5350 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5451 SECTION 1. NEW LAW A new section of law to be codified
5552 in the Oklahoma Statutes as Section 2-105C of Title 47, unless there
5653 is created a duplication in numb ering, reads as follo ws:
5754 A. As used in this act:
5855 1. “Oklahoma educational inst itution” means an institution of
5956 higher education within The Oklahoma State System of Higher
6057 Education;
6158 2. “Eligible Oklahoma Highway Patrol officer” means a current
6259 officer in good standing who has either an associate’s degree or a
6360 minimum of sixty-two (62) successfully completed semester hours from
61+an accredited college or university and whose hours are transferable
62+between recognized i nstitutions;

91-an accredited college or university and whose hours are transferable
92-between recognized institutions;
9389 3. “Program” means the Oklahoma Highway Patrol Educa tional
9490 Assistance Program established pursuant to the provisions of this
9591 section; and
9692 4. “Undergraduate program” means a program offered by an
9793 Oklahoma educational institution that leads to the award of a
9894 baccalaureate degree.
9995 B. There is hereby created the Oklahoma Highway Pat rol
10096 Educational Assistance Program to provide assistance to eli gible
10197 Highway Patrol officers who enroll in an Oklahoma educational
10298 institution. The amount of assistance shall be equivalent to the
10399 amount of resident tu ition for courses in which the eligible Highway
104100 Patrol officer is enrolled, not to exceed a maximum of eighteen (18)
105101 credit hours each semester.
106102 1. The amount of assistan ce provided to an eligible Highway
107103 Patrol officer in an undergrad uate program shall not exceed a
108104 maximum of sixty (60) credit hours in pursuit of a baccalaureate
109105 degree.
110106 2. Assistance provided pursuant to this section shal l be
111107 granted without limitation other than the amount of funds available
112108 for the Program and the number of eligible Highw ay Patrol officers
113109 who apply.
110+3. Assistance allowed by this section shall not be allow ed for
111+courses taken in excess of the requiremen ts for completion of an
112+undergraduate program for the eligible Highway Patro l officer.

141-3. Assistance allowed by this section shall not be allow ed for
142-courses taken in excess of the requiremen ts for completion of an
143-undergraduate program for the eligible Highway Patro l officer.
144139 C. Assistance provided pursuant to this section shall be
145140 allocated to the Oklahoma education insti tution from the Oklaho ma
146141 Highway Patrol Educational Assistance Revolvi ng Fund created
147142 pursuant to Section 2 of this act.
148143 D. 1. To be eligible to apply for the Program, an eligible
149144 Highway Patrol officer shall agree in writing to continue in service
150145 as a Highway Patrol off icer in good standing for not less than
151146 twenty-four (24) months after completion o f the last semester for
152147 which the officer receives assistance pursuant to this section.
153148 2. To retain eligibility for the Program, an eligible Highway
154149 Patrol officer shall:
155150 a. maintain good academic standing and sati sfactory
156151 academic progress according to standards of the
157152 Oklahoma educational institution in which the officer
158153 is enrolled,
159154 b. maintain the requirements for ret ention and degree
160155 completion as established by the Oklahom a educational
161156 institution in which the member is enrolled,
162157 c. maintain a minimum grade point average of 2.0 on a 4.0
163158 scale, and
159+d. maintain satisfactory performance in the Oklahoma
160+Highway Patrol.
161+E. An eligible Oklahoma Highway Patrol officer see king
162+assistance pursuant to the provisions of this secti on shall submit

191-d. maintain satisfactory performance in the Oklahoma
192-Highway Patrol.
193-E. An eligible Oklahoma Highway Patrol officer see king
194-assistance pursuant to the provisions of this secti on shall submit
195189 an application on a form prescribed by the Oklahoma Highway Patrol
196190 prior to the semester for which assistance is sought. The Chief of
197191 the Oklahoma Highway Patrol, or his or her designee, shall confirm a
198192 member’s standing and eligibility to the Oklahoma educational
199193 institution in which the student is enrolled.
200194 F. The Chief of the Highway Patrol may deny an application
201195 submitted by an eligible Highway Patrol officer for con tinued
202196 Program assistance if he or she fails to comply with the provi sions
203197 of this section.
204198 G. An eligible Highway Patrol officer who has received Program
205199 assistance pursuant to th e provisions of this section and who fails
206200 to comply with the provisions of this section shall b e required to
207201 repay an amount to be determined by rules promulgated by the
208202 Department of Public Safety.
209203 H. The Department of Public Safety shall promulgate rules to
210204 implement the provisions of this act.

241-There is hereby created in the State Treasury a revolving fund
242-for the Oklahoma Highway Patrol to be designated the “Oklahoma
243-Highway Patrol Educationa l Assistance Revolving Fund”. The fund
244-shall be a continuing fund, not subject to fiscal year limitat ions,
245-and shall consist of all monies received by the Department of Public
246239 Safety from state appropriations. All monies accruing to the credit
247240 of the fund are hereby appropriated and may be budgeted and expended
248241 by the Department of Public Safety for the purpose of providing
249242 assistance to eligible Highway Patrol officers pur suant to the
250243 provisions of Section 1 of this act. Expenditures from the fund
251244 shall be made upon warrants issued by the State Treasurer against
252245 claims filed as prescribed by law with the Director of the Office of
253246 Management and Enterprise Services for approval and payment.
254247 SECTION 3. This act shall become effective Novem ber 1, 2022.
