4851 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4952 SECTION 1. NEW LAW A new section of law to be codified
5053 in the Oklahoma Statutes as Section 1020.9D of Title 82, unless
5154 there is created a duplication in numb ering, reads as follows:
5255 1. Prior to approving a permit to use fresh groundwater for
5356 enhanced recovery of oil and gas, the Oklahoma Water Resources Board
5457 shall determine that the ap plicant has reviewed all other
5558 economically viable alternat ives for the use of fresh groundwater.
5659 2. Applicants filing a permit application to use fresh
5760 groundwater for enhanced r ecovery of oil and gas, in addition to all
5861 other requirements, shall furnish the following as part of and at
5962 the time of filing the application:
60-a. a copy of the easements or leases from the surface
61-right owners giving the appli cant the right to develop

9094 b. an estimated schedule of use showing the amount of
9195 fresh groundwater used each year in the recovery
9296 process,
9397 c. an economic study containing the following
9498 information:
9599 (1) a detailed analysis of the relativ e cost of
96100 obtaining salt water and any other feasible
97101 alternative versus the relative cost of obtaining
98102 fresh groundwater,
99103 (2) total project costs and the amount of oil and gas
100104 expected to be recovered and the value expec ted
101105 to be realized,
102106 (3) the estimated value of fresh groundwater for
103107 other purposes including, but not limited to,
104108 those that are common to the area or vicinity
105109 subject of the application as measured against
106110 the overall estimated value of the oil or gas to
107111 be recovered,
108112 (4) the additional expense per barrel of oil
109113 recovered if the applica nt is required to use or
110-treat salt water instead of fresh groundwater in
111-the recovery process, and

141+treat salt water instead of fresh groundwater in
142+the recovery process, and
138143 (5) an evaluation of other recovery methods
139144 considered and an explanation justifying the
140145 choice of using fresh groundwater for recovery as
141146 necessary or the most fea sible,
142147 d. an inventory of all wells, whether active or abandoned
143148 within the boundaries of the proposed unitization and
144149 within two (2) miles of the outside boundaries of the
145150 proposed unitization ,
146151 e. the permeability, thickness, and estimated porosity of
147152 the injection zone, and
148153 f. information about the reuse and recycling of the fresh
149154 groundwater.
150155 3. The applicant may also be required to furnish other relevant
151156 material upon request of the Board including, but not limited to,
152157 the following:
153158 a. a copy of the unitization pla n on file with the
154159 Corporation Commission,
155160 b. a copy of each injection well application and the
156161 approval of such application b y the Corporation
157162 Commission,
158163 c. a copy of all logs of each injection well showing the
159164 name of each zone containing salt water , and
160-d. the name and chemical composition of any material or
161-substance other than fresh groundwater proposed to be
