60	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
61	58		SECTION 1. AMENDATORY 47 O.S. 2021, Section 6 -101, is
62	59		amended to read as follows:
63	60		Section 6-101. A. No person, exce pt those hereinafter
64	61		expressly exempted in Section s 6-102 and 6-102.1 of this title,
65	62		shall operate any motor vehicle upon a highway in this state unless
66	63		the person has a valid Oklahoma driver license for the class of
	64	+	vehicle being operated under the provis ions of this title. No

97	95		B. 1. No person shall operate a Class A commercial motor
98	96		vehicle unless the person is eighteen (18) years of age or older and
99	97		holds a valid Class A commercial license, except as provided in
100	98		paragraph 5 of this subsection and subsection F of this section.
101	99		Any person holding a valid Class A commercial license shall be
102	100		permitted to operate m otor vehicles in Classes A, B, C and D, except
103	101		as provided for in paragraph 4 of this subsection.
104	102		2. No person shall operate a Class B commercial motor vehicle
105	103		unless the person is eighteen (18) years of age or older and holds a
106	104		valid Class B commercial l icense, except as provided in paragraph 5
107	105		of subsection F of this section. Any person holding a valid Class B
108	106		commercial license shall be permitted to operate motor vehicles in
109	107		Classes B, C and D, except as provided for in paragraph 4 of this
110	108		subsection.
111	109		3. No person shall operate a Class C commercial m otor vehicle
112	110		unless the person is eighteen (18) years of age or older and holds a
113	111		valid Class C commercial license, except as provided in subsection F
114	112		of this section. Any person holding a valid Class C co mmercial
115	113		license shall be permitted to operate mot or vehicles in Classes C
116	114		and D, except as provided for in paragraph 4 of this subsection.

143		-	4. No person under twenty -one (21) years of age shall be
144		-	licensed to operate any motor vehicle which is required to be
145	144		placarded for hazardous materials pursuant to 49 C.F.R., Part 172,
146	145		subpart F, except as provided in subsection F of this section;
147	146		provided, a person eighteen (18) years of age or older may be
148	147		licensed to operate a farm vehicle which is required to be p lacarded
149	148		for hazardous materials pursuant to 49 C. F.R., Part 172, subpart F,
150	149		except as provided in subsection F of this section.
151	150		5. A person at least seventeen (17) years of age who
152	151		successfully completes all examinations required by law may be
153	152		issued by the Department:
154	153		a. a restricted Class A commercial license which shall
155	154		grant to the licensee the privilege to operate a Class
156	155		A or Class B commercial motor vehicle for harvest
157	156		purposes or a Class D motor vehicle, or
158	157		b. a restricted Class B commercial licen se which shall
159	158		grant to the licensee the privilege to operate a Class
160	159		B commercial motor vehicle for harvest purposes or a
161	160		Class D motor vehicle.
162	161		6. No person shall operate a Class D motor vehicle unless the
163	162		person is sixteen (16) years of age or older an d holds a valid Class
164	163		D license, except as provide d for in Section 6-102 or 6-105 of this
165	164		title. Any person holding a valid Class D license shall be
166	165		permitted to operate motor vehicles in Class D only.

193	193		C. Any person issued a driver license pursuant to th is section
194	194		may exercise the privilege thereby gran ted upon all streets and
195	195		highways in this state.
196	196		D. No person shall operate a motorcycle or motor -driven cycle
197	197		without having a valid Class A, B, C or D license with a motorcycle
198	198		endorsement. Except as ot herwise provided by law, any new applicant
199	199		for an original driver license shall be required to successfully
200	200		complete a written examination, vision examination and driving
201	201		examination for a motorcycle as prescribed by the Department of
202	202		Public Safety, and a certified state-approved motorcycle basic rider
203	203		course approved by the Department if the applicant is seventeen (17)
204	204		years of age or younger to be eligible for a motorcycle endorsement
205	205		thereon. The written examination and driving examination for a
206	206		motorcycle shall be waived by the Department of Public Sa fety upon
207	207		verification that the person has successfully completed a certified
208	208		Motorcycle Safety Foundation rider course approved by the
209	209		Department.
210	210		E. Except as otherwise provided by law, any person who la wfully
211	211		possesses a valid Oklahoma driver license w hich is eligible for
212	212		renewal shall be required to successfully complete a written
213	213		examination, vision examination and driving examination for a
214	214		motorcycle as prescribed by the Department, and a certified st ate-
215	215		approved motorcycle basic rider course approve d by the Department if
216	216		the person is seventeen (17) years of age or younger to be eligible

243	244		for a motorcycle endorsement. The written examination and driving
244	245		examination for a motorcycle shall be waived by the Department of
245	246		Public Safety upon verification that the person has successfully
246	247		completed a certified Motorcycle Safety Foundation rider course
247	248		approved by the Department.
248	249		F. 1. Any person eighteen (18) years of age or older may apply
249	250		for a restricted Class A, B or C commercial learner permit. The
250	251		Department, after the applicant has passed all parts of the
251	252		examination for a Class D license and has successfully passed all
252	253		parts of the examination for a Class A, B or C commercial license
253	254		other than the driving examination, may issue to the applicant a
254	255		commercial learner permit which shall entitle the person having
255	256		immediate lawful possession of the commercial learner permit and a
256	257		valid Oklahoma driver license or provisional driver license pursuant
257	258		to Section 6-212 of this title to operate a Class A, B o r C
258	259		commercial motor vehicle upon the public highways solely for the
259	260		purpose of behind-the-wheel training in accordance with rules
260	261		promulgated by the Department.
261	262		2. This commercial learner permit shall be issued for a period
262	263		as provided in Section 6 -115 of this title of one hundred eighty
263	264		(180) days, which may be renewed one time for an additional one
264	265		hundred eighty (180) days; provided, such commercial learner permit
265	266		may be suspended, revoked, canceled, de nied or disqualified at the
266	267		discretion of the Depa rtment for violation of the restrictions, for

293	295		failing to give the required or correct information on the
294	296		application or for violation of any traffic laws of this state
295	297		pertaining to the operation of a motor vehicle. Except as otherwise
296	298		provided, the lawful possessor of a commercial learner permit who
297	299		has been issued a commercial learner permit for a minimum of
298	300		fourteen (14) days may have the restriction requiring an
299	301		accompanying driver removed by satisfacto rily completing a driver’s
300	302		examination; provided, the removal of a restriction shall not
301	303		authorize the operation of a Class A, B or C commercial motor
302	304		vehicle if such operation is otherwise prohibited by law.
303	305		3. No person shall apply for and the Departmen t shall not issue
304	306		an original Class A, B or C driv er license until the person has been
305	307		issued a commercial learner permit and held the permit for at least
306	308		fourteen (14) days. Any person who currently holds a Class B or C
307	309		license and who wishes to apply fo r another class of commercial
308	310		driver license shall be required to apply for a commercial learner
309	311		permit and to hold the permit for at least fourteen (14) days before
310	312		applying for the Class A or B license, as applicable. Any person
311	313		who currently holds a Cl ass A, B or C license and who wishes to add
312	314		an endorsement or remove a restriction for which a skills
313	315		examination is required shall be required to apply for a commercial
314	316		learner permit and to hold the permit for at least fourteen (14)
315	317		days before applying for the endorsement.

342	345		4. A commercial learner perm it shall be issued by the
343	346		Department as a separate and unique document which shall be valid
344	347		only in conjunction with a valid Oklahoma driver license or
345	348		provisional driver license pursuant to Section 6 -212 of this title,
346	349		both of which shall be in the posses sion of the person to whom they
347	350		have been issued whenever that person is operating a commercial
348	351		motor vehicle as provided in this subsection.
349	352		5. After one renewal of a commercial learner permit, as
350	353		provided in paragraph 2 of this subsection, a commercial permit
351	354		shall not be renewed again. Any person who has held a commercial
352	355		learner permit for the initial issuance period and one renewal
353	356		period shall not be eligible for and the Department shall not issue
354	357		another renewal of the permit; provided, the person may reapply for
355	358		a new commercial learner permit, as provided for in this subsection.
356	359		G. 1. For purposes of this title:
357	360		a. "REAL ID Compliant Driver License" or "Identification
358	361		Card" means a driver license or identification card
359	362		issued by the State of Okl ahoma that has been
360	363		certified by the United States Department of Homeland
361	364		Security (USDHS) as compliant with the requirements of
362	365		the REAL ID Act of 2005, Public Law No. 109 -13. A
363	366		REAL ID Compliant Driver L icense or Identification
364	367		Card and the process thro ugh which it is issued
365	368		incorporate a variety of security measures designed to

393	397		license or card. A REAL ID Compliant Driver License
394	398		or Identification Card wil l be clearly marked on the
395	399		face indicating that it is a compliant document, and
396	400		b. "REAL ID Noncompliant Driver License" or
397	401		"Identification Card" means a driver license or
398	402		identification card issued by the State of Oklahoma
399	403		that has not been certified by t he United States
400	404		Department of Homeland Security ( USDHS) as being
401	405		compliant with the requirements of the REAL ID Act. A
402	406		REAL ID Noncompliant Driver License or Identification
403	407		Card will be clearly marked on the face indicating
404	408		that it is not compliant with the federal REAL ID Act
405	409		and is not acceptable for official federal purposes.
406	410		The driver license or identification card will have a
407	411		unique design or color indicator that clearly
408	412		distinguishes it from a compliant license or card.
409	413		2. Original Driver License and Identification Card Issuance:
410	414		a. Application for an original REAL ID Compliant or REAL
411	415		ID Noncompliant Driver License or Identification Card
412	416		shall be made to the Department of Public Safety
413	417		through December 31, 2022. Beginning January 1, 2023,
414	418		application for an original REAL ID Compliant Driver
415	419		License or Identification Card may be made to Service

446	451		Noncompliant Driver License or Identification Card
447	452		shall be made to Service Oklahoma .
448	453		b. Department of Public Safety employees shall perform
449	454		all document recognition and other requirements needed
450	455		for approval of an or iginal REAL ID Compliant or REAL
451	456		ID Noncompliant Driver License or Identification Card
452	457		application through December 31, 2022. Beginning
453	458		January 1, 2023, Service Oklahoma employees or
454	459		authorized licensed operators shall perform all
455	460		document recognition and other requirements needed for
456	461		approval of an original REAL ID Compliant Driver
457	462		License or Identification Card application. Service
458	463		Oklahoma employees shall perform all document
459	464		recognition and other requirements needed for approval
460	465		of a REAL ID Noncompli ant Driver License or
461	466		Identification Card applicat ion.
462	467		c. Upon approval of an original REAL ID Compliant or REAL
463	468		ID Noncompliant Driver License or Identification Card
464	469		application, the applicant may take the approved
465	470		application document to a motor license agent to

494	500		d. The motor license agent shall process the approved
495	501		REAL ID Compliant or REAL ID Noncompliant Driver

498	504		license or identification ca rd. A temporary driver
499	505		license or identification card shall afford the holder
500	506		the privileges otherwise granted by the specific class
501	507		of driver license or identification card for the
502	508		period of time listed o n the temporary driver license
503	509		or identification card or the period of time prior to
504	510		the applicant receiving a REAL ID Compliant or REAL ID
505	511		Noncompliant Driver License or Identification Card,
506	512		whichever time period is shorter.
507	513		3. REAL ID Compliant Driver L icense and Identification Card
508	514		Renewal and Replacement:
509	515		a. Application for renewal or replacement of a REAL ID
510	516		Compliant Driver License or Identification Card may be
511	517		made to the Department of Public Safety or to a motor
512	518		license agent; provided, such motor license agent is
513	519		authorized to process application for REAL ID
514	520		Compliant Driver Licenses and Identification Cards. A
515	521		motor license agent may process the voluntary

550	557		License or Identification Card application.
551	558		c. Upon approval of a renewal or replacement REAL ID
552	559		Compliant Driver License or Identification Card
553	560		application, the applicant may receive a temporary
554	561		driver license or identification card from the
555	562		Department of Public Safety or an authorized motor
556	563		license agent.
557	564		d. A temporary driver license or identification card
558	565		acquired under the provisions of this paragraph shall
559	566		afford the holder the privileges othe rwise granted by
560	567		the specific class of driver lice nse or identification
561	568		card being renewed or replaced for the period of time
562	569		listed on the temporary driver license or
563	570		identification card or the period of time prior to the
564	571		applicant receiving a REAL ID Com pliant Driver License

595	603		an individual with a valid Oklahoma -issued driver
596	604		license or identification card shall be considered a
597	605		renewal of a REAL ID Compliant Driver License or
598	606		Identification Card.
599	607		4. REAL ID Noncompliant Driver License and Identification Card
600	608		Renewal and Replacement:
601	609		a. Application for renewal or replacement of a REAL ID
602	610		Noncompliant Driver License or Identification Card may
603	611		be made to the Department of Public Safety or to a
604	612		motor license agent. A motor license agent may
605	613		process the voluntary downgrade of a REAL ID
606	614		Noncompliant Commercial Driver License to any lower
607	615		class license upon request of the licensee; provided,
608	616		no additional endorsements or restrictions are added
609	617		to the license.
610	618		b. Department of Public Safety employees or motor license
611	619		agents shall perform all document recognition and
612	620		other requirements needed for appr oval of a renewal or
613	621		replacement REAL ID Noncompli ant Driver License or
614	622		Identification Card application.

651	660		listed on the temporary driver license or
652	661		identification card or the period of time prior to the
653	662		applicant receiving a REAL ID Noncomplia nt Driver
654	663		License or Identification Card, whicheve r time period
655	664		is shorter.
656	665		H. 1. The fee charged for an approved application for an
657	666		original Oklahoma REAL ID Compliant or REAL ID Noncompliant Driver
658	667		License or an approved application for the addition of an
659	668		endorsement to a current valid Oklahoma REAL I D Compliant or REAL ID
660	669		Noncompliant Driver License shall be assessed in accordance with the
661	670		following schedule:

795	807		M. Notwithstanding the provisions of Section 1104 of this
796	808		title, of each fee charged purs uant to the provisions of subsections
797	809		J, K and L of this section:
798	810		1. Five Dollars and fifty cents ($5.50) of a 4 -year license or
799	811		Eleven Dollars ($11.00) of an 8 -year license shall be deposited to
800	812		the Trauma Care Assistance Revolving Fund created in Sectio n 1-

891	905		Q. In accordance with the provisions of subsection G of this
892	906		section, the Department of Public Safety and the Oklahoma Tax
893	907		Commission are authorized to promulgate rules for the issuance and
894	908		renewal of driver licenses authorized pursuant to the provisions of
895	909		Sections 6-101 through 6-309 of this title; provided, that no su ch
896	910		rules applicable to the issuance or renewal of REAL ID Noncompliant
897	911		Driver Licenses shall create more stringent standards than such
898	912		rules applicable as of January 1, 2017, unless directly related to a
899	913		specific change in statutory law concerning standard s for REAL ID
900	914		Noncompliant Driver Licenses. Applications, upon forms approved by
901	915		the Department of Public Safety, for such licenses shall be handled,
902	916		in accordance with the provisions of subsection G of th is section,
903	917		by the motor license agents; provided, the Department of Public
904	918		Safety is authorized to assume these duties in any county of this
905	919		state. Each motor license agent accepting applications for driver
906	920		licenses shall receive Six Dollars ($6.00) for a 4-year REAL ID
907	921		Noncompliant Driver License or Tw elve Dollars ($12.00) for an 8 -year
908	922		REAL ID Noncompliant Driver License or Ten Dollars ($10.00) for a 4 -
909	923		year REAL ID Compliant Driver License or Twenty Dollars ($20.00) for
910	924		an 8-year REAL ID Compliant Drive r License to be deducted from the
911	925		total collected for each license or renewal application accepted.

939	954		license agent accepting applications for driver licenses for

941	956		applications for drivers pursuant to subsection P of this section
942	957		shall receive Six Dollars ($6.00) for a 4 -year driver license or
943	958		Twelve Dollars ($12.00) for an 8 -year driver license to be deducted
944	959		daily by the motor license agen t receipts. The amount retained
945	960		pursuant to this subsection shall not be retained by any state
946	961		agency. The fees received by the motor license agent, authorized by
947	962		this subsection, shall be used for operating expenses.
948	963		R. Notwithstanding the provisions o f Section 1104 of this title
949	964		and subsection Q of t his section and except as provided in
950	965		subsections H and M of this section, the first Sixty Thousand
951	966		Dollars ($60,000.00) of all monies collected pursuant to this
952	967		section shall be paid by the Oklahoma Tax Co mmission to the State
953	968		Treasurer to be deposited in the General Revenue Fund of the State
954	969		Treasury.
955	970		The next Five Hundred Thousand Dollars ($500,000.00) of monies
956	971		collected pursuant to this section shall be paid by the Tax
957	972		Commission to the State Treasurer to be deposited each fiscal year
958	973		under the provisions of this section to the credit of the Department
959	974		of Public Safety Restricted Revolving Fund for the purpose of the
960	975		Statewide Law Enforcement Communications System. All other monies
961	976		collected in excess o f Five Hundred Sixty Thousand Dollars

991	1007		S. The Department of Public Safety shall retain the images
992	1008		displayed on licenses and identification cards issued pursuant to
993	1009		the provisions of Sections 6 -101 through 6-309 of this title which
994	1010		may be used only:
995	1011		1. By a law enforcement agency for purposes of criminal
996	1012		investigations, missing person investigations or any law enforcem ent
997	1013		purpose which is deemed necessary by the Commi ssioner of Public
998	1014		Safety;
999	1015		2. By the driver licensing agency of another state for its
1000	1016		official purpose; and
1001	1017		3. As provided in Section 2 -110 of this title.
1002	1018		All agencies approved by the Oklahoma Law Enforcem ent
1003	1019		Telecommunications System (OLETS) or the Natio nal Law Enforcement
1004	1020		Telecommunications System (NLETS) to receive photographs or
1005	1021		computerized images may obtain them through OLETS or through NLETS.
1006	1022		Photographs or computerized images may be obtained by law
1007	1023		enforcement one inquiry at a time.
1008	1024		The computer system and related equipment acquired for this
1009	1025		purpose must conform to industry standards for interoperability and
1010	1026		open architecture. The Department of Public Safety may promulgate
1011	1027		rules to implement the pr ovisions of this subsection.

1044	1061		or identification card has been surrendered to the Department by the
1045	1062		applicant. The Department may promulgate rules related to the
1046	1063		issuance of replacement REAL ID Compliant Driver Licenses in the
1047	1064		event of loss or theft.
1048	1065		U. Upon the effective date of this act Beginning May 24, 2021,
1049	1066		and ending on April 30, 2023, in addition to the amounts p rovided in
1050	1067		subsection Q of this section, a motor l icense agent shall receive
1051	1068		Five Dollars ($5.00) for each processed application for a REAL ID
1052	1069		Compliant 4-year Driver License and Ten Dollars ($10.00) for each
1053	1070		processed application for a REAL ID Compliant 8 -year Driver License.
1054	1071		Any additional amounts prov ided pursuant to this subsection shall
1055	1072		not be retained by the Department of Public Safety.
1056	1073		SECTION 2. It being immediately necessary for the preservation
1057	1074		of the public peace, health or safe ty, an emergency is hereby
1058	1075		declared to exist, by r eason whereof this act shall take effect and

1149		-	SECTION 3. AMENDATORY 47 O.S. 2021, Section 6-101, is
1150		-	amended to read as follows:
1151		-	Section 6-101. A. No person, except those hereinafter
1152		-	expressly exempted in Sections 6 -102 and 6-102.1 of this title,
1153		-	shall operate any motor vehicle upon a highway in this state unless

1250		-	6. No person shall operate a Class D motor vehicle unless the
1251		-	person is sixteen (16) years of age or o lder and holds a valid Class
1252		-	D license, except as provided for in Section 6 -102 or 6-105 of this
1253		-	title. Any person holding a valid Class D license shal l be
1254		-	permitted to operate motor vehicles in Class D only.
1255		-	C. Any person issued a driver license pursuan t to this section
1256		-	may exercise the privilege thereby granted upon all street s and
1257		-	highways in this state.
1258		-	D. No person shall operate a motorcycle or mo tor-driven cycle
1259		-	without having a valid Class A, B, C or D license with a motorcycle
1260		-	endorsement. Except as otherwise provided by law, any new applicant
1261		-	for an original driver lic ense shall be required to successfully
1262		-	complete a written examination, visio n examination and driving

1345		-	to Section 6-212 of this title to operate a Class A, B or C
1346		-	commercial motor vehicle upon the public highways solely for the
1347		-	purpose of behind-the-wheel training in accordance with rules
1348		-	promulgated by the Department.
1349		-	2. This commercial learner permit shall be issued for a period
1350		-	as provided in Section 6 -115 of this title of o ne hundred eighty
1351		-	(180) days, which may be renewed one time for an additional one
1352		-	hundred eighty (180) days; provided, such commercial learner permit
1353		-	may be suspended, revoked, can celed, denied or disqualified at the
1354		-	discretion of the Department for violat ion of the restrictions, for
1355		-	failing to give the required or correct informat ion on the
1356		-	application or for violation of any traffic laws of this state
1357		-	pertaining to the operation of a motor vehicle. Except as otherwise
1358		-	provided, the lawful possessor of a commercial learner permit who
1359		-	has been issued a commercial learner permit fo r a minimum of
1360		-	fourteen (14) days may have the restriction requiring an
1361		-	accompanying driver removed by satisfactorily completing a driver’s
1362		-	examination; provided, the removal of a restriction shall not

1390		-	vehicle if such operation is otherwise prohibited by law.
1391		-	3. No person shall apply for and the Department shall not issue
1392		-	an original Class A, B or C driver license until the person has been
1393		-	issued a commercial learner permit and held the permit for at least
1394		-	fourteen (14) days. Any person who currently holds a Class B or C
1395		-	license and who wishes t o apply for another class of commercial
1396		-	driver license shall be required to apply for a commercial learner
1397		-	permit and to hold the permit for at least fo urteen (14) days before
1398		-	applying for the Class A or B license, as applicable. Any person
1399		-	who currently holds a Class A, B or C license and who wishes to add
1400		-	an endorsement or remo ve a restriction for which a skills
1401		-	examination is required shall be require d to apply for a commercial
1402		-	learner permit and to hold the permit for at least fourteen (14)
1403		-	days before applying for the endorsement.
1404		-	4. A commercial learner permit shall be issu ed by the
1405		-	Department as a separate and unique document which shall be valid
1406		-	only in conjunction with a valid Oklahoma driver license or
1407		-	provisional driver license pursuant to Secti on 6-212 of this title,
1408		-	both of which shall be in the possession of the pers on to whom they
1409		-	have been issued whenever that person is operating a commer cial
1410		-	motor vehicle as provided in this subsection.
1411		-	5. After one renewal of a commercial learner permit, as
1412		-	provided in paragraph 2 of this subsection, a commercial permit

1441		-	period shall not be eligible for and the Department shall no t issue
1442		-	another renewal of the permit; provided, the person may reapply for
1443		-	a new commercial learner permit, as provided for in this subsection.
1444		-	G. 1. For purposes of this title:
1445		-	a. “REAL ID Compliant Driver License” or “Identification
1446		-	Card” means a driver license or identification card
1447		-	issued by the State of Oklahoma that has b een
1448		-	certified by the United States Department of Homeland
1449		-	Security (USDHS) as compliant with the requirements of
1450		-	the REAL ID Act of 2005, Public Law No. 109-13. A
1451		-	REAL ID Compliant Driver License or Identification
1452		-	Card and the process through which it is issued
1453		-	incorporate a variety of security measures designed to
1454		-	protect the integrity and trustworthiness of the
1455		-	license or card. A REAL ID Compliant Driver License
1456		-	or Identification Card will be clearly marked on the
1457		-	face indicating that it is a compliant document, and
1458		-	b. “REAL ID Noncompliant Driver License” or
1459		-	“Identification Card” means a driver license or
1460		-	identification card issued by the State of Oklahoma
1461		-	that has not been cert ified by the United States
1462		-	Department of Homeland Security (USDHS) as being

1493		-	and is not acceptable for official federal purposes.
1494		-	The driver license or identification card will have a
1495		-	unique design or color indicator that clearly
1496		-	distinguishes it from a compliant license or card.
1497		-	2. Original Driver License and Identification Card Issuance:
1498		-	a. Application for an original REAL ID Compliant or REAL
1499		-	ID Noncompliant Driver License or Identific ation Card
1500		-	shall be made to the Department of Public Safety.
1501		-	b. Department of Public Safety employees shall perform
1502		-	all document recognition and other requirements neede d
1503		-	for approval of an original REAL ID Compli ant or REAL
1504		-	ID Noncompliant Driver License or Identification Card
1505		-	application.
1506		-	c. Upon approval of an original REAL ID Compliant or REAL
1507		-	ID Noncompliant Driver License or Identification Card
1508		-	application, the appl icant may take the approved
1509		-	application document to a motor license agent to
1510		-	receive a temporary driver license or identification
1511		-	card.

1544		-	the privileges otherwise granted by the specific class
1545		-	of driver license or identification card for the
1546		-	period of time listed on the temporary driver license
1547		-	or identification card or the period of time prior to
1548		-	the applicant receiving a REAL ID Compliant o r REAL ID
1549		-	Noncompliant Driver License or Identification Ca rd,
1550		-	whichever time period is shorter.
1551		-	3. REAL ID Compliant Driver License and Identification Card
1552		-	Renewal and Replacement:
1553		-	a. Application for renewal or replacement of a REAL ID
1554		-	Compliant Driver License or Identification Card may be
1555		-	made to the Department of Public Safety or to a motor
1556		-	license agent; provided, such motor license agent is
1557		-	authorized to process application for REAL ID
1558		-	Compliant Driver Licenses and Identification Cards. A
1559		-	motor license agent may process the voluntary
1560		-	downgrade of a REAL ID Co mpliant Commercial Driver
1561		-	License to any lower class license upon request of the

1599		-	Department of Public Safety or an authorized motor
1600		-	license agent.
1601		-	d. A temporary driver license or identification card

1605		-	card being renewed or replaced for the period of time
1606		-	listed on the temporary driver license or

1702		-	License or an approved applica tion for the addition of an
1703		-	endorsement to a current valid Oklahoma REAL ID Compliant or REAL ID
1704		-	Noncompliant Driver License shall be assessed in accordan ce with the
1705		-	following schedule:

1743		-	shall be deposited in the General Revenue Fun d of this state.
1744		-	I. The fee charged for any failed examination shall be Four
1745		-	Dollars ($4.00) for any license classification. Notwithstanding the
1746		-	provisions of Section 1104 of this title, all monies collected from
1747		-	such examination fees pursuant to the pro visions of this subsection
1748		-	shall be deposited in the General Re venue Fund of this state.
1749		-	J. In addition to any fee charged pursuant to the provisions of
1750		-	subsection H of this section, the fee charged for the issuance or
1751		-	renewal of a REAL ID Noncompliant Dr iver License shall be in
1752		-	accordance with the following schedule ; provided, that any applicant
1753		-	who has a CDL Learner Permit shall be charged only the replacement
1754		-	fee for the issuance of the license:

1839		-	M. Notwithstanding the provisions of Section 1104 of this
1840		-	title, of each fee charged purs uant to the provisions of sub sections
1841		-	J, K and L of this section:
1842		-	1. Five Dollars and fifty cents ($5.50) of a 4-year license or
1843		-	Eleven Dollars ($11.00) of an 8 -year license shall be deposited to
1844		-	the Trauma Care Assistance Revolving Fund created in Sectio n 1-
1845		-	2530.9 of Title 63 of the Oklahoma Statutes;
1846		-	2. Six Dollars and s eventy-five cents ($6.75) of a 4-year
1847		-	license or Thirteen Dollars and f ifty cents ($13.50) o f an 8-year
1848		-	license shall be deposited to the Dep artment of Public Safety
1849		-	Computer Imaging Sys tem Revolving Fund to be used solely for the
1850		-	purpose of administration and maintenance of the computerized
1851		-	imaging system of the Department;
1852		-	3. Ten Dollars ($10. 00) of a 4-year license or Twenty Dollars
1853		-	($20.00) of an 8-year license shall be deposited to the Department
1854		-	of Public Safety Revolving Fund for all original or ren ewal
1855		-	issuances of licenses; and
1856		-	4. Five Dollars ($5.00) of a 4 -year license or Six Dollars
1857		-	($6.00) of an 8-year license shall be deposited to the State Public
1858		-	Safety Fund created in Sec tion 2-147 of this title.

1899		-	Forces of the United States to be a disabled veteran i n receipt of
1900		-	compensation at the one-hundred-percent rate for a permanent
1901		-	disability sustained through military action or accident resulting
1902		-	from disease contracted while in such active service and registered
1903		-	with the veterans registry created by the Oklah oma Department of
1904		-	Veterans Affairs shall be ch arged a fee for the issuance,
1905		-	replacement or renewal of an Oklahoma driv er license; provided, that
1906		-	if a veteran has been previously exempt from a fee pursuant to this
1907		-	subsection, no registration with the vetera ns registry shall be
1908		-	required.

1936		-	section, the Department o f Public Safety and the Oklahoma Tax
1937		-	Commission are authoriz ed to promulgate rules for the issuance and
1938		-	renewal of driver licenses authori zed pursuant to the provisions of
1939		-	Sections 6-101 through 6-309 of this title; provided, that no such
1940		-	rules applicable to the issuance or renewal of REAL ID Noncompliant
1941		-	Driver Licenses shall create more stringent standards than such
1942		-	rules applicable as of January 1, 2017, unless directly related to a
1943		-	specific change in statutory law concerning standards for REAL ID
1944		-	Noncompliant Driver Licenses. Applications, upon forms approved b y
1945		-	the Department of Public Safety, for such licenses shall be handled,
1946		-	in accordance with the provisions of subsection G of this section,
1947		-	by the motor license agents; provided, the Department of P ublic
1948		-	Safety is authorized to assume these duties in any cou nty of this
1949		-	state. Each motor license agent accepting applications for driver
1950		-	licenses shall receive Six Dollars ($6.00) for a 4-year REAL ID
1951		-	Noncompliant Driver License or Twelve Dollars ($12.00) for an 8-year
1952		-	REAL ID Noncompliant Driver License or Ten Dollars ($10.00) for a 4-
1953		-	year REAL ID Compliant Driver Lic ense or Twenty Dollars ($20.00) for
1954		-	an 8-year REAL ID Compliant Driver License to be deducted from the
1955		-	total collected for each license or renewal application accepted.
1956		-	Beginning July 1, 2022 , and ending on May 31, 2023, each motor
1957		-	license agent or licensed operator accepting applications for driver
1958		-	licenses for individuals over the age of sixty -five (65) years or

1989		-	receipts. The amount retained pursuant to this subsection shall not
1990		-	be retained by any state agency. The fees received by the motor
1991		-	license agent, authorized by this subsection, shall be used for
1992		-	operating expenses. For purposes of this s ubsection, “licensed
1993		-	operator” shall mean an individual who ob tains a license from the
1994		-	Service Oklahoma Operator Board to operate a designated Service
1995		-	Oklahoma location and offers third -party fulfillment of designated
1996		-	services to be rendered by Service Okl ahoma.
1997		-	R. Notwithstanding the provisions of Section 1104 of t his title
1998		-	and subsection Q of this section and except as provided in
1999		-	subsections H and M of this section, the first Sixt y Thousand
2000		-	Dollars ($60,000.00) of all monies collected pursuant to this
2001		-	section shall be paid by the Oklahoma Tax Commission to the Sta te
2002		-	Treasurer to be deposited in the General Revenue Fund of the State
2003		-	Treasury.
2004		-	The next Five Hundre d Thousand Dollars ( $500,000.00) of monies
2005		-	collected pursuant to this section shall be paid by the Tax
2006		-	Commission to the State Treasurer to be deposited eac h fiscal year

2040		-	S. The Department of Public Safet y shall retain the images
2041		-	displayed on licenses and identifica tion cards issued pursuant to
2042		-	the provisions of Sections 6-101 through 6-309 of this title which
2043		-	may be used only:
2044		-	1. By a law enforcement agency for purposes of criminal
2045		-	investigations, missin g person investigations or any law enforcement
2046		-	purpose which is deemed necessary by the Commissioner of Public
2047		-	Safety;
2048		-	2. By the driver lice nsing agency of another state for its
2049		-	official purpose; and
2050		-	3. As provided in Section 2-110 of this title.
2051		-	All agencies approved by the Oklahoma Law Enforcement
2052		-	Telecommunications System (OLETS) or the National Law Enforcement
2053		-	Telecommunications System (N LETS) to receive photographs or
2054		-	computerized images may obtain them through OLETS or through NLETS.
2055		-	Photographs or computerized images may be obtained by law
2056		-	enforcement one inquiry at a time.
2057		-	The computer system and related equipment acquired for this
2058		-	purpose must conform to industry standards for interoperability and
2059		-

2086		-	rules to implement the provisions of this su bsection.
2087		-	T. No person may hold more than one state-issued or territory-
2088		-	issued REAL ID Compliant Driver License or REA L ID Compliant
2089		-	Identification Card from Oklahoma or any other state or terr itory.
2090		-	The Department shall not issue a REAL ID Compliant Dri ver License to
2091		-	a person who has been previously issued a REAL ID Compliant Driv er
2092		-	License or REAL ID Compliant Identifi cation Card until such license
2093		-	or identification card has been surrendered to the Department by the
2094		-	applicant. The Department may promul gate rules related to the
2095		-	issuance of replacement REAL ID Compliant Driver Lice nses in the
2096		-	event of loss or theft.
2097		-	U. Upon the effective date of this act Beginning May 24, 2021,
2098		-	and ending on April 30, 2023, in addition to the amounts pr ovided in
2099		-	subsection Q of this section, a motor license agent shall receive
2100		-	Five Dollars ($5.00) for each processed appli cation for a REAL ID
2101		-	Compliant 4-year Driver License and Ten Dollars ($10.00) for each
2102		-	processed application for a REAL ID Compliant 8 -year Driver License.
2103		-	Any additional amounts provided pursuant to this subsection shall
2104		-	not be retained by the Department of Public Safety.
2105		-	SECTION 4. It being immediately necessary for the pr eservation
2106		-	of the public peace, health or safety, an emergency is hereby
2107		-	declared to exist, by reason whereof this act shall take effect and
