53 | 50 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

54 | 51 | | SECTION 1. NEW LAW A new section of law to be codified |
---|
55 | 52 | | in the Oklahoma Statutes as Section 2-105C of Title 47, unless there |
---|
56 | 53 | | is created a duplication in numb ering, reads as follo ws: |

57 | 54 | | A. As used in this act: |
---|
58 | 55 | | 1. “Oklahoma educational inst itution” means an institution of |
---|
59 | 56 | | higher education within The Oklahoma State System of Higher |
---|
60 | 57 | | Education; |
---|
61 | 58 | | 2. “Eligible Oklahoma Highway Patrol officer” means a current |
---|
62 | 59 | | officer in good standing who has either an associate’s degree or a |
---|
63 | 60 | | minimum of sixty-two (62) successfully completed semester hours from |
---|
93 | 89 | | 3. “Program” means the Oklahoma Highway Patrol Educa tional |
---|
94 | 90 | | Assistance Program established pursuant to the provisions of this |
---|
95 | 91 | | section; and |
---|
96 | 92 | | 4. “Undergraduate program” means a program offered by an |
---|
97 | 93 | | Oklahoma educational institution that leads to the award of a |
---|
98 | 94 | | baccalaureate degree. |
---|
99 | 95 | | B. There is hereby created the Oklahoma Highway Pat rol |
---|
100 | 96 | | Educational Assistance Program to provide assistance to eli gible |
---|
101 | 97 | | Highway Patrol officers who enroll in an Oklahoma educational |
---|
102 | 98 | | institution. The amount of assistance shall be equivalent to the |
---|
103 | 99 | | amount of resident tu ition for courses in which the eligible Highway |
---|
104 | 100 | | Patrol officer is enrolled, not to exceed a maximum of eighteen (18) |
---|
105 | 101 | | credit hours each semester. |
---|
106 | 102 | | 1. The amount of assistan ce provided to an eligible Highway |
---|
107 | 103 | | Patrol officer in an undergrad uate program shall not exceed a |
---|
108 | 104 | | maximum of sixty (60) credit hours in pursuit of a baccalaureate |
---|
109 | 105 | | degree. |
---|
110 | 106 | | 2. Assistance provided pursuant to this section shal l be |
---|
111 | 107 | | granted without limitation other than the amount of funds available |
---|
112 | 108 | | for the Program and the number of eligible Highw ay Patrol officers |
---|
113 | 109 | | who apply. |
---|
144 | 139 | | C. Assistance provided pursuant to this section shall be |

145 | 140 | | allocated to the Oklahoma education insti tution from the Oklaho ma |
---|
146 | 141 | | Highway Patrol Educational Assistance Revolvi ng Fund created |
---|
147 | 142 | | pursuant to Section 2 of this act. |
---|
148 | 143 | | D. 1. To be eligible to apply for the Program, an eligible |
---|
149 | 144 | | Highway Patrol officer shall agree in writing to continue in service |
---|
150 | 145 | | as a Highway Patrol off icer in good standing for not less than |
---|
151 | 146 | | twenty-four (24) months after completion o f the last semester for |
---|
152 | 147 | | which the officer receives assistance pursuant to this section. |
---|
153 | 148 | | 2. To retain eligibility for the Program, an eligible Highway |
---|
154 | 149 | | Patrol officer shall: |
---|
155 | 150 | | a. maintain good academic standing and sati sfactory |
---|
156 | 151 | | academic progress according to standards of the |
---|
157 | 152 | | Oklahoma educational institution in which the officer |
---|
158 | 153 | | is enrolled, |
---|
159 | 154 | | b. maintain the requirements for ret ention and degree |
---|
160 | 155 | | completion as established by the Oklahom a educational |
---|
161 | 156 | | institution in which the member is enrolled, |
---|
162 | 157 | | c. maintain a minimum grade point average of 2.0 on a 4.0 |
---|
163 | 158 | | scale, and |
---|
195 | 189 | | an application on a form prescribed by the Oklahoma Highway Patrol |
---|
196 | 190 | | prior to the semester for which assistance is sought. The Chief of |
---|
197 | 191 | | the Oklahoma Highway Patrol, or his or her designee, shall confirm a |
---|
198 | 192 | | member’s standing and eligibility to the Oklahoma educational |
---|
199 | 193 | | institution in which the student is enrolled. |
---|
200 | 194 | | F. The Chief of the Highway Patrol may deny an application |
---|
201 | 195 | | submitted by an eligible Highway Patrol officer for con tinued |
---|
202 | 196 | | Program assistance if he or she fails to comply with the provi sions |
---|
203 | 197 | | of this section. |
---|
204 | 198 | | G. An eligible Highway Patrol officer who has received Program |
---|
205 | 199 | | assistance pursuant to th e provisions of this section and who fails |
---|
206 | 200 | | to comply with the provisions of this section shall b e required to |
---|
207 | 201 | | repay an amount to be determined by rules promulgated by the |
---|
208 | 202 | | Department of Public Safety. |
---|
209 | 203 | | H. The Department of Public Safety shall promulgate rules to |
---|
210 | 204 | | implement the provisions of this act. |
---|
211 | 205 | | SECTION 2. NEW LAW A new sec tion of law to be codified |

246 | 239 | | Safety from state appropriations. All monies accruing to the credit |
---|
247 | 240 | | of the fund are hereby appropriated and may be budgeted and expended |
---|
248 | 241 | | by the Department of Public Safety for the purpose of providing |
---|
249 | 242 | | assistance to eligible Highway Patrol officers pur suant to the |
---|
250 | 243 | | provisions of Section 1 of this act. Expenditures from the fund |
---|
251 | 244 | | shall be made upon warrants issued by the State Treasurer against |
---|
252 | 245 | | claims filed as prescribed by law with the Director of the Office of |
---|
253 | 246 | | Management and Enterprise Services for approval and payment. |
---|
254 | 247 | | SECTION 3. This act shall become effective Novem ber 1, 2022. |
