pursuant to the provisions of this subs ection shall
219213 clearly indicate that it is tempora ry and shall state the date that
220214 the identification document ex pires. Such identification document
221215 may be renewed only upon presentation of valid documentary evidence
222216 that the status by which the applicant q ualified for the
223217 identification document has bee n extended by the United States
224218 Citizenship and Immigration Ser vices or other authorized agency of
225219 the United States Department of Homeland Security.
226220 D. The provisions of subsection B of this section shall n ot
227221 apply to an identification document described in paragraph 4 of
228222 subsection A of this section that is only va lid for use on the
229223 campus or facility of that edu cational institution and includes a

260255 an application has been made for renewal, duplication or reissuance
261256 shall be presumed to have been issued in accord ance with the
262257 provisions of subsection C of this section; provi ded that, at the
263258 time the application is made, th e driver license has not expired, or
264259 been cancelled, susp ended or revoked. The requirements of
265260 subsection C of this section shall apply, howeve r, to a renewal,
266261 duplication or reissuance if the Department of Public Safety is
267262 notified by a local, state or f ederal government agency of
268263 information in the possession of the agency indicating a reasonable
269264 suspicion that the individual seeking such renew al, duplication or
270265 reissuance is present in the United States i n violation of law. The
271266 provisions of this subse ction shall not apply to United States
272267 citizens, nationals or legal permanent resident aliens.
273-SECTION 2. AMENDATORY 26 O.S. 2021, Section 4 -109.3, is
274-amended to read as follows:
275-Section 4-109.3. A. When a qualified elector applies for
276-issuance or renewal of an Oklahoma driver license, or issuance of a
277-state identification card issued pursuant to Sect ion 6-105 of Title
278-47 of the Oklahoma Statutes, he or she shall be provided voter
279-registration services as required by the National Voter Registration

306-Act. Any applicant or licensee providing an individual tax
307-identification number to the Department of Pu blic Safety or a motor
308-license agent pursuant to Section 6 -106 of Title 47 of the Oklahoma
309-Statutes shall not be provided voter registration services. All
310-completed paper voter registration applications shall be t ransmitted
311-by the agency accepting the app lication at the close of business
312-each week to the State Election Board in preaddressed, postage
313-prepaid envelopes provided by the State Election Board. If a person
314-registers or declines to register to vote, the o ffice at which the
315-person submits the vote r registration application or the fact that
316-the person declined to register shall remain confident ial and will
317-be used only for voter registration purposes.
318-B. A change of address for an Oklahoma driver license or state
319-identification card submitted by a registered voter shall also serve
320-as a change of address for voter registration purposes if the ne w
321-address is within the same county where the voter is registered to
322-vote. If the new address is outside the county where the voter is
323-currently registered t o vote, the voter shall be sent a notice and
324-application with instructions for registering to vote at the new
325-address. A change of address for an Oklahoma driver license or
326-state identification card shall not be u sed to update a voter
327-registration address if the registrant states in writing that the
328-change of address is not for voter registration purp oses.

355-C. Motor license agents shall receive fifty cents ($0.50) per
356-valid paper voter registration application or a pplication for change
357-in voter registratio n taken by themselves and employees of the motor
358-license agent’s office taken at the agent ’s office, payable by the
359-State Election Board.
360-D. The Oklahoma Tax Commission shall notify the Secretary of
361-the State Election Board of motor license agent appointm ents. The
362-Oklahoma Department of Public Safety shall notify the Secretary of
363-the State Election B oard of motor license agents qualified to issue
364-driver licenses.
365-E. The Secretary of the State Election Board is au thorized to
366-develop with the Department of Public Safety a system to
367-electronically transmit voter registration applications from motor
368-license agencies to the State Election Board or county election
369-boards. Such system shall be consistent with the requir ements for
370-electronic submission of voter registration applications provided in
371-Section 4-109.4 of this title.
372-F. 1. At least quarterly, t he Department of Public Safety
373-shall transmit to the Secretary of the State Election Board
374-identifying information t hat shall include the name, date of birth,
375-residential address, and mailing address, of all applicants or
376-licensees who have provided an ind ividual tax identification number
377-pursuant to Section 6 -106 of Title 47 of the Oklahoma Statutes.

404-2. The Secretary of the State Election Board shall compare the
405-transmitted identifying information provided pursuant to paragraph 1
406-of this subsection with t he list of registered voters in each
407-county. The Secretary of the State Election Board shall notify the
408-secretary of any relevant county election board of an y matches based
409-on the identifying information provided by the Department of Public
410-Safety.
411-3. Upon receipt of notification from the Secretary of the State
412-Election Board pursuant to paragraph 2 of this subsection , the
413-secretary of the county election boa rd shall notify the proper
414-authority pursuant to Section 16 -123 of this title, to investigate
415-whether a violation related to voting crimes or voter registration
416-has occurred.
417-4. The Secretary of the State Election Board shall not retain
418-the information provided pursuant to paragraph 1 of this subsection
419-after the completion of his or her duties pursua nt to paragraph 2 of
420-this subsection except as may be necessary when assisting with an
421-investigation.
422-G. The Secretary of the State Election Board shall prom ulgate
423-rules and procedures to implement the requirements of this section.
424-SECTION 3. AMENDATORY 47 O.S. 2021, Section 6 -101, is

460305 B. 1. No person shall operate a Class A commercial motor
461306 vehicle unless the pe rson is eighteen (18) years of age or older and
462307 holds a valid Class A commer cial license, except as provided in
463308 paragraph 5 of this subsection and subsecti on F of this section.
464309 Any person holding a valid Class A commercial license shall be
465310 permitted to operate motor vehicles in Classes A, B, C and D, except
466311 as provided for in par agraph 4 of this subsection.
467312 2. No person shall operate a Class B commercial m otor vehicle
468313 unless the person is eighteen (18) years of age or older and holds a
469314 valid Class B commercial license, except as provided in paragraph 5
470315 of subsection F of this sec tion. Any person holding a valid Class B
471316 commercial license shall be permitted to operate motor vehicles in
472317 Classes B, C and D, except as provided for in paragraph 4 of this
473318 subsection.
474319 3. No person shall operate a Class C commercial motor vehicle
475320 unless the person is eighteen (18) years of age or older and holds a
476321 valid Class C commercial license, except as provided in subsection F

511357 licensed to operate a farm vehicle which is required to be placarded
512358 for hazardous materials pursuant to 49 C.F.R., Part 172, sub part F,

514360 5. A person at least seventeen (17) years of age who
515361 successfully completes all examinations required by law may be
516362 issued by the Department:
517363 a. a restricted Class A commercial license which shal l
518364 grant to the licensee the privilege to operate a Class
519365 A or Class B commercia l motor vehicle for harvest
520366 purposes or a Class D motor vehicle, or
521367 b. a restricted Class B commercia l license which shall
522368 grant to the licensee the privilege to operate a Class
523369 B commercial motor vehicle for harvest purposes or a
524370 Class D motor vehicle.
525371 6. No person shall operate a Class D motor vehicle unless the
526372 person is sixteen (16) years of age or o lder and holds a valid Class

559406 D. No person shall operate a motorcycle or motor -driven cycle
560407 without having a valid Class A, B, C or D license with a motorcycle
561408 endorsement. Except as otherwise provided by law, any new applicant
562409 for an original driver lic ense shall be required to successfully
563410 complete a written examination, vision e xamination and driving
564411 examination for a motorcycle as prescribed by the Department of
565412 Public Safety, and a certified state-approved motorcycle basic rider
566413 course approved by t he Department if the applicant is seventeen (17)
567414 years of age or younger to be eligible for a motorcycle endorsement
568415 thereon. The written examination and driving examination for a
569416 motorcycle shall be waived by the Department of Public Safety upon
570417 verification that the person has successfully completed a certified
571418 Motorcycle Safety Foundation rider course approved by the
572419 Department.
573420 E. Except as otherwise provided by law, any perso n who lawfully
574421 possesses a valid Oklahoma driver license which is eligible f or
575422 renewal shall be required to successfully complete a written
576423 examination, vision examination and driving examination for a
577424 motorcycle as prescribed by the Department, and a cer tified state-

609457 completed a certified Motorcycle Safety Foundation rider course
610458 approved by the Department.
611459 F. 1. Any person eighteen (18) years of age or older may apply
612460 for a restricted Class A, B or C commercial learner permit. The
613461 Department, after the applicant has passed all parts of the
614462 examination for a Class D license an d has successfully passed all
615463 parts of the examination for a Class A, B or C commercial license
616464 other than the driving examination, may issue to the applicant a
617465 commercial learner permit which shall entitle the person having
618466 immediate lawful possession of the commercial learner permit and a
619467 valid Oklahoma driver license or provisional driver license pursua nt
620468 to Section 6-212 of this title to operate a Class A, B or C
621469 commercial motor vehicle upon the public highways solely for the
622470 purpose of behind-the-wheel training in accordance with rules
623471 promulgated by the Department.
624472 2. This commercial learner permit shall be issued for a period
625473 as provided in Section 6-115 of this title of o ne hundred eighty
626474 (180) days, which may be renewed one time for an additional one
627475 hundred eighty (180) days; provided, such commercial learner permit

670519 license and who wishes t o apply for another class of commercial
671520 driver license shall be required to apply for a commercial learner

16581526 of this section, every applicant for a commercial driver license who
16591527 is subject to the requirements of 49 C.F.R., Par t 391, and is
16601528 applying for an original, renewal, or replacement license, and every
16611529 person who, upon or after May 8, 2012, is currently the holder of a
16621530 commercial driver license and is subject to the requirements of 49
16631531 C.F.R., Part 391, and who does not app ly for a renewal or
16641532 replacement license prior to January 30, 2014, shall submit to the
16651533 Department and maintain with the Department a curre nt approved
16661534 medical examination certif icate signed by a licensed physician
16671535 authorized to perform and approve medical e xamination
16681536 certifications. The Department shall adopt rules for maintain ing
16691537 medical examination certificates pursua nt to the requirements in 49

17151584 3. If the applicant has or is applying for a hazardous mate rial
17161585 endorsement, the applicant shall submit to a security t hreat
17171586 assessment performed by the Transportation Security Administration
17181587 of the Department of Homeland Security as required by and pursuant
17191588 to 49 C.F.R., Part 1572, which shall be used to determin e whether

17581628 emergency contact information shall be main tained by the Departme nt
17591629 and shall be used by the Department and law enforcement for
17601630 emergency purposes only. A person listed as an emergen cy contact
17611631 may request to be removed at any time. Any update to a change of
17621632 name, address, or phone number may be m ade by the applicant l isting
17631633 the emergency contact person or by the person listed as the
17641634 emergency contact.
17651635 E. Whenever application is rece ived from a person previously
17661636 licensed in another jurisdiction, the Depar tment shall request a
17671637 copy of the driving r ecord from the other j urisdiction and,
17681638 effective September 1 , 2005, from all other jurisdictions in which
17691639 the person was licensed within the immediately previous ten (10)

18111682 when issuing an iden tification card pursuant to the provisions of
18121683 this subsection. The Department s hall promulgate rules necessary to
18131684 implement and administer the provision s of this subsection.
18141685 H. A valid and unexp ired U.S. passport sha ll serve as both
18151686 primary and secondary proofs of identity whenever application for a
18161687 driver license or identification card is submitted to the

21021979 G. When a person makes application for a driver license, or
21031980 makes application to renew a driver license, and the person has been
21041981 convicted of, or received a deferred judgment for, any offense
21051982 required to register pursuant to the Sex Offenders Registration Act,
21061983 the driver license shall be valid for a period of one (1) year from
21071984 the month of issuance, but may be renewed yearly during the time the
21081985 person is registered on the Sex Offen der Registry. Notwithstanding
21091986 any other provision of law, the cost for such license shall be the
21101987 same as for other driver licenses and renewals.
21111988 H. The Department of Public Safety shall promulgate rules
21121989 prescribing forms of identification acceptable fo r the renewal of an
21131990 Oklahoma driver license.
